AMENDMENT TO BUILDING AND ROOFTOP LEASE AGREEMENT
The lease agreement made and entered into as of May 1997 between
Consolidated Government of Columbus, Georgia (the ?Landlord?) and
Powertel/Atlanta, Inc. (the ?Tenant?) is hereby amended by adding two new
sentences to paragraph 1(a) and by deleting Section 5 and inserting a new
Section 5 to read as follows:
?1.(a) Tenant is granted permission to install three (3) additional
antennae with an increase in the annual rental in the amount of $250.00 per
antenna for a total annual increase of $750.00 for these additional antennae
pursuant to this paragraph 1(a). As a result of these additions, Tenant also
agrees to pay an additional $375.00 for 2002 annual rent under this agreement.?
?5. Renewal Term Annual Rental
1st (May 1, 2002 thru May 1, 2007) $12,250.00
2nd (May 1, 2007 thru May 1, 2012) $14,087.50
The annual rental for the renewal for the renewal terms shall be payable in the
same manner as the annual rental for the Initial Term. The annual rental
amounts contained herein include annual payments for additional antenna
approved as of May 1, 2002.?

SUBJECT: Powertel/Atlanta, Inc. Cellular Lease
INITIATED BY: Department of Engineering
Recommendation: Approve the attached resolution authorizing the City Manager
to execute a lease renewal to the existing lease agreement with
Powertel/Atlanta, Inc. for a cellular facility on the Government Center rooftop.
Background: Powertel/Atlanta, Inc. executed a five (5) year Lease Agreement
for a cellular facility on top of the Government Center building in May 1997
with provisions for renewals with Council approval.
Analysis: The lease agreement provides for a 1st term lease renewal to begin
May 2002 thru May 2007. It also allows for additional antennae at an annual
rent of $250.00 each. Powertel is requesting the addition of three more
antennae. The lease specifies the annual rent for the 1st term to be
$11,500.00 plus the annual rent for three antennae to be $750.00 equating to an
annual rent of $12,250.00 over the next five years. The 2nd renewal term
annual rent is set for $14,087.50.
Alternatives: The existing lease agreement is set up for a total of three each
five year terms requiring each renewal term to be approved by Council.
Financial Considerations: The City will receive an annual rent of $12,250.00
over the next five years.
Legal Considerations: All lease agreements require Council approval.
Recommendations/Actions: Approve a lease renewal for Powertel/Atlanta, Inc.
for the rooftop lease of the Government Center for a cellular facility.

A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A LEASE AGREEMENT
TERM RENEWAL FOR THE 1ST TERM TO INCLUDE THE ADDITION OF THREE ANTENNAE FOR THE
EXISTING BUILDING AND ROOFTOP LEASE AGREEMENT WITH POWERTEL/ATLANTA, INC.
WHEREAS, Powertel/Atlanta, Inc. has an existing Building and Rooftop
Lease Agreement with the City for a cellular facility on the Government Center
Building; and,
WHEREAS, said Building and Rooftop Lease Agreement provides in
paragraph 1. (a) for the addition of antennae at an annual rent of $250.00
each; and,
WHEREAS, the leasee requests the addition of three antennae which
increases the annual rent by $750.00 with the City approving said request; and,
WHEREAS, paragraph 5. Renewal Term Rental specifies the original term
of said lease expires as of April 30, 2002 with provisions for a 1st term
renewal (May 1, 2002 through May 1, 2007) at an annual rent of $11,500.00
requiring Council approval for this lease renewal; and,
WHEREAS, paragraph 5. Renewal Term Rental is revised so that the 1st
term renewal?s annual rent now becomes $12,250.00 ($750.00 + $11,500.00) and
the 2nd term renewal becomes $14,087.50 for the lease renewal with
Powertel/Atlanta, Inc.; and
WHEREAS, the Finance Director, City Attorney and Traffic Engineer
reviewed the lease agreement recommending approval.
NOW, THE COUNCIL OF COLUMBUS, GEORGIA HEREBY RESOLVES:
THAT THE CITY MANAGER IS HEREBY AUTHORIZED TO EXECUTE A LEASE AGREEMENT TERM
RENEWAL FOR THE 1ST TERM TO INCLUDE THE ADDITION OF THREE ANTENNAE FOR THE
EXISTING BUILDING AND ROOFTOP LEASE AGREEMENT WITH POWERTEL/ATLANTA, INC. AS
DEFINED HERE WITHIN.
