General Business
? The legislature passed a FY05 budget with a $57 million shortfall
therefore, a special session to balance the budget is likely.
? Tort reform died as no consensus was reached in conference committee.
? Local option sales tax passes--will allow Atlanta voters to vote on a
1% sales tax to be used to offset the costs of upgrading and repairing the
sewer and water system.
? Ethics reform failed to pass.
? A resolution allowing the proposal of a Constitutional Amendment
banning same sex marriage and prohibiting the state from recognizing same sex
unions, passed.
? The Hope Scholarship program was changed to create a new 3.0 academic
standard, verify continued academic progress more stringently, and establishes
a freeze on payments for fees should lottery revenues drop over time.
? Legislators will be forced to run under court drawn maps, after current
maps were deemed unconstitutional. ? The legislature authorized the
first statewide water plan--to be finalized July 2007-- to divide rivers and
underground aquifers among cities, farmers, and industry.
2004 Legislative Session
The 2004 ?regular? session of the Georgia General Assembly, after working 40
legislative days, or perhaps more accurately, including committee days from
January 12 until April 7, 2004, concluded with a few issues resolved, left many
more outstanding, and the prospect of a special session looming.
Budget
Although both chambers passed a FY05 budget prior to Sine Die, because a bill
outlining the funding mechanism for the Indigent Defense Program failed to
pass, the budget sits on the Governor?s desk with an approximate $57 million
gap. As such, the Governor will soon call a special session. The level of
future debate or work on the budget is largely up to the Governor. He could
call a special session to pass the indigent defense funding mechanism, thereby
balancing the budget, or he could call into question the entire budget, thereby
forcing legislators to begin the budget process from the beginning.
The budget that passed during the session included compromise positions on many
education and health care measures including: restoration of $204 million in
education funding, eliminating the Medicaid funding delay, setting Medicaid
eligibility at 200% Federal Poverty Level, and delay of the Governor?s proposed
2% pay increase for teachers and state employees until January 2005.
Tort Reform
Tort reform was one of the more highly debated and visible issues facing the
Georgia Legislature. While doctors and hospitals, as well as the Georgia
Chamber of Commerce, worked diligently to push for the enactment of legislation
which would offer the healthcare industry relief from medical malpractice rates
in terms of tort reform, trial lawyers, as well as Georgia Watch, sought to
prevent that same action, citing protecting the individuals right to sue.
As the session began nearing the end, and it appeared that tort reform would
die, the Senate amended and subsequently passed HB 1028, to include tort reform
provisions including: immunity for hospitals for the actions of physicians who
are independent contractors, stricter standards for the use of expert
testimony, apportionment of liability among defendants, absolute immunity from
being sued for non-economic damages for ER physicians, expand the
joint-and-several liability apportionment to all civil lawsuits, allow
attorneys to cross-examine expert witnesses, and to provide for "disappearing
venue" in multi-defendant lawsuits where other defendants are dismissed.
HB 1028 was placed in a conference committee made up of State Senators: Preston
Smith, Tom Price and Mitch Seabaugh and State Representatives: Alan Powell,
Jimmy Skipper, and Mary Margaret Oliver. Although conferees worked toward
compromise actions, the legislative session came to an end prior to consensus
within the conferees. As such, no tort reform passed the Georgia General
Assembly.
Redistricting
Early into the session, judges ruled that the democrat-drawn legislative
districts violated the one-person, one vote law. As such, Legislators were
forced to deal with redrawing maps which met the necessary standards. Because
legislators could not reach consensus regarding new maps, a court appointed
panel drew politically blind districts. This action will cause: some major
shuffling of legislators as incumbents were paired with one another, the
creation of many open seats, and districts changed their party leaning.
Call Center and Other Overseas Operations
Numerous efforts (HB 1218, HB 1281, HB 1357, SB 473) toward reducing off
shoring occurred this session. Most of these bills were defeated during the
subcommittee and full committee hearings. Although HB 1281 did survive the
committee process, and pass the House, it failed to be reported favorably out
of Senate Committee. An eleventh-hour effort was made during the last day of
the session to amend a vehicle to include off shore language. This effort
failed. As a result, no efforts to reduce off shoring passed this session.
Unemployment State-wide Reserve Ratio
Statewide reserve ratio received unexpected attention as a bill to stretch out
the sunset provision another year was amended to include part-time employment
in the definition of ?bona fide in the labor market?. Although the bill passed
the House with the part-time employment language in tact, the Senate stripped
said language out before returning the bill to the House for further action.
In late action, the House made continual attempts to include part-time workers,
ultimately to no avail. The provision for part-time employment in the
state-wide reserve ratio failed.
Ethics Reform
Ethics reform was one piece of the Governor?s legislative agenda for 2004.
Perdue's Honesty in Government bill sought to close the revolving door by
prohibit public officials from lobbying for one year after they leave office.
In addition, his measure aimed to ban legislators and statewide officials from
soliciting campaign funds during the Legislative Session, restrict honoraria
and gifts to public officials and to require greater financial disclosure by
candidates, office-holders, and lobbyists. After much debate in Senate
committee, the measure reached the Senate floor. While on the floor, the bill
was attached with numerous amendments, in an attempt to kill the bill. The
bill did ultimately pass out of House committee, but failed to make it to the
House floor for debate.
Ethics reform may be on the list of measures to be considered during a special
session.
Subsequent Injury Trust Fund
Legislation to dissolve the Subsequent Injury Trust Fund, which has been the
subject of debate for the last two sessions, passed this session. HB 1579, by
Rep. Mary Margaret Oliver, dissolves the fund as of July 2008. The bill
further requires an actuarial study on the fund to be completed by January of
2005 in order to assess outstanding claims once the fund is abolished.
