The Regular Meeting of the Board of Zoning Appeals was held Wednesday, December
4, 2002 at 2:00 P.M., on the 1st Floor of the Government Center Annex, 420-10th
Street. Members present were:

CASES TABLED FROM THE NOVEMBER 6TH MEETING.
Case No. 02-V170--Granted.
Doug Jeffcoat, presented the appeal of Developers-Investors, 1664 Whittlesey
Road Lot 600, for a variance to reduce the lot width requirement from 40 feet
to 25 feet at the building line, in order to subdivide a lot. The property is
zoned C-3. Contingent upon Planning approval.
In his statement and in response to questions from the Board Members,
Mr. Jeffcoat gave the following information: They have real estate at the
corner of Rollins Way and Whittlesey Road. There was an earlier configuration
that had one large lot of about an acre in a half to the back side of lot 300.
At that time it was configured with entrances that were wide enough and a
variance would not be necessary. They would like to subdivide the lot to give
it frontage. They are not changing the driveway configuration from what was
originally proposed which is a driveway that will come in from Rollins Way that
is a shared driveway and another driveway that will come in off of Whittlesey
Road which is also a shared driveway. They will be re-defining where the
property line is. This will allow them to be good stewards over the traffic
flow in that area, needing only one driveway in each location to serve multiple
users.

There was no opposition presented to this appeal.
Mr. Fox made a motion, which was seconded by Mr. Edwards, to grant this
appeal because this is basically a lot width requirement reduction. They will
be using the same driveway curb cuts that are already in use. The detention
pond that is there prevents a much wider road frontage requirement. Planning
does not oppose this request. Motion carried by the affirmative vote of the
three Board Members present for this meeting with Leah Braxton abstaining from
the vote.
Case No. 02-V171--Granted.

Case No. 02-V176?-Denied.
Gerald Parker, Southern Awning Company, presented the appeal of Angel Santos,
5440 St. Mary?s Road, for a variance to reduce the side yard setback
requirement from 8 feet to 1 foot, in order to make an addition, 7? x 23?, a
carport, to a single family residence. The property is zoned R-2.
In his statement and in response to questions from the Board Members, Mr.
Parker gave the following information: Mr. Santos would like to add a carport
to the side of his house. There is an existing slab. The carport will match
the existing gable roof and it will have shingles. The materials used for the
carport will match the house. The water will flow to the rear of the house.
This will not be a wide carport. The carport will be 1 foot from the privacy
fence. He already has a garage, but he would like to park his red car under
the carport.
There was no opposition presented to this appeal.
Mr. Fox made a motion, which was seconded by Mr. Edwards, to deny this appeal
because Mr. Santos was not at the meeting to state what was his hardship and to
answer additional questions. He already has car storage available. Mr. Santos
could re-apply so that he can be able to explain why he needs this addition.

this meeting.
Case No. 02-V177?-Granted.
Claudio Lugo-Brun, 6723 Dorsey Drive, presented his appeal
for a variance to reduce the corner side yard setback requirement
from 25 feet to 6 feet, in order to make an addition, 28? x 29?, a
carport, to a single family residence. The property is zoned R-2.
In his statement and in response to questions from the Board Members, Mr. Brun
gave the following information: His house is on a dead end street and there
are about 10 or 12 houses on the street. There is an existing parking pad.
The materials used for the carport will match the house.
There was no opposition presented to this appeal.
Mr. Edwards made a motion, which was seconded by Mr. Fox, to grant this appeal
because this is a dead end street. The carport will be built over an existing
concrete pad. The addition will be 22 feet from the curb. Motion carried by
the affirmative vote of the four Board Members present for this meeting.
Case No. 02-V178?-Granted.
James Johnson, presented the appeal of Columbus Housing Initiative, 2810
Baldwin Street, for a variance to reduce the number of off street parking for a
single family residence from the required 2 spaces to 1 space for a single
family residence. The property is zoned R-3.
In his statement and in response to questions from the Board Members, Mr.
Johnson gave the following information: The reason they would like to reduce
the off street parking from 2 spaces to 1 is because the lot is very small. If
they have 2 parking spaces they will be covering up the front yard. Most of
the houses in that area do not have off street parking. Most of the lots are
25 or 30 feet wide. The reason they are building on a 25 feet lot is because
both houses on each side of this lot is affordable to buy.
There was no opposition presented to this appeal.
Mr. Edwards made a motion, which was seconded by Mr. Fox, to grant this appeal
because most of the houses in the neighborhood do not have the curb cut for
parking. This will be an improvement to the neighborhood. Motion carried by
the affirmative vote of the four Board Members present for this meeting.
Case No. 02-V179--Granted.
Lisa Pound, 2219 14th Street (Lot #2), presented her appeal for a variance to
reduce the lot area from 7,500 square feet to 5,354 square feet, to reduce the
front yard setback requirement from 20 feet to 15 feet, to reduce the rear yard
setback requirement from 30 feet to 29 feet and to reduce the parking spaces
from 2 to 1. The property is zoned R-2. Contingent upon Planning approval.
In her statement and in response to questions from the Board Members, Ms. Pound
gave the following information: A couple of years ago she bought three houses,
they have three different street addresses, but technically they all are on one
lot. She is now ready to sell one of the houses. She is not adding anything
to the lots, just sub-dividing.

contingent upon Planning?s approval, because there are three properties that
are on one lot. There is a necessity in selling one of these. They will

from 7,500 square feet to 4,491 square feet, to reduce the lot width from 60
feet to 54 feet, to reduce the front yard setback requirement from 20 feet to
15 feet, to reduce the side yard setback requirement from 10 feet to 7 feet, to
reduce the rear yard setback requirement from 30 feet to 21 feet and to reduce
the required number of off-street parking spaces from 2 to 1. The property is
zoned R-4. Contingent upon Planning approval.

from 7,500 square feet to 4,183 square feet, to reduce the lot width from 60
feet to 49 feet, to reduce the front yard setback requirement from 20 feet to
18 feet, to reduce the side yard setback requirement from 10 feet to 4 feet, to
reduce the rear yard setback requirement from 30 feet to 21 feet and to reduce
the required number of off-street parking spaces from 2 to 1. The property is
zoned R-4. Contingent upon Planning approval.
In her statement and in response to questions from the Board Members, Ms. Pound

Case No. 02-V182?-Granted.
Charles Crumpton presented the appeal for his daughter-in-law, Joy Crumpton,
7015 Winthrop Court, for a variance to increase the maximum lot coverage from
10% to 10.72%, in order to erect a single family residence. The property is
zoned A-1.
In his statement and in response to questions from the Board Members, Mr.
Crumpton gave the following information: There was an original house on the
lot that was 33 years old. They found out that is was infested with termites,
so they demolished it. They would like to erect a new single family
residence. They would like to increase the square footage of building coverage
from 10% to 10.72%, this is less than a 1% increase on the lot. They have
signatures from neighbors that are not in opposition.
There was no opposition presented to this appeal. There was a letter from
neighbors who are in support of this request.
Mr. Edwards made a motion, which was seconded by Mr. Fox, to grant this appeal
because they demolished an old house that had termites. The new house they
want to put on the lot is bigger than the old house. There was a petition from
adjacent residents who are in support of this request. Motion carried by the
affirmative vote of the four Board Members present for this meeting.
Case No. 02-V183?-Tabled.
There was no one present to present the appeal of George Adams III, 1509 22nd
Street, for a variance to reduce the lot area requirement from 21,000 square
feet to 20,600 square feet, in order to add four dwelling units, 3,000 square
feet lot area required per dwelling unit. The property is zoned R-3A.
There was no opposition presented to this appeal.
Mr. Fox made a motion, which was seconded by Mr. Billingsley, to table this
appeal until the January meeting because there was no one present to present
the appeal. Motion carried by the affirmative vote of the four Board Members
present for this meeting.
Case No. 02-V184?-Granted.
Franklin Douglas, Murray Calhoun and Ken Levy presented the appeal of Fourth
Street Towers, Inc., 2801 Thomas Street, for a variance to reduce the side yard
setback requirement from 5 feet to 3 feet and to reduce the corner-side yard
setback requirement from 20 feet to 2 feet, in order to erect a single family
residence. The property is zoned R-3.
In their statements and in response to questions from the Board Members, Mr.
Douglas, Mr. Calhoun and Mr. Levy gave the following information: Mr. Douglas
has worked with an architect and a builder to look at the best way to put a
single family residence on this property. The house will have 3 bedrooms and 2
bathrooms. The plans they are using are modified to meet the needs to be in
compliance with redeveloping the area. They want the homes to be as modern as
possible on the space allowed.
When the Chairperson asked for opposition Bill Weary came forward. He wanted
to know what they were building on the property. He was not in opposition
after he was told they were going to build a house on the property.
Mr. Fox made a motion, which was seconded by Mr. Billingsley, to grant this
appeal because they will erect a single family residence. After Mr. Weary was
aware of what they were doing, he was not in opposition to this request.
Motion carried by the affirmative vote of the four Board Members present for
this meeting.
Case No. 02-V185?-Granted.
Franklin Douglas, Murray Calhoun and Ken Levy presented the appeal of Fourth

yard setback requirements from 5 feet to 3 feet, in order to erect a single
family residence. The property is zoned R-3.
In their statements and in response to questions from the Board Members, Mr.
Douglas, Mr. Calhoun and Mr. Levy gave the following information: Mr. Douglas
has worked with an architect and a builder to look at the best way to put a

Case No. 02-V186?-Granted.
Murray Calhoun and Virginia Peoples presented the appeal of Calhoun
Construction Co., LLC, 619 3rd Avenue, for a variance to reduce the side yard
setback requirement from 10 feet to 4 feet, in order to move a single family
residence onto an existing lot. The property is zoned H. Contingent upon BHAR
approval.
In their statements and in response to questions from the Board Members, Mr.
Calhoun and Ms. Peoples gave the following information: They have a house on
Veterans Parkway. In the future they are suppose to be widening Veterans
Parkway. The house will probably be demolished if not moved to another
location. They have a lot on 3rd Avenue and they would like to move the house
there. There is an existing curb cut on the right side of the lot. The house
is pushed back for the 4 foot setback. There are trees there right now, but in
the future if someone wanted to tear down the trees and have a driveway they
could. There was a house previously on this lot and it was set the same way
with the same blueprint. The only way to save the house would be to move
it.

Mr. Edwards made a motion, which was seconded by Mr. Billingsley, to grant this
appeal contingent upon BHAR?s approval, because this is an empty lot now and
they are going to save a historic home. They would like to move it closer to
the side to use the existing curb cut for a driveway and not park on the
street. Motion carried by the affirmative vote of the four Board Members
present for this meeting.
Case No. 02-V187?-Granted.
William Gullion and Dan Parpkah presented the appeal of Cascade Hospitality
LLP, 1408 Bradley Lake Boulevard, for a variance to reduce the required number
of parking spaces from 180 to 148 and to increase the sign height from 20 feet
to 70 feet and to increase the sign area from 150 square feet to 300 square
feet. The property is zoned A-O.
In their statements and in response to questions from the Board Members, Mr.
Gullion and Mr. Parpkah gave the following information: The parking is for a
hotel, which is typical for individual business travelers. The property is
going to be located in the Brookstone Center Office Park and will cater heavily
to the business traveler. The parking ratio that the Hilton typically require
is a 1 to 1 ratio, 1 space for every guess room. They have done extensive
studies in house and other similar hotels. The hotels are very rarely 100%
occupied. They would like to have more space because they will have meeting
space about 3,000 square feet. This could generate outside business, but
typically the business generates from meeting space. The same people who are
staying in the hotel are the ones that are occupying the hotel. They are
asking to reduce the parking ratio from 1.5 to 1.25. There was only a limited
location to put up a pylon sign to be able to visually get the people from the
highway to find the property. We are contending with a DOT tree line of very
mature pine trees. The only way to get up above the tree line would be to ask
for a variance. The Hilton is very specific about signage and what they can do
about signs. There are only 3 sign companies in the country that are allowed
to build signs for this property. They set out a book of standards on signage
and with a sign of that size they are requiring to have 299.27 square feet of
sign face.

Case No. 02-V188?-Granted.
Marty Radke and Randy Moore presented the appeal of Nu-Rock, 2001 Torch Hill
Road, for a variance to increase the size of a sign from 15 square feet to 32
square feet. The property is zoned R-4.
In their statements and in response to questions from the Board Members, Mr.
Radke and Mr. Moore gave the following information: They are owner and
management company for the property that use to be the old Camellia Club
Apartments. They are doing a major renovation on the property, it has 381
units. The sign is 30 square feet and they need an extra 15 feet. The sign
will be single sided and face Torch Hill Road. The sign is a good 200 feet
from the road. They would like to put the sign by the gated entrance. They
are trying to get visibility from Torch Hill Road.

appeal because they have done a good job in re-claiming an old apartment area.
This will be the only sign where the entrance is located. Motion carried by

Case No. 02-V189?-Granted.
D. Hal Averett, 1414 33rd Street, presented the appeal for a variance to reduce
the side yard setback requirement from 15 feet to 1 foot, in order to make an
addition, 40? x 90?, a storage building, to an office building. The property
is zoned C-2.
In his statement and in response to questions from the Board Members, Mr.
Averett gave the following information: He would like to add a storage
building to an existing building that adjoins a residential neighborhood. One
neighbor is not protesting she is o.k., but another neighbor is not pleased
about it. The existing building is right on the line, apparently there was a
time when someone could do that. It kinda slipped up, no one really was aware
of that.
When the Chairperson asked for opposition Nick Kokoles, Bernice Kokoles (owner
of the property), Mary Ellen Oakes, Tommy Kokoles and Debbie Kokoles came
forward. Mr. Averett dug a trench about 1 foot and it is caving in her fence.
The fence has been there 40 to 45 years. The fence is 3 inches or more inside
of her property. Ms. Bernice Kokoles would like the dirt that was dug up from
around her post and under her fence to be corrected. Mr. Averett stated that
he would put the dirt back.
Mr. Fox made a motion, which was seconded by Mr. Edwards, to grant this appeal
because. There was opposition from a neighbor who had questions regarding what
was being done, but it seems to be with the adjustment in the building where it
encroaches on the neighbors property. Mr. Averett did state that he would
correct the problem. Motion carried by the affirmative vote of the four Board
Members present for this meeting.

Case No. 02-HO246?-Granted.
Paul Clifford Schierholz Jr., 6023 Crystal Drive #128, presented his
application for a Certificate of Occupancy for a Home Occupation for an office

In his statement and in response to questions from the Board Members, the
applicant gave the following information: He will be using one room of his home
