Response A report has been provided to the City Manager. The off duty Deputy

Sheriff was off work in his personal vehicle but had on his Deputy Sheriff

uniform. Mr Prichett included the City in his law suit but the judge ruled in

the City's favor on a request for dismissal on September 7, 2001. We then

closed the case. I spoke with Mr Prichett on December 11, 2002 and advised him

of my finding in which he was aware of the dismissal. He contends that the

Deputy Sheriff is salaried and had on his uniform and salaried personnel are

always on duty. I consider this matter closed.
