An Ordinance amending the Zoning Atlas of the Consolidated Government
of Columbus, Georgia; this amendment changes certain boundaries of a district
located at the northwest and southwest corners of Wooldridge Road and Veterans
Parkway and north of the northwest corner of Wooldridge Road and Veterans
Parkway from RE1 (Residential Estate 1) District to GC (General Commercial) and
RO (Residential-Office) Districts.
THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY ORDAINS:
That the Zoning Atlas on file with the Planning Department be, and
the same is hereby amended by changing the following described property from
RE1 (Residential Estate 1) District to GC (General Commercial) District:
Part of Land Lots 233, 19th District, Columbus, Muscogee County, Georgia, and
being more particularly described as follows:
Beginning at a point formed by the intersection of the south right-of-way line
of Wooldridge Road with the west right-of-way line of Veterans Parkway, and run
thence South 12 degrees 14 minutes 45 seconds West along the west right-of-way
of Veterans Parkway a distance of 1,150.0 feet; thence run South 88 degrees 52
minutes 31 seconds West a distance of 478.36 feet; thence run North 77 degrees
45 minutes 15 seconds west a distance of 220.0 feet; thence run North 12
degrees 14 minutes 45 seconds East a distance of 1,270.0 feet to the south
right-of-way line of Wooldridge Road; thence run along the south right-of-way

The above-described property is being rezoned with the following conditions:
1. The Grey Rock Property that is to be developed as general commercial, office
and multifamily shall be consistent with the Master Plan entitled Grey Rock
Development Conceptual Master Plan, dated 1 March 2004, a copy of which is
attached and incorporated herein by reference.
2. Perpetual buffers, each consisting of a strip of land 50 feet in width and
entirely within the respective Grey Rock Property parcels, and (i) running
along the common boundary of each of the "Proposed Commercial Development"
parcels and the "Proposed Apartment/Office Development" parcel and the west
right-of-way line of Veterans Parkway, and (ii) running along the common
boundary of each of the "Proposed Commercial Development" parcels and the north
and south right-of-way lines, respectively, of Wooldridge Road, shall be
created and established through a combination of the natural growth of existing
trees, if any, and landscaping to supplement any such natural growth of
existing trees in order to screen and soften the visual impact of such
commercial developments and apartment / office developments from and along
Veterans Parkway and Wooldridge Road, as the case may be. The types of trees
and plant materials selected and their age and height / spread and caliper at
the time of planting (installation) shall be such that they will reach maturity
in six (6) to eight (8) years after planting. Such Veterans Parkway /
Wooldridge Road Buffers shall be created and completely installed (including
but not limited to all related landscaping) at the time of and
contemporaneously with the commencement of the development of the respective
parcels, shall remain as buffer areas in perpetuity, shall be maintained by the
owner or owners of such parcels at their sole cost and expense, and shall be
included as a condition to any rezoning of any such parcels. No structures or
other improvements excluding entrances of any kind shall be permitted to be
constructed or installed within any of such Veterans Parkway / Wooldridge Road
Buffers by Grey Rock or any other person or entity. No trees or other plant
materials whether naturally existing or planted as part of the landscaping plan
for such Veterans Parkway / Wooldridge Road Buffers (other than dead or
diseased trees or other plant materials) shall be cut down or removed by Grey
Rock or any other person or entity. Any dead or diseased trees or other plant
materials which are cut down and removed shall be replaced by the owner or
owners of such parcels as part of their respective obligations to create,
establish and maintain such Veterans Parkway / Wooldridge Road Buffers. Grey
Rock shall include in any conveyance and / or development documents such
negative easements, restrictions and other provisions as will ensure that such
Veterans Parkway / Wooldridge Road Buffers shall be created, established and
maintained as contemplated herein and shall be perpetual.
3. Each "Proposed Commercial Development" parcel shall have no more than one
(1) entrance onto Wooldridge Road. The "Proposed Apartment/Office Development"
parcel shall have no entrance onto Wooldridge Road. It is contemplated that
each parcel shall have additional entrances onto Veterans Parkway. These
restrictions shall be included as a condition to any rezoning of any such
parcels.
4. No buildings or other structures constructed on either "Proposed Commercial
Development" parcel shall exceed two (2) stories in height. No buildings or
other structures constructed on the "Proposed Apartment / Office Development"
parcel shall exceed three (3) stories in height. These restrictions shall be
included as a condition to any rezoning of any such parcels.
5. All lighting for the development on any such parcels shall be directed
internally and away from the residential areas. This restriction shall be
included as a condition to any rezoning of any such parcels.
6. Grey Rock agrees to (i) establish buffer areas on the "Proposed Commercial
Development" parcels and the "Proposed Apartment/Office Development" parcel and
along the common boundary lines with the single family residential development
lots, and/or (ii) make the single family residential lots which share a common
boundary line with the "Proposed Commercial Development" parcels and the
"Proposed Apartment/Office Development" parcel, of sufficient depth and size,
to allow the existence or creation of a natural or planted buffer area on such
single family residential lots, to screen the view between such lots and such
commercial and apartment/office parcels. This restriction shall be included as
a condition to any rezoning of any such parcels. Such Interior Buffers (herein
so called) shall consist of a strip(s) of land not less than 40 feet in width,
shall be perpetual, and shall be maintained by the owner or owners of such
parcels and/or residential lots at their sole cost and expense. No structures
or other improvements of any kind shall be permitted to be constructed or
installed within any of such Interior Buffers by Grey Rock or any other person
or entity. No trees or other plant materials whether naturally existing or
planted as part of a landscaping plan for any such Interior Buffers (other than
dead or diseased trees or other plant materials) shall be cut down or removed
by Grey Rock or any other person or entity. Grey Rock shall include in any
conveyance and/or development documents such negative easements, restrictions
and other provisions as will ensure that such Interior Buffers will be created,
established and maintained as contemplated herein and will be perpetual.
