The Regular Meeting of the Board of Zoning Appeals was held Wednesday, February

6, 2002 at 2:00 P.M., on the 1st Floor of the Government Center Annex, 420-10th

Street. Members present were:

Also present were Mr. Danny Cargill, Secretary of the Board, and Ms. Veronica

Pitts, Recording Secretary.





VARIANCES.



Case No. 02-V34?-Granted.



William Tye, 5503 Rodgers Drive, presented the appeal for a variance to reduce

the corner side yard setback requirement from 25 feet to 11 feet, in order to

make an addition, 20? x 60?, to a single family residence. The property is

zoned R-1A.





In his statement and in response to questions from the Board Members, Mr. Tye

gave the following information: He lives on a corner lot. He would like to

add a living room, bedroom and a bathroom to his home.



There was no opposition present to this appeal.



Mr. Fox made a motion, which was seconded by Mr. Billingsley, to grant this

appeal because the addition will be no closer to the street than the existing

house. Motion carried by the affirmative vote of the four Board Members

present for this meeting.













BOARD OF ZONING APPEALS ? 02/06/2002





Case No. 02-V35?-Granted.



Paul Gibson and Phillip Thayer presented the appeal of Richard Schwindt, 2004

Country Club Drive, for a variance to reduce the rear yard setback requirement

from 30 feet to 29 feet, in order to add brick veneer to a single family

residence. The property is zoned R-1A.



In their statements and in response to questions from the Board Members, Mr.

Gibson and Mr. Thayer gave the following information: The house is already

under construction. Originally the house was going to have siding. They are

adding brick veneer to the home. They need the 1 foot to give them room to

work.



There was no opposition present to this appeal.



Mr. Fox made a motion, which was seconded by Mr. Billingsley, to grant this

appeal because the house is already constructed. They decided to add brick

instead of siding and it?s actually encroaching on the rear yard setback.

Motion carried by the affirmative vote of the four Board Members present for

this meeting.



Case No. 02-V36?-Granted.



Tamara Marshall Edwards, 5704 Billings Road, presented the appeal for a

variance to reduce the lot width requirement from 100 feet to 99.37 feet and to

reduce the lot width requirement from 100 feet to 25.15 feet and to reduce the

rear yard setback requirement from 40 feet to 28 feet and to reduce the front

yard setback requirement from 30 feet to 10 feet. The property is zoned R-1.

Contingent upon Planning approval.





In her statement and in response to questions from the Board Members, Ms.

Edwards gave the following information: She purchased the property two years

ago. She was unaware that she could not have two buildings on one piece of

property. They fixed up the house in the back and they lease the house in the

front. The only option she has is to separate the lot into two lots.

Planning does not oppose this request.



There was no opposition present to this appeal.



Mr. Phillips made a motion, which was seconded by Mr. Billingsley, to grant

this appeal because the homes are already on the lot. They are not developing

property, but continuing to use the property as it has been used previously.

In order for the owner to do that, it requires separation of the two

buildings. Motion carried by the affirmative vote of the four Board Members

present for this meeting. Contingent upon Planning approval.



Case No. 02-V37--Granted.



George Stringer, presented the appeal of Louise Crowell, 3541 Califon

Drive, for a variance to reduce the side yard setback requirement from 8 feet

to 5 feet and the rear yard setback requirement from 30 feet to 24 feet, in

order to make an addition, to a single family residence. The property is zoned

R-1A.





In his statement and in response to questions from the Board Members, Mr.

Stringer gave the following information: Ms. Crowell would like to add a

carport to her home. It will be over an existing slab. The same materials

will be used to match the house.



There was no opposition present to this appeal.



Mr. Fox made a motion, which was seconded by Mr. Billingsley, to grant this

appeal because the carport will be over an existing slab. The same materials

will be used to match the house. Motion carried by the affirmative vote of the

four Board Members present for this meeting.



Case No. 02-V38--Granted.



Hane Hollis presented the appeal of Sunbelt-Columbus, L.L.C., 2830 Hart Drive,

for a variance to reduce the number of required off street parking spaces from

119 spaces to 80 spaces. The property is zoned C-3.

In his statement and in response to questions from the Board Members, Mr.

Hollis gave the following information: They are developing a 79 room hotel.

They noticed the requirement for parking spaces were 1.5 spaces per room. The

industry-hotel standards are 1 space per room. They have 16 other properties

in operation and all of them are based on the 1 to 1 ratio.



There was no opposition present to this appeal.



Mr. Phillips made a motion, which was seconded by Mr. Billingsley, to grant

this appeal because 1 parking space per room is adequate. Motion carried by

the affirmative vote of the four Board Members present for this meeting.

Keith Mclaughlin, 5743 Pineview Avenue, presented his application for a
