The Regular Meeting of the Board of Zoning Appeals was held Wednesday, January
23, 2002 at 2:00 P.M., on the 1st Floor of the Government Center Annex,
420-10th Street. Members present were:

There was no one present to present the application of Walter Scott Wilhelm
III, 1411 Celeste Drive, for a Certificate of Occupancy for a Home Occupation
for an office only for a pressure washing business, Wilhelm?s Pressure
Washing. The property is zoned R-1A.
There was no opposition to this application.

In his statement and in response to questions from the Board Members, Mr.
Maxwell gave the following information: He would like to protect his car from
a huge oak tree in his neighbor?s yard. His car and truck are covered with sap
all the time. The houses are built very close together. The carport will be
metal.

Edgar Hughston, 4948 Aaron Drive, presented the appeal for a variance to reduce
the side yard setback requirement from 8 feet to 7 feet 7 inches, in order to
erect a single family residence, 44? x 59?. The property is zoned R-1A.
In his statement and in response to questions from the Board Members,
Mr. Hughston gave the following information: The house was started and it was
discovered the wrong brick was put on it. Instead of tearing off the side
brick, they erected a new brick wall which reduced the side lines down 5 inches
on each side. This home is typical for the neighborhood.

reduced the side yard by 5 inches. Motion carried by the affirmative vote of

Case No. 02-V13?-Granted.
Edgar Hughston, 3359 Cooper Branch Road, presented the appeal for a variance to
reduce the front yard setback requirement from 25 feet to 15 feet and to reduce
the rear yard setback requirement from 30 feet to 25 feet, in order to erect a
single family residence, 43? x 59?. The property is zoned R-2.
In his statement and in response to questions from the Board Members,
Mr. Hughston gave the following information: This lot is at the end of a
cul-de-sac. There is a deep detention pond behind the lot with a steep slope.
The house needs to come forward, this will be similar to the other houses in
the area.

Mr. Fox made a motion, which was seconded by Mr. Billingsley, to grant
this appeal because this is a cul-de-sac lot. He doesn?t have many choices.
He has to bring the house forward in order to get it adequate on the property.

Case No. 02-V14--Granted.
Edgar Hughston, 3352 Cooper Branch Road, presented the appeal for a variance to
reduce the front yard setback requirement from 25 feet to 15 feet and to reduce
the side yard setback requirement from 8 feet to 6 feet, in order to erect a
single family residence, 43? x 59?. The property is zoned R-2.
In his statement and in response to questions from the Board Members,
Mr. Hughston gave the following information: This lot is at the end of a
cul-de-sac. There is a deep detention pond behind the lot with a steep slope.
The house needs to be pulled forward, so that the house will be similar to
others in the area.

Case No. 02-V15--Denied.
Allison Payton, 4627 Northgate Drive, presented the appeal for a
variance to reduce the side yard setback requirement from 8 feet to 2 feet, in
order to make an addition, a canopy, 8? x 16?, to a single family residence.
The property is zoned R-1A.
In her statement and in response to questions from the Board Members,
Ms. Payton gave the following information: The canopy is already built. The
canopy is used to protect her vehicles from the pine trees. This is only a
temporary structure that she will keep for about 2 years. She is going to give
her nephew her jeep when he is old enough to drive.
When the Chairman asked for opposition, Mr. Christopher Stone came
forward. He stated, the existing carport has a overhang and it is on his
property. He plans to sell his home and the value of his home will be
reduced.
Mr. Fox made a motion, which was seconded by Mr. Billingsley, to deny
this appeal because the canopy was placed at the convenience of the property
owner without consideration for the permitting procedure as well as the regard
for any neighbors that might be concerned about this. There are other canopy
type covers in the area that are over parking pads that are existing and are
the primary cover for vehicles. Ms. Payton already has a double carport.
There was opposition to this appeal. A hardship was not shown. The canopy
must be taken down within 30 days. Motion carried by the affirmative vote of
the three Board Members present for this meeting.
