Subject Lullwater Apartments Proposed Rezoning

Description Have the staff to look into the statement made by Mr. Jeffcoat

in that they have been told by the Inspections & Code Division that they will

be unable to bring construction traffic back through the occupied area is not

acceptable to them. (Request of Councilor Allen)

Response When dealing with apartment complexes in the past, we have required

the developer to keep the construction traffic separate from any occupied

apartments, for public safety reasons. In most cases this has been

accomplished by some mutually acceptable means. Only if it were impossible to

provide access to the construction area by some other route have we allowed

construction traffic through the occupied apartment area. Even then, none of

the occupied area can be used for construction, or for staging for

construction. It is more desirable to keep construction traffic on the public

right of way rather than through an occupied apartment parking lot where there

is more congestion due to a closer proximity of vehicles and/or foot traffic.
