An Ordinance amending the Zoning Atlas of the Consolidated Government

of Columbus, Georgia; this amendment changes certain boundaries of a district

located at 5812 and 5820 Buena Vista Road and all lots fronting the Zenos Drive

right-of-way, from R-1A (Low Density Residential) District to R-2 (Low Density

Residential) District.



THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY ORDAINS:



That the Zoning Atlas on file with the Planning Division of the

Department of Community and Economic Development be, and the same is hereby

amended by changing the following described property from R-1A (Low Density

Residential) District to R-2 (Low Density Residential) District:



All those lots, tracts or parcels of land situate, lying and being in Land Lot

20 of the 9th District of Muscogee County, Georgia, and being all of Lots 15 to

25 of Block ?K?, Lots 14 to 26 of Block ?L?, Lots 1 to 12 of Block ?M?, and

Lots 1 to 13 of Block ?N?, BUENA VISTA HEIGHTS SUBDIVISION, as said lots are

shown on a map or plat of said subdivision recorded in Plat Book 5, Page 49 in

the Office of the Clerk of the Superior Court of Muscogee County, Georgia, to

which reference is made for a more particular description of said lots.



ALSO, herein conveyed is all of Zenos Drive, from Buena Vista Road to the

United States Military Reservation, and all of Alton Way, from the westerly

margin of Winall Drive to the prolongation of the east margin of Lot 13, Block

?N?, and all of Upland Way from the prolongation of the westerly margin of Lot

15, Block ?K?, to a prolongation of the easterly margin of Lot 12, Block ?M?,

all as shown on said map or plat.



The above-described property is being rezoned with the following conditions:



1. A maximum of 57 lots shall be permitted.

2. Restrictive covenants shall be required for the development.

3. A smoke disclosure statement shall be required in all home sales. The

requirement for the disclosure shall be included in the restrictive covenants

of said development. The smoke disclosure statement shall be attached to this

ordinance.

4. A noise disclosure statement shall be required in all home sales. The

requirement for the disclosure shall be included in the restrictive covenants

of said development. The noise disclosure statement shall be attached to this

ordinance.

5. A minimum of ten (10) acres shall be preserved as greenspace.

Introduced at a regular meeting of the Council of Columbus, Georgia held on

the 21st day of June, 2005; introduced a second time at a regular meeting of

said Council held on the day of , 2005 and adopted at said

meeting by the affirmative vote of members of said Council.
