The Regular Meeting of the Board of Zoning Appeals was held Wednesday, March 5,
2003 at 2:00 P.M., on the 1st Floor of the Government Center Annex, 420-10th
Street. Members present were:

Also present were Mr. Danny Cargill, Secretary of the Board, and Ms. Veronica
Pitts, Recording Secretary.
Mr. Fox made a motion, which was seconded by Mr. Edwards to excuse the absence
of Ms. Braxton because of personal business.
CASES TABLED FROM THE FEBRUARY 5TH MEETING.
Case No. 03-V21--Granted.
Bill Hart, 5767 Marlette Court, presented his appeal for a variance to reduce
the front yard setback requirement from 20 feet to 10 feet and to reduce the
rear yard setback requirement from 20 feet to 10 feet, in order to erect a
single family residence, 33? x 41? 6?. The property is zoned R-3B.
In his statement and in response to questions from the Board Members, Mr. Hart
gave the following information: 5763 Marlette Court and 5773 Marlette Court
are adjacent to each other. The setback requirement for the front yard and
rear yard is 20 feet. This will leave only 16 feet to build the house, which is
not enough space. Directly across the street are two houses that are similar
and the same floor plan will be used.

this appeal because these are sub-shaped lots in a contiguously cul-de-sac

Members present for this meeting.
Case No. 03-V22--Granted.
Bill Hart, 5773 Marlette Court, presented his appeal for a variance to reduce
the front yard setback requirement from 20 feet to 10 feet and to reduce the
rear yard setback requirement from 20 feet to 10 feet, in order to erect a
single family residence, 31? 9? x 39?. The property is zoned R-3B.
In his statement and in response to questions from the Board Members, Mr. Hart
gave the following information: 5763 Marlette Court and 5773 Marlette Court

Craig Webber, Best Buy Corporation, 2925 Columbus-Manchester Expressway, and
Robert Teasley, Signs, Inc., presented the appeal for a variance to increase
the maximum height of a sign from 35 feet to 48 feet. The property is zoned
C-3.

In their statements and in response to questions from the Board
Members, Mr. Webber and Mr. Teasley gave the following information: They
brought in pictures that were super-imposed to show how the sign would look.
They would like to increase the height of a sign for more visibility. This
will also be a multi-tenant sign.

grant this appeal because the height is needed for more visibility and this

Case No. 03-V29--Tabled.
There was no one present to present the appeal of Claudio Lugo-Brun, 6723
Dorsey Drive, for a variance to reduce the corner side yard setback requirement
from 20 feet to 12 feet, in order to make an addition, 18? x 23?, a covered
patio, to a single family residence. The property is zoned R-3A.
There was no opposition presented to this appeal.
Mr. Fox made a motion, which was seconded by Mr. Billingsley, to table
this appeal until the April meeting because there was no one present to present
the appeal. Motion carried by the affirmative vote of the four Board Members
present for this meeting.
Case No. 03-V30--Granted.
Herbert Franks, 3816 Weems Road, presented his appeal for a variance to
increase the height requirement of an accessory structure (storage room/shop)
from 14 feet to 23 feet. The property is zoned R-1.

In his statement and in response to questions from the Board Members,
Mr. Franks gave the following information: He would like to increase the
height of his storage building/shop. He is trying to reduce the footprint and
go up. The first floor will be 10 feet and the second floor will be 8 feet, by
the time they do the roof line they will have 23 feet. His neighbor also has a
shop in his back yard.
There was no opposition presented to this appeal.
Mr. Fox made a motion, which was seconded by Mr. Billingsley, to grant
this appeal to increase the height of the storage room/shop. Similar materials
will be used to match the house. There are similar accessory structures in the
area. Motion carried by the affirmative vote of the four Board Members present
for this meeting.
Case No. 03-V31--Granted.
Donald Baine, 504 Old Double Churches Road, presented his appeal for a variance
to increase the height requirement of an accessory structure (pool house) from
14 feet to 16 feet. The property is zoned R-1A.
In his statement and in response to questions from the Board Members,
Mr. Baine gave the following information: The pool house is already
constructed. The pool sits 30 yards from the house. The materials used on the
pool match the house. The pool sits in a valley and will not be visible from
the road.

appeal because the pool house is already constructed. This is a large lot and
the pool house is not visible from the road. There was no opposition to this

Case No. 03-V32?-Granted.
Gail Aderhold, Action Buildings presented the appeal of
Matthew Walker, 424 Leary Avenue, for a variance to reduce the
side yard setback requirement from 8 feet to 5 feet, in order to
make an addition, 12? x 26?, a carport, to a single family
residence. The property is zoned R-1A.
In her statement and in response to questions from the Board Members, Mr.
Aderhold gave the following information: Mr. Walker would like to add a
carport to his home. The carport will be over an existing slab. There is a
wall 3 feet inside of the property line. The water will come to the roof of
the carport and flow to the street. There are similar structures in the area.
There was no opposition presented to this appeal.
Mr. Fox made a motion, which was seconded by Mr. Billingsley, to grant this
appeal because the carport will be over an existing slab. The wall that is
adjacent to the property has adequate land, therefore there should not be a
drainage problem. Motion carried by the affirmative vote of the four Board
Members present for this meeting.
Case No. 03-V33?-Granted.
John Bruce Stephens, 2821 Waverly Avenue, presented his appeal for a variance
to reduce the side yard setback requirement from 5 feet to 3 feet, in order to
erect a storage building, 10? x 16?. The property is zoned R-3A.
In his statement and in response to questions from the Board Members, Mr.
Stephens gave the following information: Presently there is an existing
non-conforming structure (a carport & storage building) that he would like to
take down. He will tear down the carport and leave the storage building. He
will build a new storage building that will be attached to the present storage
building. He will use the same roof structure and there will be a breezeway
between the two storage buildings. The new storage building will be in the
same place as the old carport.

Mr. Edwards made a motion, which was seconded by Mr. Billingsley, to grant this
appeal because this is a narrow lot. A portion of the building will be removed
and he will build a new storage building. This will be a nice improvement to
the area. Motion carried by the affirmative vote of the four Board Members
present for this meeting.
Case No. 03-V34?-Granted.
J. D. Starling, 4421 North Oaks Drive, presented his appeal for a variance to
reduce the corner side yard setback requirement from 25 feet to 10 feet, in
order to erect a carport, 18? x 18?. The property is zoned R-1A.
In his statement and in response to questions from the Board Members, Mr.
Starling gave the following information: He bought a free standing carport and
was told he could put it up, he didn?t know that it wasn?t enough space to do
that. The foundation is already done and he is on a corner lot. There are
similar carports in the area.

Mr. Fox made a motion, which was seconded by Mr. Billingsley, to grant this
appeal because this is a corner lot and he is erecting a detached carport.

Case No. 03-V35?-Granted.
Patrick Aiken, 5948 Sherborne Drive, presented his appeal for a variance to
reduce the side yard setback requirement from 8 feet to 3 feet, in order to
make an addition, 24? x 49?, a great room, bedroom, bathroom & utility room, to
a single family residence. The property is zoned R-2.
In his statement and in response to questions from the Board Members, Mr. Aiken
gave the following information: He would like to make an addition to his
home. He has a pie shape lot and the addition is too close to the back. He
has a privacy fence. If he moved the addition over 5 feet it would encroach on
his concrete pad that he plays basketball on.

Mr. Edwards made a motion, which was seconded by Mr. Billingsley, to grant this
appeal because this is an odd shaped lot and the only encroachment will be on
the very corner on the property. There was no opposition to this appeal. The
privacy fence will block most of the view. Motion carried by the affirmative
vote of the four Board Members present for this meeting.
Case No. 03-V36?-Granted.
Jerald Gilliland, 2810 Cartledge Road, presented his appeal for a variance to
reduce the front yard setback requirement from 30 feet to 22 feet and to reduce
the side yard setback requirement from 10 feet to 7.25 feet, in order to make
an addition, 25? x 52?, a carport, bathroom, laundry room, den & front porch,
to a single family residence. The property is zoned R-1.
In his statement and in response to questions from the Board Members, Mr.
Gilliland gave the following information: He has a front porch with an
aluminum cover over the stoop, they would like to open it up and put a roof
line with columns on the front of it. The house was built in 1955, when the
code came into affect the house was already in place. There is an existing
single pad. There was a letter from a neighbor, Mr. Danny T. Bailey, who
supports Mr. Gilliland?s request.

Mr. Fox made a motion, which was seconded by Mr. Billingsley, to grant this
appeal because the porch is an improvement to the front of the house and it
will be over an existing pad. There was a letter from a neighbor, who
recommends approval of this request. Motion carried by the affirmative vote of

Case No. 03-V37?-Granted.
Michael Lane, 5881 Fornof Road, presented his appeal for a variance to reduce
the side yard setback requirement from 5 feet to 3 feet, in order to erect a
garage, 16? x 30?. The property is zoned R-1.

In his statement and in response to questions from the Board Members, Mr. Lane
gave the following information: He would like to erect a garage and this will
allow him to use 100 percent of his driveway. The garage will sit on a
monolithic slab. It will have gutters installed to collect water and insure no
water damage. It will also have a French drain to prevent water damage to the
garage. The material used will be vinyl siding. There was a letter from Doug
Strickland, a neighbor, who understands that he will be 3 feet from the
property line and does not oppose this request.

Mr. Fox made a motion, which was seconded by Mr. Billingsley, to grant this
appeal because the garage will be over an existing slab. It will be guttered
and have a French drain. Motion carried by the affirmative vote of the four
Board Members present for this meeting.
Case No. 03-V38?-Granted.
Emmett Byrum, 6324 Birling Drive and Donald McRay, presented the appeal for a
variance to reduce the side yard setback requirement from 8 feet to 2 feet, in
order to make an addition, 14? x 24?, a carport, to a single family residence.
The property is zoned R-1A.
In their statements and in response to questions from the Board Members, Mr.
Byrum and Mr. McRay gave the following information: He bought the house 20
years ago and it had an awning with a double carport and he would like to
replace the awning with a permanent carport. The same materials used will
match the house and this will improve the look of the house.

Mr. Edwards made a motion, which was seconded by Mr. Billingsley, to grant this
appeal because he will remove an aluminum carport and build a wood frame
carport that will be an improvement to the neighborhood. There was no

Adam Delk, Freeman & Associates, Inc., 3711 Macon Road, presented the appeal
for a variance to reduce the street frontage buffer requirement from 5 feet to
0. The property is zoned C-2.
In his statement and in response to questions from the Board Members, Mr. Delk
gave the following information: This has always been a service station and we
were going to renovate it, but had to demolish it to make it more sound. The
buffer is going to cause problems with traffic, so we moved the building back
to have easier traffic flow. When Macon Road was widened that limited the flow
of traffic. We are not adjusting access to the station, but we will have
landscape areas on the existing islands.

appeal because this is a replacement of an existing structure. Motion carried
by the affirmative vote of the four Board Members present for this meeting.
Case No. 03-V40?-Granted.
Henry Hargrove presented the appeal of Forrest Park Baptist Church, 1555
Schatulga Road, for a variance to reduce the front yard setback requirement
from 25 feet to 16 feet, in order to make an addition, 22? x 71?, two
restrooms, a classroom and a front porch, to a church. The property is zoned
R-1A.
In his statement and in response to questions from the Board Members, Mr.
Hargrove gave the following information: They would like to make an addition
to their church, two restrooms, a classroom, front porch and a handicapped
ramp. They will tear down the present porch and use it for a handicap ramp and
entrance- way. The existing building sits back on one side, so they will bring
the classroom out to line up with the front of the building.

Lonnie Taylor presented the appeal of Mike Hagues, 1251 Smith Road, for a
variance to increase the height requirement of an accessory structure
(garage/workshop & storage above), from 14 feet to 20 feet. The property is
zoned A-1.
In his statement and in response to questions from the Board Members, Mr.
Taylor gave the following information: Mr. Hagues had 8 acres and he would
like to have a garage/workshop with storage above that is not visible from the
road. Mr. Hague?s neighbor has a similar structure like the one he would like
to have.

appeal to increase the height requirement because this is a multi-acre lot and
the structure will not be visible from the road. Motion carried by the

Case No. 03-V42?-Granted.
Jill Soost presented the appeal of St. Jude Research Hospital, 8109 Highlands
Drive, for a variance to allow a temporary sign in a residential zoned
district. The property is zoned R-1A.
In her statement and in response to questions from the Board Members, Ms. Soost
gave the following information: They are doing a 4 month fund raising campaign
which concludes at the end of April. Once a year they give away a home.
Contractors make donations and do different things. They would like to post a
sign for advertising purposes that will be located approximately 100 feet off
of the road behind the turn-around of the side entry garage. The sign will be
up for one month from March 13th ? April 13th. The house will be given away on
April 12th.

Case No. 03-V43?-Granted.
James McVay, Leary & Brown, presented the appeal of 5096 Boone Links Lane, for
a variance to reduce the rear yard setback requirement from 30 feet to 8 feet,
in order to erect a single family residence. The property is zoned R-3A.
In his statement and in response to questions from the Board Members, Mr. McVay
gave the following information: This is the Ballantyne section of Maple Ridge
and the last cut, so hopefully they will not have to come before the Board
again but a few more times. This is the only corner lot in this cut, the other
corner lots in this section have all required variances to get the detached
garage. They are erecting a house, but the garage is what they need the
request for. They asked for 8 feet, but may need 10 feet.

When the Chairman asked for opposition Mr. Robert Edison and Mrs. Joy Krutext
came forward. Mr. Edison wanted to know if the home business would affect his
rental property located at 42 Munson Drive. Mrs. Krutext wanted to know if the
zoning of the property would be changed.
Mr. Worlds stated that his home business will not affect the neighbors
and the zoning will not be changed.
