RE: Removal of City Mills and Eagle-Phenix Dams
Dear Colonel Keyser:
This is to advise you that Columbus Consolidated Government will act as
a non-Federal sponsor for the above referenced Aquatic Restoration Project
proposed for the Chattahoochee River. The proposed project is to be executed
by the U. S. Army Corps of Engineers under the authorization of Section 206 of
the Water Resources Development Act of 1986.
This Letter of Intent is in accordance with actions taken by the
Columbus Consolidated Government Council in a regular session at a public
meeting held on May 21, 2002. This intent is based on information presented to
the Columbus Consolidated Government in the Corps? Preliminary Restoration Plan
(PRP).
We understand that non-Federal cost-sharing will be required for the
Environmental Restoration Project, preparation of plans and specifications, and
project construction. We also understand the PRP, which constitutes the first
phase of project evaluations, will be conducted at 100 percent Federal
expense. We will more fully assess our capability of serving in this capacity
once the Corps determines the scope and cost of the project.

We understand the responsibilities include providing 35 percent of the
total project cost of which 100 percent can be in-kind contributions. This
share also includes provision of all lands, easements, rights-of-way and
necessary relocations for project implementation. We also understand that the
project must be maintained and operated by the local authority after completion
without cost to the United States in accordance with regulations prescribed by
the Secretary of the Army. No funds of the Consolidated Government shall be
expended on this project until the Corps? study is complete; and any such
expenditure shall be approved by the Columbus Council.
This letter is not a legal instrument and is subject to the terms
established by the Local Cooperation Agreement to be prepared by the Corps in
concert with the Columbus Consolidated Government.
