The Regular Meeting of the Board of Zoning Appeals was held Wednesday, April 2,

2003 at 2:00 P.M., on the 1st Floor of the Government Center Annex, 420-10th

Street. Members present were:

Case No. 03-V29--Denied.



There was no one present to present the appeal of Claudio Lugo-Brun, 6723

Dorsey Drive, for a variance to reduce the corner-side yard setback requirement

from 20 feet to 12 feet, in order to make an addition, 18? x 23?, a covered

patio, to a single family residence. The property is zoned R-3A.



There was no opposition presented to this appeal.



Mr. Fox made a motion, which was seconded by Mr. Edwards, to deny this

appeal because there was no one present for two consecutive meetings. Motion

carried by the affirmative vote of the four Board Members present for this

In her statement and in response to questions from the Board Members, the

applicant gave the following information: She will have no employees and there

will be no additional traffic in the neighborhood. This will be part time

work.

In her statement and in response to questions from the Board Members, the

applicant gave the following information: She will have no employees and there

will be no additional traffic in the neighborhood. This will be full time

work.

VARIANCES.



Case No. 03-V44--Granted.



Dan Clark and John Waldrop, presented the appeal of Old Wood Properties, 10541

County Line Road (Lot A), for a variance to reduce the lot width requirement

from 125 feet to 100 feet, in order to replat a lot, to erect a single family

residence. The property is zoned A-1.



In their statements and in response to questions from the Board Members, Mr.

Clark and Mr. Waldrop gave the following information: The property has

approximately 4 acres, but it has 125 feet of road frontage. In order to make

it into two lots they need to get a variance. This is in an area that is 1.3

miles from Columbus-Manchester Expressway and most of the lots in this area are

2 acres. This will be a spec lot.



There was a letter from Planning stating that the variance request would

constitute a genuine hardship.



There was no opposition presented to this appeal.



Mr. Fox made a motion, which was seconded by Mr. Edwards, to grant this

appeal because this is a large lot and there is not enough acreage to meet the

private road minimum of 5 acres. This will be similar to other flag lots on

County Line Road. There was a letter from Planning stating that they did show

a hardship. Motion carried by the affirmative vote of the four Board Members

present for this meeting.



Case No. 03-V45--Granted.



Dan Clark and John Waldrop, presented the appeal of Old Wood Properties, 10541

County Line Road (Lot B), for a variance to reduce the lot width requirement

from 125 feet to 25 feet, in order to replat a lot, to erect a single family

residence. The property is zoned A-1.



In their statements and in response to questions from the Board Members, Mr.

Clark and Mr. Waldrop gave the following information: The property is 4 acres,

but it has 125 feet of road frontage. In order to make two lots they need to

get a variance. Most of the lots in this area are 2 acres.

Case No. 03-V46--Granted.



R. D. Duncan Jr., 2505 Nancy Street, presented his appeal for a variance to

reduce the rear yard setback requirement from 30 feet to 14 feet, in order to

make an addition, a kitchen, 18? x 21?6?, to a single family residence. The

property is zoned R-1A.



In his statement and in response to questions from the Board Members,

Mr. Duncan gave the following information: The addition he would like to add

to his home is a kitchen. He would like to remove the kitchen from the front

of the house and move it to the rear so that it will be connected with the

eating area. The same materials used will match the house.



There was no opposition presented to this appeal.



Mr. Edwards made a motion, which was seconded by Mr. Fox, to grant this

appeal because this will be a nice improvement and there was no opposition.

Motion carried by the affirmative vote of the four Board Members present for

this meeting.



Case No. 03-V47?-Granted.



Teresa Singleton, 3308 Meadowbrook Drive and Tom Moore

presented the appeal for a variance to reduce the rear yard

setback requirement from 30 feet to 15 feet and to reduce the

corner side yard setback requirement from 25 feet to 20 feet, in

order to make an addition, 20? x 27?, to a single family

residence. The property is zoned R-1A.

In their statements and in response to questions from the Board Members, Mrs.

Singleton and Mr. Moore gave the following information: The materials used for

the addition will be the same as the house. The addition will go no further

back than the existing house. There is a privacy fence and the addition will

not be visible.



When the Chairman asked for opposition, Mr. Byran Hamilton came forward. He

stated, he would like to oppose this variance because this will open up the

flood gates for other changes to be made in the area. It will endanger the

neighborhood and de-value his home. He stated they have a lot of building

material on their property and asked if their house was across from 3333

Meadowbrook Drive.



Mrs. Singleton stated, they do not have building material on their property.

He has their house mixed up with another neighbor, their house is not across

from 3333 Meadowbrook Drive.



Mr. King made a motion, which was seconded by Mr. Fox, to grant this appeal

because this will be a nice addition and the materials used will match the

house. Mr. Hamilton had the Singleton?s house mixed up with one of the other

neighbor?s. Motion carried by the affirmative vote of the four Board Members

present for this meeting.



Case No. 03-V48?-Granted.



Al Picken presented the appeal of David Rehak, 2201-5 Old River Road, from a

Decision of the Building Official that an accessory structure (a barn & a pool)

is not allowed in the side or front yard and an accessory structure (a barn),

may not exceed 14 feet in height. The property is zoned A-1.



In his statement and in response to questions from the Board Members, Mr.

Picken gave the following information: There are 13 acres of land. They have

a private road that fronts the house. They would like to put a barn in front

of the house. The house is not constructed yet. The barn will not be visible

from the road. They would like to put the pool in the side rear yard because

of the topography. Mr. Hal Averett who owns the property across the street

also has an accessory structure in the front yard.

Hal Averett who is head of the Architectural Review Board approves the location

of the barn.



There was no opposition presented to this appeal.



Mr. Fox made a motion, which was seconded by Mr. Edwards, to grant this appeal

because of the topography and to increase the height requirement of the

accessory structure. There was a letter from the developer, Hal Averett,

stating that he approves this request. Motion carried by the affirmative vote

of the four Board Members present for this meeting.



Case No. 03-V49?-Granted.



Terrance White, 4323 Castlewood Court and Danny Dean presented the appeal for a

variance to reduce the rear yard setback requirement from 30 feet to 17 feet,

in order to make an addition, 12? x 16?, a sunroom, to a single family

residence. The property is zoned R-1A.



In their statements and in response to questions from the Board Members, Mr.

White and Mr. Dean gave the following information: The sunroom they would like

to add will be in the center of the house which will shorten the variance to

the back property line from 30 to 17 feet. It will have gutters, a down spout

and glass windows.



There was no opposition presented to this appeal.



Mr. Edwards made a motion, which was seconded by Mr. King, to grant this appeal

because this will be a nice addition to the home and there was no opposition.

this meeting.



Case No. 03-V50?-Tabled.



There was no one present to present the appeal of Wade Branch, 5425 Cranston

Drive, for a variance to reduce the side yard setback requirement from 8 feet

to 5 feet, in order to make an addition, 8? x 12?, a carport, to a single

family residence. The property is zoned R-2.

Case No. 03-V51?-Granted.



Gail Aderhold, Action Buildings presented the appeal of Walter & Betty West,

2501 White Chapel Drive, for a variance to reduce the side yard setback

requirement from 8 feet to 3 feet, in order to make an addition, 11? x 27?, a

carport, to a single family residence. The property is zoned R-2.



In her statement and in response to questions from the Board Members, Ms.

Aderhold gave the following information: Mr. and Mrs. West would like to add a

carport to their home. It will be over an existing concrete slab. The water

will drain off the carport and go to the curb. There are similar carports in

the area.



There was no opposition presented to this appeal.



Mr. King made a motion, which was seconded by Mr. Fox, to grant this appeal

because there was no opposition and Mr. & Mrs. West must add gutters to help

with water control. Motion carried by the affirmative vote of the four Board

Members present for this meeting.



Case No. 03-V52?-Granted.



Mr. & Mrs. Cecil Kent, 6669 Creekview Place, presented their appeal for a

variance to reduce the rear yard setback requirement from 30 feet to 23 feet,

in order to make an addition, 10? x 21?, a screen porch, to a single family

residence. The property is zoned R-2.

In their statements and in response to questions from the Board Members, Mr.

and Mrs. Kent gave the following information: The screen porch will be over an

existing concrete patio. Their screen porch will be similar to other screen

porches in the area. They did receive a letter from the Architectural Review

Committee stating the proposed improvements are the type of investment that

will enhance property values for the entire Creekside neighborhood and are

approved by the committee.

Mr. Fox made a motion, which was seconded by Mr. Edwards, to grant this appeal

because there are other screen porches in the area and they received approval

from the Architectural Review Committee. Motion carried by the affirmative

vote of the four Board Members present for this meeting.



Case No. 03-V53?-Tabled.



Duk Soon Duncan, 5736 Veterans Parkway and Phil Batastini presented the appeal

for a variance to reduce the required number of off-street parking spaces from

80 to 65, in order to make an addition to an existing restaurant. The property

is zoned C-2.



In their statements and in response to questions from the Board Members, Ms.

Duncan and Mr. Batastini gave the following information: They would like to

reduce the number of off-street parking spaces so that they can increase the

capacity of the restaurant. The Fire Department came in and said the seating

capacity was 100 and this added an additional 80 seats. The screen porch was

not on their plans. This was a patio, but now it has a sliding glass door on

it and heating and cooling. She enhanced the building, but didn?t know that

she needed a permit. This location was a bank with a drive thru, the addition

will be where the drive thru was. When they have big sporting events, they have

security and uniform policeman to make sure no one is parking in Mr. Key?s

(Kennon, Parker, Duncan and Key Realtors) parking lot. They make sure someone

goes over to their parking lot and clean up any mess that is made. They have a

verbal agreement with the The Pain Center and the Bank to use their parking lot

for any over flow parking.

Board of Zoning Appeals ? 04/02/2003





When the Chairman asked for opposition, Jack Key of Kennon Parker, Duncan and

Key Realtors came forward. He stated, several years ago when Ms. Suk Soon

Duncan applied for a variance they opposed it because they anticipated the

spill over parking would come over to their parking lot. They had concerns

with disruption of their business. They thought it would be a safety issue and

an inconvenience. Ms. Duncan was denied the variance and she opened the drive

thru lanes as a patio and screened it in. As it got cooler it was glassed in

and heated and cooled. It seems like the whole thing was done backwards; what

do you do if you tell someone they can?t build on to their house, they do it

anyway and came back and ask for approval.



Leah Braxton stated, she was informed by Danny Cargill there was a

letter from Rita Stokes, Property Manager and Agent for the owners of Landmark

Associates, stating they did not receive notice of this variance request. They

would like for this case to be delayed until proper notification has been

received and they have the opportunity to review this request. Danny did check

the mailing list and a letter was sent to them.



Mr. Edwards made a motion, which was seconded by Mr. Fox, to table this appeal

until the May meeting so that the adjacent landowner can have an opportunity to

review this request and Mr. Key and Ms. Duncan can try to resolve there

differences. Motion carried by the affirmative vote of the four Board Members

present for this meeting.



Case No. 03-V54?-Granted.



Gabe Denes, 1805 Wells Drive and Homer Alexander presented the appeal for a

variance to reduce the side yard setback requirement from 5 feet to 3 feet, in

order to make an addition to an accessory structure. The property is zoned

R-1A.



In their statements and in response to questions from the Board Members, Mr.

Denes and Mr. Alexander gave the following information: The structure is a

storage building with a carport attached. They would like to fill in the

existing carport to construct a playroom. There is an existing concrete

pad.

Mr. Fox made a motion, which was seconded by Mr. Edwards, to grant this appeal

because they are enlarging an existing structure. The addition will be over an

existing slab. Motion carried by the affirmative vote of the four Board

Members present for this meeting.



Case No. 03-V55?-Granted.



James Johnson presented the appeal of Columbus Housing Initiative, Inc., 4831

13th Avenue, for a variance to reduce the front yard setback requirement from

20 feet to 15 feet and to reduce the corner-side yard setback requirement from

20 feet to 5 feet, in order to erect a single family residence. The property

is zoned C-3. (Pending rezoning from C-3 to R-3).



In his statement and in response to questions from the Board Members, Mr.

Johnson gave the following information: The reason this property is zoned C-3

is because it is located in the Beallwood area. At one time they did a blanket

C-3 and the homeowners had a chance to go back to residential, but this

resident did not. The house is deplorable, if the resident was not living in

the home it would be condemned. He has been relocated in a house that belongs

to Columbus Housing Initiative. They would like to rebuild a new home for him.

They are not going to subdivide the lot.



There was no opposition presented to this appeal.



Mr. Edwards made a motion, which was seconded by Mr. Fox, to grant this appeal

pending rezoning from C-3 to R-3. Mr. James Johnson did state they were not

going to subdivide this lot. Motion carried by the affirmative vote of the

four Board Members present for this meeting.



HOME OCCUPATIONS.

Jose Manuel Espino, 6029 Flat Rock Road Apt. 430, presented his application for
