The Regular Meeting of the Board of Zoning Appeals was held Wednesday, April 7,
2004 at 2:00 P.M., on the 1st Floor of the Government Center Annex, 420-10th
Street. Members present were:

Mr. Fox made a motion, which was seconded by Mr. Edwards, to approve
the Minutes of the Monthly Meeting, which was held on March 3, 2004. Motion
carried unanimously.
CASES TABLED FROM THE MARCH 3rd MEETING.
Case No. 04-V36--Denied.
There was no one present to present the appeal of Lori Eanes, 3320 12th Avenue,
for a variance to reduce the side yard setback requirement from 8 feet to 6
feet, in order to make an addition, 13? 4? x 13? 6?, a bathroom and closet, to
a single family residence. The property is zoned R-3A.
There was no opposition presented to this appeal.
Mr. Fox made a motion, which was seconded by Mr. Edwards,
to deny this appeal because there was no one present to present
the appeal for two consecutive meetings. Motion carried
unanimously.

BOARD OF ZONING APPEALS ? 04/07/2004
VARIANCES.
Case No. 04-V41--Granted.
Forest Hudson, 720 1st Avenue and Ricky Grier, Contractor, presented the appeal
for a variance to reduce both side yard setback requirements from 10 feet to 6
feet and from 10 feet to 6 feet, in order to make an addition, 20? x 28?, a
family room and bathroom, to a single family residence. The property is zoned
H.
In their statements and in response to questions from the Board
Members, Mr. Hudson and Mr. Grier gave the following information: They would
like to add a family room and it needs to include a bathroom. They have only 1
bathroom for the whole family. The addition needs to be this size to include
the bathroom.
The Board of Historic and Architectural Review has granted the owner a
Certificate of Appropriateness for this addition. This Certificate is attached
and therefore is considered a part of these minutes.
There was no opposition presented to this appeal.
Mr. Fox made a motion, which was seconded by Mr. Lewis, to grant this
appeal because this is a sub-standard lot and the addition will be at the rear
of the house. The addition does not encroach any closer to the side yard than
the existing structure. Motion carried unanimously.
Case No. 04-V42?-Granted.
Ronnie Wilson, 6943 Buckhorn Drive, presented the appeal for a variance to
reduce the side yard setback requirement from 5 feet to 6 inches, in order to
make an addition, 8? x 16?, to an existing storage building. The property is
zoned R-1A.
In his statement and in response to questions from the Board Members,
Mr. Wilson gave the following information: They would like to make an addition
to an existing storage building. The addition has to be on the left side
because there is a tree to the right side. His neighbor to the left has an 8
feet privacy fence. Gutters will be added so there will not be water run off.

There was no opposition presented to this appeal.
Mr. Edwards made a motion, which was seconded by Mr. Fox, to grant this
appeal even though the addition is within 6 inches of the property, the
overhang would only be 4 inches with the stipulation that gutters must be
installed. There wasn?t an alternative for the addition because trees are on
the other side of the building. Motion carried unanimously.
Case No. 04-V43?-Denied.
Michael Hamby, owner of Delta Motor Company & Transmission Service Company,
4420 17th Avenue, presented the appeal from a Decision of the Building Official
that a sign is not allowed on a fence. The property is zoned C-3.
In his statement and in response to questions from the Board Members, Mr. Hamby
gave the following information: His sign is 3? x 24?. He is calling the sign
a projecting fa?ade sign which falls under section 17E-3(7), which says it must
be affixed to the fa?ade of the building, which it is and it projects beyond
about it 6 to 8 inches. It is attached to the fence, but in the ordinance the
word fence is not found, but falls under 17E-4, which basically is a catch all
if it is not in the ordinance it don?t fly. The fence does support it, fences
have been sign boards for years, it is a natural sign board and as long as it
is a pleasing sign board he doesn?t see a problem. The reason the sign was put
up was for more visibility and it would catch people?s attention. He drove
approximately a mile from his shop to get a lot of pictures showing other
banners and signs that were on fences presently on Veterans Parkway. There are
signs and banners all across town that are illegal. He spent $300.00 on his
sign and didn?t know it was illegal. He didn?t put up an ugly or vulgar sign,
he thought it was o.k., the sign is not a health hazard.
Diane Hewitt, Sign Inspector, Inspections and Code, stated, Mr. Hamby was first
given a request in January 2003 and he was told the sign was prohibited under
the sign ordinance section 17E-4(12) prohibited signs. It was explained to Mr.
Hamby under the ordinance if it is not exempt and if he was not able to get a
sign permit it was prohibited. He did remove the sign in 2003 and put the sign
back up in 2004. Again it was explained that the sign was

prohibited, that he could attach a sign to the face of his building. He was
given a request to remove it within 2 days. He had already been given a
request prior to a 10 day notice.
There was no opposition presented to this appeal.
Mr. Fox made a motion, which was seconded by Mr. Lewis, to deny this appeal
because the Building Official is correct that a sign is not allowed on a fence
and because Mr. Hamby has other options for the location of the sign. The sign
must be removed within 30 days. If he decides to appeal this decision, the
appeal must be made within 30 days. Motion carried unanimously.
Case No. 04-V44?-Granted.
James Lewis presented the appeal of New Testament Baptist Church, 2622 Macon
Road, for a variance to delete the buffer requirement along the west property
line. The property is zoned R-4.
In his statement and in response to questions from the Board Members,
Mr. Lewis gave the following information: The zoning of the property changed
after an addition was made to the church. They wanted to put a daycare in the
existing facility and had to have it rezoned in order to comply. When they
built a building on their property they were required to put a 6 foot fence up
along the west side of their property line for a buffer between their two
properties. The two churches have co-existed for many years and they did not
see a reason why they needed to separate each other with this particular fence
as well as they share parking and it would not look well for them to be in a
religious community separated that way. All of the trees that are shown have
not been added because they had some concerns with the caliber of trees. The
nursery that is suppose to do it for them has not been able to make contact
with the arborist, so that has held them up from getting trees planted. Some
trees are already existing, where they are not existing they will put them in
as well as shrubbery and plants for beautification purposes.
When the Chairperson asked for opposition Maxine Kaplan, President of the Board
at Shearith Isreal Synagogue, came forward. She stated in talking to her board
they do not want the fence from the edge of Macon Road all the way back down
and around because it

would cage them and they would not like that. Aesthetically it would be ugly,
but because they have a problem with the community itself coming through their
parking lot and making u-turns, there is no way to stop them. The board
members have suggested that toward the back of the building on back of the
property that a fence be put up with a gate so that the congregates could still
use their facilities to park, but they have a way to get into their building
and everything. The reason why is that people zoom through there and if they
do go back to daycare, they don?t want anyone to get hurt. That is their
suggestion. It doesn?t have to be that far over like on the edge of the
property it could be in a way from the back end of the brick building. They
have a fear for the population someone getting hurt. They don?t know
aesthetically if it is the best thing to do. They do not want to make them put
up a fence from the edge of Macon Road going all the way down. They are
thinking safety.
Board of Zoning Appeals Member Willie Lewis Jr., also came forward. He
stated, his home is two doors down from the church. He wants to know how can
someone get a permit to build a structure without going through the community
and getting their agreement on it. He has a different interpretation of a
buffer. There have been complaints about the noise factor. He was under the
impression that this buffer would absorb the noise in the neighborhood, but
apparently that is not the case. The parking is a problem. He doesn?t want an
accident to be on Dixon Drive because when there is activity at the church
there is only one way traffic. He doesn?t see any existing exits on the
property.
Mr. Fox made a motion, which was seconded by Mr. King, to grant this appeal
with the stipulation that only the portion of the buffer from Macon Road going
East be deleted for a distance of 125 feet. Motion carried by the affirmative
vote of the four Board Members with Mr. Lewis abstaining from the vote.
Case No. 04-V45?-Granted.
Marion and Deb Self, 1725 Smith Road, presented the appeal for a variance to
reduce the front yard setback requirement from 50 feet to 38 feet, in order to
make an addition, 42? 8? x 30?, a mother/father-in-law suite, to a single
family residence. The property is zoned A-1.

In their statements and in response to questions from the Board Members, Mr.
and Mrs. Self gave the following information: They have a 3 story a-frame
house and this would be the only place to come off of it. His mother has had 8
operations and getting ready for a second hip replacement and she will be in a
wheel chair. His father has Alzheimer?s disease. He does not want to put his
parents in a nursing home and they are doing everything to prevent that. The
property on the left side belongs to him.
There was no opposition presented to this appeal.
Mr. King made a motion, which was seconded by Mr. Lewis, to grant this
appeal to make an addition for a mother/father-in-law suite. Motion carried
unanimously.
Case No. 04-V46?-Granted.
Madappa Vrishabhendra, 4237 Bonnie Drive, presented the appeal for a variance
to reduce the rear yard setback requirement from 30 feet to 12 feet, in order
to make an addition, a roof over an existing 8? x 16? deck, to a single family
residence. The property is zoned R-1A.
In his statement and in response to questions from the Board Members, Mr.
Vrishabhendra gave the following information: He would like to cover his
existing deck, it will still be open around the deck. The same materials will
be used to match the house.
There was no opposition presented to this appeal.
Mr. King made a motion, which was seconded by Mr. Fox, to grant this appeal to
reduce the rear yard setback requirement in order to make an addition, which is
a roof over an existing deck. Motion carried unanimously.
Case No. 04-V47?-Granted.
Scott McGregor, Aquarius Pools, presented the appeal of Michael Courtney, 8730
McKee Road, from a Decision of the Building Official that accessory structures
(a swimming pool and sunroom) are not allowed in the side yard. The property
is zoned A-1.

In his statement and in response to questions from the Board Members, Mr.
McGregor gave the following information: Mr. Courtney owns a 3 acre lot and
they would like to put in a swimming pool, the house is located more toward the
back. They have more room in the side for the swimming pool than in the back,
because they have a garden. The swimming pool will be 100 feet from the
property line and over 300 feet from the road. The swimming pool would be
visible from the road, but the appellants would be willing to put up a privacy
fence if required.
There was no opposition presented to this appeal.
Mr. Fox made a motion, which was seconded by Mr. Edwards, to grant this
appeal, although the Building Official is correct that accessory structures are
not allowed in the side yard, with the stipulation that a privacy fence must be
put around the pool. This is a country size lot and it is well over 300 feet
from the road to the house and swimming pool. This is the best location
available to put the pool. Motion carried unanimously.
Case No. 04-V48?-Granted.
Jim Prescott, 3340 Meadowbrook Drive, and Comer Alexander, Builder, presented
the appeal for a variance to reduce the corner side yard setback requirement
from 25 feet to 18 feet, in order to make an addition, 12? x 26?, a carport &
storage room, to a single family residence. The property is zoned R-1A.
In their statements and in response to questions from the Board
Members, Mr. Prescott and Mr. Alexander gave the following information: This
is a corner lot and they would like to add an additional carport and storage
room addition to the existing carport which is the same dimension as the one
that they are proposing. The same basic building materials will be used and it
will be the same roof line.
There was no opposition presented to this appeal.
Mr. King made a motion, which was seconded by Mr. Lewis, to grant this
appeal because the addition will be built in the same taste of the house. To
reduce the corner side will not create any problems with traffic. Motion
carried unanimously.

Case No. 04-V49?-Granted.
Will Barnes, Barnes & Company, 3715 1st Avenue, presented the appeal for a
variance to reduce the number of off-street parking spaces from 585 to 5. The
property is zoned M-1.
In his statement and in response to questions from the Board Members, Mr.
Barnes gave the following information: They are working with The River Mill,
LLC and re-developing the old Bibb Mill in Bibb City. They don?t completely
agree with reducing the parking spaces from 585 to 5, but take into account the
entire Bibb Mill complex. Documentation was given to the Board Members to help
clarify what the appeal is. On the first sheet, it shows they want to
re-phrase the appeal to reducing the parking requirement from 4 spaces per
thousand square feet of building to 2 spaces per thousand square feet for all
mercantile occupancy. The appeal as it is written took into account only the
largest of the Bibb Mill building. This information was put together to
identify where all of the buildings and the existing parking are located on the
site. Their basic appeal is so that they can develop the phase 1 portion of
this project and utilize the parking they have on site now. Phase 1A is under
construction, phase 1B is shortly to be under construction, phase 1C and 1D are
the first floor of the 130,000 square feet per floor mill building of 4 floors,
4 mercantile floors. These are the first phase construction aspects that they
want to address. Additionally there is ground level storage occupancy in the
main mill and it is beneath the first floor, there is basement storage beneath
that. There are 2 offices 404,000 square feet of warehouse storage. If you
add up all of the required parking spaces, you will see there are 1,063
required. There is parking available for 897 spaces. They are not asking that
any of the storage of office space parking requirement be reduced, they think
that if you have office space that the parking requirements are probably in
order, but for mercantile and what the developer intends to do here is to
create an antique mall. They think the parking requirements are a little high
in connection with what is typically seen in mercantile. They are asking phase
1A, 1B, 1C and 1D be reduced to half. They have talked about it all going
mercantile in the larger mill. The 404,000 square feet of warehouse storage
would not become mercantile. If the 4 story mercantile went forward that would
probably become some entrance areas, warehouse storage and then become a
parking deck are something that requires the requirement.

Mr. King made a motion, which was seconded by Mr. Edwards, to grant this
revised appeal to reduce the number of off-street parking spaces based on the
current 4 spaces per thousand square feet down to 2 spaces per thousand square
feet (on the mercantile, the storage and other facilities, he would be willing
to leave the rest as is, reference the site plan diagram that was presented at
the meeting by Barnes & Company Architect). Due to the fact this is an
existing structure, it is not a new site that is being created. This will give
ample parking for the type business they are trying to attract. Motion carried
unanimously.
Case No. 04-V50?-Granted.
Herman Lewis, and Alexander White, presented the appeal of 2702 Spenola Street,
for a variance to reduce the corner side yard setback requirement from 20 feet
to 8 feet, in order to make an addition, 16? x 16?, an over flow porch, to a
church. The property is zoned R-3A.
In their statements and in response to questions from the Board
Members, Mr. Lewis and Mr. White gave the following information: They would
like to add a covered porch to the church. The same materials will be used to
match the church. They did talk to the neighbors and they are not in
opposition to this addition.
There was no opposition presented to this appeal.
Mr. Fox made a motion, which was seconded by Mr. Lewis, to grant this
appeal to allow the church to make a receiving porch on the front of the
church. One corner actually encroaches to within 8 feet of the property line.
It is a triangular shaped corner and where the church is located they do not
have any other options because of parking considerations. Motion carried
unanimously.
Case No. 04-V51?-Withdrawn.
This appeal was withdrawn at the request of the appellant Fred Cronin, 1042
33rd Street, for a variance to reduce the 6 feet separation required between
structures to 3 feet. The property is zoned R-4.

Case No. 04-V52?-Granted.
Dhan Parekh presented the appeal of Hilton Garden Inn, 1500 Bradley Lake
Boulevard, for a variance to increase the height of a ground sign from 20 feet
to 75 feet. The property is zoned A-O. (The appellant?s Case No. 02-V187 was
approved on 12/04/02 for a height increase from 20 feet to 70 feet)
In his statement and in response to questions from the Board Members, Mr.
Parekh gave the following information: They need an extra 5 feet because they
have a very small area to work with because of the Georgia Power easement and
the DOT line. The lay of the land is such that they think 5 feet will cover
the height into the area.
There was no opposition presented to this appeal.
Mr. Edwards made a motion, which was seconded by Mr. Lewis, to grant this
appeal because they have been before the Board previously and were approved for
70 feet and now they want 5 more feet because of the topography. Motion
carried by the affirmative vote of the four Board Members with David Fox
abstaining from the vote.
