SUBJECT: Permanent Encroachment, Litho-Krome Company
INITIATED BY: Department of Engineering
Recommendation: Approve the attached resolution authorizing an encroachment
agreement with the Litho-Krome Company for 1359 - 11th Avenue for an
encroachment of the building onto 11th Avenue right-of-way
Background: The Litho-Krome Company owns the property and building located at
1359 ? 11th Avenue. A recent survey found that the building encroaches onto
11th Avenue a distance of 1.5 feet. The building and said encroachment has
been in place for many years. Litho-Krome Company requested the City to
approve/sign an encroachment agreement that gives legal notice of this
encroachment for the consideration of the sale of this property to others.
Analysis: A review of the proposed encroachment agreement provides the City
the legal right to have the encroachment cleared from the City right-of-way by
180 day written notification to the property owner. Based on this notice, an
encroachment agreement with Litho-Krome is recommended.
Alternatives: Columbus Council has the right to deny the request for an
encroachment agreement.
Financial Considerations: There are no financial expenses to the City.
Legal Considerations: An encroachment agreement must be approved by Columbus
Council.
Recommendations/Actions: Approve an encroachment agreement with the
Litho-Krome Company.

A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE AN ENCROACHMENT
AGREEMENT WITH THE LITHO-KROME COMPANY TO ALLOW AN ENCROACHMENT OF AN EXISTING
BUILDING LOCATED AT 1359 ? 11TH AVENUE TO ENCROACH 1.5 FEET ONTO 11TH AVENUE
RIGHT-OF-WAY.
WHEREAS, the Litho-Krome Company owns the property and building located
at 1359 ? 11th Avenue; and,
WHEREAS, a recent survey of said property found that the existing
building encroaches onto the 11th Avenue 1.5 feet; and,
WHEREAS, the building encroachment onto 11th Avenue has been in place
for many years not causing any problems to the traveling public; and,
WHEREAS, the Litho-Krome Company requests the City to enter into an
encroachment agreement to allow the encroachment to remain; and,
WHEREAS, the encroachment agreement provides that the property shall
remove the encroachment with a 180 day written notice should the City need the
right-of-way.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA HEREBY ORDAINS:
THAT THE CITY MANAGER IS HEREBY AUTHORIZED TO EXECUTE AN ENCROACHMENT
AGREEMENT WITH THE LITHO-KROME COMPANY TO ALLOW AN ENCROACHMENT OF AN EXISTING
BUILDING LOCATED AT 1359 ? 11TH AVENUE TO ENCROACH 1.5 FEET ONTO 11TH AVENUE
RIGHT-OF-WAY.
