A RESOLUTION AUTHORIZING THE CITY MANAGER TO DISPOSE OF THE STREET SEGMENT OF
GREEN ISLAND DRIVE AND RIGHT-OF-WAY BEGINNING AT THE NORTH RIGHT-OF-WAY LINE OF
NEWLY CONSTRUCTED GREEN ISLAND DRIVE CUL-DE-SAC AT GAINES CREEK ROAD
NORTHEASTERLY TO THE WEST RIGHT-OF-WAY LINE OF RIVER ROAD TO COLUMBUS REGIONAL
SENIOR LIVING, INC. BY QUIT CLAIM DEED.
WHEREAS, Columbus Regional Senior Living, Inc. is developing a Continuing Care
Retirement Community on 40 acres of property between River Road and Green
Island Drive having 196 Apartment Homes and Garden Villas; and,
WHEREAS, Green Island Drive runs directly through this development which
creates potential conflicts with residents and patients having to cross a
public roadway; and,
WHEREAS, the developer has worked with the adjoining property owners of Gaines
Creek Subdivision agreeing to certain improvements in order to permanently
close Green Island Drive; and,
WHEREAS, the closure is deemed to be in the public interest.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES:
The following improvements shall be made as a condition of this street
closure:
? Columbus Regional Senior Living, Inc., agrees to provide a pedestrian access
onto the Spring Harbor entrance road from the planned cul-de-sac at the
intersection of Green Island Drive and Gaines Creek Road.
? Columbus Regional Senior Living, Inc., will install a fountain at the planned
pond located between the facility front door and the neighbor's property with
the intent of aerating the pond at all times.
? Columbus Regional Senior Living, Inc., will plant an evergreen screen along
the edge of Green Island Drive between the road and the five neighborhood's
property. The plant material planned for this screen is the same material
currently planted in the area, Illeagnus. Columbus Regional Senior Living,
Inc., will plant three gallon sized plants at five foot intervals and will
attempt to do so early in the construction process so as to allow for growth
before opening.
? Columbus Regional Senior Living, Inc., will agree to "shield" street lights
on the west side of Green Island Drive to direct the light emitted on to
Columbus Regional Senior Living, Inc. property only.
? Columbus Regional Senior Living, Inc., agrees to increase the screening of
Garden Villas 40-42 as specified in the "Supplemental Screening Plan" dated
June 3, 2003, which is made part of this document by reference.
? Columbus Regional Senior Living, Inc., agrees to pay the reasonable and
customary fees for the legal work and survey work required to affect this
transfer.
? Columbus Regional Senior Living, Inc., agrees to create a permanent 50 foot
buffer zone from the edge of lot 1 through lot 6. Columbus Regional Senior
Living, Inc., will record a covenant to prevent any development in the above
buffer zone (excluding roads, retaining walls, utilities or other installations
mandated by local building codes or requirements).
? Columbus Regional Senior Living, Inc., has agreed to engage Bob Best of Best
Landscaping to prepare a landscape plan of evergreen trees and plantings to be
installed between lots 1 through 5 and Green Island Drive. This plan will be
developed in consultation with these five homeowners and Columbus Regional
Senior Living, Inc., agrees to implement this plan so long as the requests of
the homeowners are reasonable in nature.
? Columbus Regional Senior Living, Inc., agrees to maintain, in perpetuity, the
drainage ditches contiguous to lots 1 through 5, along both sides of Green
Island Drive to insure positive water flow and to prevent standing water.
? Columbus Regional Senior Living, Inc., agrees, through an arrangement with
the City, to have installed curb, gutter, sidewalks and resurfacing of Green
Island Drive from Gaines Creek Road to Mountainbrook Road.
? Columbus Regional Senior Living, Inc., agrees to replace the streetlights
along Green Island Drive between Gaines Creek Road and Mountainbrook Road. The
streetlights to be used are envisioned to be the ones currently in use in the
section of Green Island Drive scheduled to be transferred to Columbus Regional
Senior Living, Inc.
? Columbus Regional Senior Living, Inc., agrees to contribute $40,000 for the
installation of a traffic signal at the intersection of River Road (SR 219) and
Double Churches Road.
I.
That the City Manager is hereby authorized to declare surplus and execute a
Quit Claim deed to the street segment of Green Island Drive and right-of-way
beginning at the north right-of-way line of newly constructed Green Island
Drive cul-de-sac at Gaines Creek Road northeasterly to the west right-of-way
line of River Road to Columbus Regional Senior Living, Inc. by Quit Claim deed;
and,
II.
Authorized to file of all deeds and associated documents with the Clerk of
Superior Court.
