SUBJECT: Abandonment/Quit Claim Deed

Recommendation: Authorize the City Manager to execute a Quit Claim Deed

to Buck Investment Property for a portion of an existing fifteen foot storm

drain easement as shown on the replat of Lot 2, Lot 3 and Lot 4, Block "D",

Edgewood; which property is located at 3740 Macon Road.



Background: Buck Investment Company is requesting that the City execute

a Quit Claim Deed for all rights, title and interest the City may have in a

portion of the existing fifteen foot storm drain easement located on replat for

part of Lot 2, Lot 3 and Lot 4, Block "D", Edgewood. The owner relocated the

pipe at his expense.



Analysis: The Engineering Department has examined the property and has no

objection to abandoning that portion of the fifteen foot storm drain easement.

Since the pipe has been installed as part of a development, the owner will be

responsible for maintenance.



Financial Considerations: N/A



Legal Considerations: An easement abandonment requires Council approval.



Recommendations/ Actions: Authorize the City Manager to execute a Quit

Claim Deed to Buck Investment Company for the existing fifteen foot storm drain

easement.
