SUBJECT: Transfer of Property - State of Georgia, Department of
Corrections
INITIATED BY: City Manager's Office
Recommendation: Approve the attached Resolution authorizing the City
Manager to transfer property to the State of Georgia, Department of Corrections.
Background: On December 15, 1970, property was transferred to the State
of Georgia for the construction of a State Prison Facility. Over the years the
prison has been expanded to include a maintenance shop and refueling station,
and additional improvements have been made to the warden's house. It was
discovered that these expansions and improvements have encroached upon
property actually belonging to Muscogee County (Consolidated Government of
Columbus, Georgia). The encroachments are identified on the attached map as
Parcels 2, and 3A.
Analysis: James Kirk from the Georgia Department of Corrections has requested
the City to consider transferring the properties that the prison system has
encroached upon in addition to other adjacent properties identified on the
attached map as Parcel 4 and 5. The Department of Corrections wishes to
construct a Southwest Regional Office on Parcel 5 and a staff training facility
on Parcel 4.
There is currently a firing range located on Parcel 3B (identified on the
attached map). The City wished to retain this parcel including a 20 foot
access easement for use by the Police and Sheriff?s Departments and the
Marshal?s Office.
The property is to be transferred with the following conditions:
1. Georgia Department of Corrections will comply with the Buffer Ordinance
along the South line to provide a buffer between the nursing home and the
prison.
2. The property will be utilized solely for a regional office and a staff
training facility.
3. The Department of Corrections will keep the firing range mowed and provide
additional maintenance as needed.
Financial Considerations: The State of Georgia will complete the transfer with
no cost to the City.
Legal Considerations: Council must approve the transfer of property owned by
the consolidated government to another government entity in accordance with
Sec. 7-501 of the City Charter.
Recommendations/ Actions: Approve the attached Resolution authorizing the City
Manager to transfer property to the State of Georgia, Department of Corrections
to be used as a prison facility.
