A RESOLUTION

WHEREAS, O.C.G.A. ? 48-8-96, recently adopted at 2004 Session of the Georgia

General Assembly, provides for an increase in the Local Option Sales and Use

Tax (LOST) upon the adoption of a resolution of the governing authority of the

consolidated government increasing such tax and a referendum of the voters of

the consolidated government where such tax is to be increased;



WHEREAS, pursuant to O.C.G.A. ? 48-8-96, the Columbus Council desires to

increase the Local Option Sales and Use Tax (LOST) in effect in the

consolidated government from 1 percent to 2 percent;



WHEREAS, pursuant to O.C.G.A. ? 48-8-96, this resolution shall be forwarded to

the Election Superintendent who shall call for a referendum conducted pursuant

to O.C.G.A. ? 48-8-85;



WHEREAS, this Council desires that the matter be placed on the ballot for

November 2, 2004.



NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA HEREBY RESOLVES:



We hereby propose that the Local Option Sales and Use Tax (LOST) be increased

from 1 percent to 2 percent in the special district comprised of the

Columbus-Muscogee County consolidated government, pursuant to O.C.G.A. ?

48-8-96 and Committee of Conference Substitute to House Bill 709 adopted at the

2004 Session of the General Assembly. The Election Superintendent shall call

for a referendum pursuant to O.C.G.A. ? 48-8-85 and said House Bill 709 to take

place on November 2, 2004. The language on the ballot for such increase in the

Local Option Sales and Use Tax (LOST) shall read as follows:



"( )YES Shall the retail sales and use tax levied within the special district

within

( )NO Muscogee County be increased from 1 percent to 2 percent?"



If such increase in the Local Option Sales and Use Tax (LOST) is approved at

referendum on November 2, 2004, collection of such tax shall become effective

on April 1, 2005 pursuant to O.C.G.A. ? 48-8-96.
