The Regular Meeting of the Board of Zoning Appeals was held Wednesday, October
1, 2003 at 2:00 P.M., on the 1st Floor of the Government Center Annex, 420-10th
Street. Members present were:

Mr. Willie Lewis Jr.
Mr. Ralph King
Board Member David Fox was unable to attend the meeting. Mr. King made a
motion, which was seconded by Mr. Lewis, to excuse Mr. Fox?s absence on today,
October 1, 2003, for personal business reasons. Motion carried unanimously by
the four members present for this meeting.
Also present were Mr. Danny Cargill, Secretary of the Board, and Ms. Veronica
Pitts, Recording Secretary.
CASES TABLED FROM THE SEPTEMBER 3rd MEETING.
Case No. 03-V114--Denied.
There was no one present to present the appeal of Lee Dunham, 3055 Walker
Street, for a variance that accessory structures must be 5 feet from the side
property line, 2 feet shown. The property is zoned R-2.
There was no opposition presented to this appeal.
Mr. King made a motion, which was seconded by Mr.
Lewis, to deny this appeal because there was no one present to
present the appeal for two consecutive meetings. Motion carried
by the affirmative vote of the four Board Members present for
this meeting.

Felicia Wynn, 8 Braddock Court, presented her application for a Certificate of

In her statement and in response to questions from the Board Members, the
applicant gave the following information: She will be using one room in her
home as an office only. She will have no employees and there will be no

Randy Prather presented the appeal of Johnny Horton, 6101 Adams Park Drive, for
a variance to reduce the corner side yard setback requirement from 25 feet to
17 feet, in order to make an addition, 13? x 28? 8?, a carport/storage room, to
a single family residence. The property is zoned R-2.
In his statement and in response to questions from the Board Members,
Mr. Prather gave the following information: Mr. Horton would like to add a
carport/utility room to his home. There is an existing slab. The same
materials will be used to match the house.
There was no opposition presented to this appeal.
Mr. Edwards made a motion, which was seconded by Mr. Lewis, to grant
this appeal because the carport will be over an existing slab. Motion carried

Case No. 03-V116?-Withdrawn.
This appeal was withdrawn at the request of the appellant Mary Avant,
2132 21st Street, for a variance to reduce the side yard setback requirement
from 8 feet to 3 feet, in order to make an addition, 5? 6? x 14?, a walk-in
closet, to a single family residence. The property is zoned R-1A.
There was no opposition presented to this appeal.
Case No. 03-V117?-Granted.
Charles Walker, 4100-4 Almond Road, presented his appeal for a variance to
increase the maximum height of an accessory structure from 14 feet to 20 feet.
The property is zoned A-1.
In his statement and in response to questions from the Board Members, Mr.
Walker gave the following information: He has five acres of land and he would
like to build an accessory structure behind his house. He is asking to
increase the height from 14 to 20 feet. It will have a loft upstairs and a
parking area on the bottom. The trim on the accessory structure will match the
house. It will be approximately 2500 feet from the road.
There was no opposition presented to this appeal.
Mr. King made a motion, which was seconded by Mr. Edwards, to grant this appeal
because the accessory structure will not be visible from the road and the trim
will match the house. Motion carried by the affirmative vote of the four Board
Members present for this meeting.
Case No. 03-V118?-Granted.
Silvia Crawford presented the appeal of Woodruff Contracting Company, 210 Plum
Court, for a variance to reduce the rear yard setback requirement from 30 feet
to 25 feet, in order to erect a single family residence, 54? 4? x 58? 4?. The
property is zoned R-2.
In her statement and in response to questions from the Board Members, Ms.
Crawford gave the following information: This is a contract job and the client
selected the lot. After everything was drawn they realized that it was 5 feet
less in the back than

the required 30 feet. They would like to accommodate their client. Woodruff
owns the property behind her, so that will not be a problem.
There was no opposition presented to this appeal.
Mr. Edwards made a motion, which was seconded by Mr. Lewis, to grant this
appeal because this is an odd shape lot in a cul-de-sac and the house had to be
pushed back because of the easement on both sides. Motion carried by the
affirmative vote of the four Board Members present for this meeting.
Case No. 03-V119?-Denied.
There was no one present to present the appeal of Steve Carver, 905 Moore Road,
for a variance to reduce the lot area from 40,000 square feet to 18,995.2 and
to reduce the lot width from 125 feet to 119.03, in order to replat a lot. The
property is zoned A-1. Planning recommends denial.
Aronda Smith, representing the Planning Division, stated that Planning
recommends denial of this request.
When the Chairman asked for opposition, James Edmonds, Ed Runci and Mr. & Mrs.
Julio Llands came forward. They stated the lot will be too small to build a
house on, a person can not build on less than an acre lot in this subdivision
and because of the lake above the property it will be a mess when the house is
built.
After the Board heard from the opposition and later during the meeting, Mr.
Steve Carver came into the meeting and stated that he would like to withdraw
his appeal.
Mr. King made a motion, which was seconded by Mr. Edwards, to deny this appeal
because this lot is not the same size as the other lots, the lot does not meet
the minimum lot size requirement and there was opposition to this appeal.

this meeting.

Case No. 03-V120?-Granted.
Eddie B. Short, 4527 Gardiner Drive, presented his appeal for a variance to
reduce the front yard setback requirement from 25 feet to 18 feet, in order to
make an addition, 10? x 15?, a front porch and to reduce the side yard setback
requirement from 8 feet to 2 feet, in order to make an addition, 12? x 24?, a
carport, to a single family residence. The property is zoned R-2.
In his statement and in response to questions from the Board Members,
Mr. Short gave the following information: He is taking the existing awning,
putting a top on it and bringing out the front porch. The same materials will
be used to match the house. There will not be a water problem because it will
have gutters.
There was no opposition presented to this
appeal.
Mr. Lewis made a motion, which was seconded by Mr. Edwards, to grant this
appeal because the carport will be over an existing slab and the same materials
will be used to match the house. Motion carried by the affirmative vote of the
four Board Members present for this meeting.
Case No. 03-V121?-Granted.
Dave Erickson presented the appeal of Pinnacle Homes, Inc., 9011 Seedling
Drive, for a variance to reduce the front yard setback requirement from 25 feet
to 24 feet and to reduce the corner side yard setback requirement from 25 feet
to 23 feet. The property is zoned R-2.
In his statement and in response to questions from the Board Members, Mr.
Erickson gave the following information: His employee made a mistake. The
house sits on a hill and the wrong measurements were taken. They measured a
straight line distance from down low and when you do the triangle it doesn?t
measure the same way. They are over 1 foot to the front and 1 foot and a few
inches to the side in one corner. The house is already 99% built.

Mr. Edwards made a motion, which was seconded by Mr. Lewis, to grant this
appeal because a mistake was made and the house is already built. Motion
carried by the affirmative vote of the four Board Members present for this

Case No. 03-V122--Granted.
Joe Alexander presented the appeal of Lisa McNary and T. J. Green, 525-D Double
Churches Road, from a Decision of the Building Official that an accessory
structure may only be located in the rear yard. The property is zoned A-1.
In his statement and in response to questions from the Board Members,
Mr. Alexander gave the following information: This is a subdivision that they
have developed. This is a 5 acre lot and the way the house sits, it needs to
have the garage in the front yard. The garage can not go in the back yard
because it goes up significantly high and the garage needs excess to the
circular driveway in order to make use of it. The garage will not be seen from
the street.
There was no opposition presented to this appeal.
Mr. King made a motion, which was seconded by Mr. Edwards, to grant
this appeal because of the way the house is on the lot and the circular
driveway, the garage fits better in the front yard. The garage will not be
seen from the street. Motion carried by the affirmative vote of the four Board

Case No. 03-V123--Granted.
Joe Sandoval, 10543 County Line Road, presented his appeal from a Decision of
the Building Official that an accessory structure may only be located in the
rear yard. The property is zoned A-1.
In his statement and in response to questions from the Board Members,
Mr. Sandoval gave the following information: The way the land is laid out it
is going to be difficult to put a garage in the back yard. The accessory
structure will be approximately 1200 feet from the street.

Mr. Edwards made a motion, which was seconded by Mr. Lewis, to grant
this appeal because of the topography of the land and the accessory structure
will not be seen from the street. Motion carried by the affirmative vote of
the four Board Members present for this meeting.
Case No. 03-V124?-Granted.
Donald Bowles, 5234 Thomason Avenue, presented his appeal for a
variance to reduce the lot width requirement from 75 feet to 25 feet, in order
to erect a single family residence. The property is zoned R-1A. Planning
recommends denial.
In his statement and in response to questions from the Board Members, Mr.
Bowles gave the following information: He is requesting a variance for a 25
foot access to a flag lot, primarily based on economic reasons. The lot will
be 50% larger than the required minimum in the neighborhood. There are 2 or 3
other flag lots in the area.
Aronda Smith, Planning Division, stated they recommend denial of this request
because flag lots should be discouraged, flag lots are undesirable because they
hinder emergency access and a hardship was not shown.
There was no opposition presented to this appeal.
Mr. King made a motion, which was seconded by Mr. Edwards, to grant this appeal
because Mr. Bowles has improved the driveway distance of the lot width
requirement from 20 feet up to 25 feet. He plans to have a proper driveway.
This would be an improvement to the area. There are other flag lots in the
area. Motion carried by the affirmative vote of the four Board Members present
for this meeting.
Case No. 03-V125?-Granted.
Larry Phillips presented the appeal of Davis Realty, 7263 North Lake Drive, for
a variance to reduce the rear yard setback requirement from 40 feet to 35 feet,
in order to erect a commercial building. The property is zoned A-O.

In his statement and in response to questions from the Board Members, Mr.
Phillips gave the following information: They would like to build a commercial
building. Three buildings are already complete and two are under construction
in this park. The configuration of the parking lot in the front, the way the
building sets back from the street, the way it is landscaped and the exact
design of the building is the same as the other buildings in the park.
Everything has to match 100 percent. The building is as far back as it can go,
it almost touches the drain easement.

appeal because the parking lot requirement is the reason why they had to push
the building back so far. Motion carried by the affirmative vote of the four
Board Members present for this meeting.
Case No. 03-V126?-Granted.
John Raymer, 4526 Labrador Drive, presented his appeal for a variance to reduce
the corner side yard setback requirement from 25 feet to 12 feet, in order to
erect a workshop/storage building, 12? x 16?. The property is zoned R-2.
In his statement and in response to questions from the Board Members, Mr.
Raymer gave the following information: He changed the request from last month,
he previously asked for 6 feet and now is asking for 12 feet from the setback
line. The reason he has a hardship is because the lot is narrow in the back
than in the front. He does not have enough room to work with back there
because of the topography. He can?t put the accessory structure on the
opposite side of his yard because he would have to cut down a lot of trees.
The accessory structure will have hardi plank siding and the shingles will
match the house.

Mr. Edwards made a motion, which was seconded by Mr. Lewis, to grant this
appeal because Mr. Raymer has made changes from his previous request last
month. The topography dictates the best place for the accessory structure, he
would have to remove several

Rene Fleckinger, 4140 Althea Drive, presented her application for a Certificate
of Occupancy for a Home Occupation for an office only for selling lingerie and
novelty items (internet), Aulnas. The property is zoned R-1A.
In her statement and in response to questions from the Board Members, the
applicant gave the following information: She will be using one room in her
home as an office only. She will have no employees and there will be no
additional traffic in the neighborhood. This will be part time work. She will
have an internet business and no one will come to her home. All items will be
dropped shipped to the clients. She will sell candles, oils and lotions. She
will not sell anything x-rated.
When the Chairperson asked for opposition, Mr. & Mrs. George Bedsole, Fred
Townsend and Margaret Garrett came forward. They stated they do not want this
type of business in their neighborhood. This type of business should not be in
a residential area. There was a letter from Ilene Lanford who oppose this type
of business and a letter with 17 signatures who were also in opposition.
Mr. Edwards made a motion, which was seconded by Mr. King, to deny this
application because there was a lot of opposition to this type of business.
Motion carried by the affirmative vote of the four Board Members present for
this meeting.
