The Regular Meeting of the Board of Zoning Appeals was held Wednesday, July 2,

2003 at 2:00 P.M., on the 1st Floor of the Government Center Annex, 420-10th

Street. Members present were:

Also present were Mr. Danny Cargill, Secretary of the Board, and Ms. Veronica

Pitts, Recording Secretary.



Board Member Ralph King was unable to attend the meeting. Mr. Fox made

a motion, which was seconded by Mr. Edwards, to excuse the absence because of

personal business. Motion carried unanimously by the four Board Members

present for this meeting.





CASES TABLED FROM THE JUNE 4th MEETING.



Case No. 03-HO145--Denied.



There was no one present to present the application of James Kevin Yates, 3210

Modler Drive, for a Certificate of Occupancy for a Home Occupation for an

office only for a lawn service, Lawnmower Man Lawn Service. The property is

zoned R-2.



There was no opposition to this application.



Mr. Fox made a motion, which was seconded by Mr. Lewis, to deny this

application because there was no one present for two consecutive meetings.

In his statement and in response to questions from the Board Members, the

applicant gave the following information: He will be using one room in his

home as an office only. This will be full time work. He will have no

employees and there will be no additional traffic in the neighborhood. He will

William Rockemore, 1405 Battle Street, presented his application for a

Certificate of Occupancy for a Home Occupation for an office only for a mobile

In his statement and in response to questions from the Board Members, the

applicant gave the following information: He will be using one room in his

home as an office only. He will have no employees and there will be no

additional traffic in the neighborhood. This will be part time work. He will

set up at different locations to sell his clothes.

In his statement and in response to questions from the Board Members, the

applicant gave the following information: He will be using one room in his

home as an office only. He will have no employees and there will be no

additional traffic in the neighborhood. This will be part time work.

Case No. 03-V77--Tabled.



Daniel Peak, 2026 Preston Drive, Fred Peak (his father) and John Peak (his

brother) presented the appeal for a variance to reduce the rear yard setback

requirement from 30 feet to 8 feet, in order to subdivide a lot to erect a

single family residence. The property is zoned R-1A. Contingent upon replat

approval.



In their statements and in response to questions from the Board Members, they

gave the following information: Daniel is renovating his property and would

like to subdivide the lot so that his brother can build a 2 story house next to

his house. The new house will face Cross Country Hill Road.



When the Chairperson asked for opposition, Bill Green, Bob Wadkins,

Robert Bunch, Charles Rambo, Moffett & Molly Flournoy, Mike & Dorothy Stafford

and Cheryl Carroll came forward.

There was a lawyer, Thomas Flournoy, who was standing with the people in

opposition who stated he was there just as an observer. They stated the house

is too big for the lot, noise problems, lack of privacy, it will de-value their

property, it doesn?t fit the neighborhood, the house they showed on photos of

how the house will look doesn?t fit the character of the neighborhood, the

houses will be jammed up, the lots in the area are deep and they have a lot of

room, this will be the only area where there are 3 lots and it is designed for

2 lots and this is an established neighborhood. There was a petition with

signatures on it of neighbors who oppose this request.



Mr. Edwards made a motion, which was seconded by Mr. Fox, to table this

appeal until the August meeting to give the people that were present and the

other neighbors that were not present an opportunity to find out what Mr. Peak

is going to do. Motion carried by the affirmative vote of the four Board

Members present for this meeting.



Case No. 03-V78--Granted.



Gail Aderhold, Action Buildings, presented the appeal of M. L. Harris United

Methodist (Parsonage), 341 Henson Avenue, for a variance to reduce the side

yard setback requirement from 8 feet to 3 feet, in order to make an addition,

12? x 25?, a carport, to a single family residence. The property is zoned R-1A.



In his statement and in response to questions from the Board Members, Ms.

Aderhold gave the following information: They will be adding a carport to the

parsonage. The carport will go over an existing slab. There are similar

carports in the area. The water will go the street.



There was no opposition presented to this appeal.



Mr. Fox made a motion, which was seconded by Mr. Edwards, to grant this

appeal because there is an existing slab and there are similar carports in the

neighborhood. Motion carried by the affirmative vote of the four Board Members

Board of Zoning Appeals ? 07/02/2003





Case No. 03-V79--Granted.



Paul Money, 507-10 Biggers Road, presented his appeal from a Decision of the

Building Official that an accessory structure may only be located in the rear

yard and may not exceed 14 feet in height, 15 feet shown. The property is

zoned A-1.



In his statement and in response to questions from the Board Members,

Mr. Money gave the following information: He has a 5 acre lot. He would like

to build a barn and exceed the height requirement from 14 to 15 feet, because

of the roof pitch they may have to raise it 1 foot.



There was no opposition presented to this appeal.



Mr. Edwards made a motion, which was seconded by Mr. Fox, to grant this

appeal because this is a large rural lot, even though the Building Official was

correct, the topography dictates where the accessory structure will be

located. There was no impact that was shown that will be on the neighbors.

Motion carried by the affirmative vote of the four Board Members present for

this meeting.



Case No. 03-V80?-Granted.



Silvia Crawford and Donnie Paulk presented the appeal of Woodruff

Contracting Company, 1344 Smith Road, from a Decision of the Building Official

that an accessory structure may only be located in the rear yard. The property

is zoned A-1.



In their statements and in response to questions from the Board Members, Ms.

Crawford and Mr. Paulk gave the following information: Because of the rough

terrain and the septic system he doesn?t have any other place to put the

accessory structure. The accessory structure will be for car storage.



There was no opposition presented to this appeal.



Mr. Fox made a motion, which was seconded by Mr. Edwards, to grant this appeal,

even though the Building Official is correct, because of the topography, sewer

and drainage it prevents the accessory structure from going in the rear of the

house. Motion carried by the affirmative vote of the four Board Members

present for this meeting.

Case No. 03-V81?-Granted.



Cleo Griswood, Pearl Tarver, Rosa Adams, Terry White and Olie Stallwood

presented the appeal of Muscogee County School District, 2100 S. Lumpkin Road,

for a variance to increase the size of a sign from 15 square feet to 40 square

feet. The property is zoned R-2.



In their statements and in response to questions from the Board Members, they

gave the following information: This is a new marquee that was purchased by

the PTA for the school. They would like to increase the size of the sign so

that it can be seen from the street and to inform the community about upcoming

events.



There was no opposition presented to this appeal.



Mr. Lewis made a motion, which was seconded by Mr. Edwards, to grant this

appeal to increase the size of the sign from 15 square feet to 40 square feet

so that the community will be informed about upcoming events and to have more

visibility from the street. Motion carried by the affirmative vote of the four

Board Members present for this meeting.



Case No. 03-V82?-Tabled.



There was no one present to present the appeal of Dana Horne, 5414 15th Avenue,

for a variance to reduce the required number of off-street parking spaces from

16 to 15. The property is zoned A-O.

Case No. 03-V83?-Granted.



John Spurlock/Claudie Spurlock, 4020 Maple Circle, presented the appeal for a

variance to reduce the side yard setback requirement from 8 feet to 1 foot, in

order to make an addition, 14? x 30?, a carport and a front porch, 6? x 29?, to

a single family residence. The property is zoned R-3A.



In their statements and in response to questions from the Board Members, they

gave the following information: This is a corner lot. They would like to add

a carport and front porch to the home. There are similar carports in the

area. Last February they doubled the size of the home and the carport is

needed to protect his mother from the rain. It will have gutters.



There was no opposition presented to this appeal.



Mr. Edwards made a motion, which was seconded by Mr. Fox, to grant this appeal

because when Mr. Spurlock was asked how close he would be with the overhang to

the property line, he stated the 14 feet will include the overhang and he will

add gutters. He will use quality metal material for the addition. Motion

carried by the affirmative vote of the four Board Members present for this

meeting.



Case No. 03-V84?-Granted.



Larry Thomas, 1626 Buford Avenue, presented the appeal for a variance to reduce

the side yard setback requirement from 8 feet to 3 feet, in order to make an

addition, 13? x 24? 1?, a bedroom & bathroom, to a single family residence.

The property is zoned R-2.



In his statement and in response to questions from the Board Members,

Mr. Thomas gave the following information: He would like to add a bedroom and

bathroom to his home. The same materials will be used to match the house.



Mr. Fox made a motion, which was seconded by Mr. Lewis, to grant this appeal to

add a bedroom and bathroom to his home. He is extending the present gable,

which directs any water to the front or rear of the lot. Motion carried by the

affirmative vote of the four Board Members present for this meeting.

Board of Zoning Appeals ? 07/02/2003





Case No. 03-V85?-Granted.



Rob McKenna of Page, Scrantom, Sprouse, Tucker & Ford, P.C., presented the

appeal of W. D. Columbus Portfolio, L.P., 5750 Milgen Road, for a variance to

reduce the required number of parking spaces from 173 to 155. The property is

zoned C-3.



In his statement and in response to questions from the Board Members, Mr.

McKenna gave the following information: This is an existing shopping center.

It was grand-fathered in when the zoning ordinance was passed. They are asking

to have the existing number of parking spaces validated in the event that the

Winn Dixie is destroyed and they could re-build it. There are 155 parking

spaces and they can?t validate that there was a variance that made the

reduction from 173 to 155.



There was no opposition presented to this appeal.



Mr. Fox made a motion, which was seconded by Mr. Edwards, to grant this appeal

because this is an existing structure that already has a preexisting number of

parking spaces. This will make it official that the property has 155 parking

Stanley came forward. They thought Mr. Whitley was going to build

motorcycles. They are concerned with traffic and parking. When they learned

that Mr. Whitley was not going to build motorcycles, they were not in

opposition.
