The Regular Meeting of the Board of Zoning Appeals was held Wednesday, December

3, 2003 at 2:00 P.M., on the 1st Floor of the Government Center Annex, 420-10th

Street. Members present were:

CASES TABLED FROM THE NOVEMBER 5th MEETING.



Case No. 03-V141--Granted.



Brian Senior presented the appeal of Horace Senior, 1243 Boxwood Boulevard, for

a variance to reduce the rear yard setback requirement from 30 feet to 19 feet,

in order to make an addition, a carport, 22? x 26?. The property is zoned

R-2.



In his statement and in response to questions from the Board Members,

Mr. Senior gave the following information: They would like to add an

additional carport to their home. The carport will be large enough for two

cars. The same materials will be used to match the house. The carport will

have a gable roof and the water will go to the back yard.



There was no opposition presented to this appeal.



Mr. Fox made a motion, which was seconded by Mr. King, to grant this

appeal because they are adding an additional carport. The same materials will

be used to match the house. Motion carried unanimously.





Board of Zoning Appeals ? 12/03/2003





Case No. 03-HO290--Denied.



There was no one present to present the application of Schanta Newman, 1053

Dunbar Avenue, for a Certificate of Occupancy for a Home Occupation for an

office only for a janitorial and carpet cleaning service, Million Dollar Carpet

& Janitorial Services. The property is zoned R-2.



There was no opposition to this application.



Mr. Fox made a motion, which was seconded by Mr. Lewis, to

deny this application because there was no one present to present

the application for two consecutive meetings. Motion carried

unanimously.



Case No. 03-HO302--Denied.



There was no one present to present the application of Robert Elliott, 1200

17th Street, for a Certificate of Occupancy for a Home Occupation for an office

only for a deejay and selling D.J. equipment, A.B.D.J.ING & Equipment. The

property is zoned C-3.



There was no opposition to this application.



Mr. Fox made a motion, which was seconded by Mr. Lewis, to

deny this application because there was no one present to present

the application for two consecutive meetings. Motion carried

unanimously.

VARIANCES.



Case No. 03-V143--Granted.



Chris Meecham and Buzzy Miller presented the appeal of CBI, 2944 Macon Road,

for a variance to reduce the corner side yard setback requirement from 25 feet

to 1 foot, in order to make an addition to a bank. The property is zoned A-O.

In their statements and in response to questions from the Board

Members, Mr. Meecham and Mr. Miller gave the following information: They are

asking for the variance because they are making modifications to the existing

Regions Bank. The Credit Union is in the process of purchasing the existing

Regions Bank building. Currently the building has two entrances, it is our

attention to achieve a more safe environment by eliminating the rear entrance.

Historically when problems have occurred the bad guys would come through the

back door. We would like to remove the rear entrance and add an entrance to

the east side of the facility. All parties who enter the building enter the

lobby and open area. The dimension of off set that we are requesting from the

property line to the overhang of the roof system at this new entrance is less

than or equal to the current condition that occurs at the corner. There will

be no obstruction of visibility. Our intent is based on safety.

Mr. Fox made a motion, which was seconded by Mr. Edwards, to grant this

appeal because this is an existing building and for security reasons that are

re-adjusting their access to the building. Motion carried unanimously.



Case No. 03-V144?-Denied.



Gary Spelman presented the appeal of Living Way Four Square Gospel Church, 7320

Whitesville Road, for a variance to increase the size of a sign from 15 square

feet allowed to 32 square feet. The property is zoned R-1A.



In his statement and in response to questions from the Board Members,

Mr. Spelman gave the following information: In 2001 they bought the property

and put up a 4? x 8? sign that read Future Home of Living Way Church and then

in July they took that one down and put up another sign. They didn?t know that

they weren?t correct in size, they did not know they needed a variance .

Approximately one month ago someone from Inspections and Codes told them they

needed to go before the Board of Zoning Appeals for a variance for the 4? x 8?

sign. With this size the writing is more legible.



There was no opposition presented to this appeal.

Board of Zoning Appeals ? 12/03/2003





Mr. King made a motion, which was seconded by Mr. Edwards, to deny this

appeal because the requested increase would more than double the size of an

allowable sign, plus the sign and the building do not blend in with the

residential setting. Motion carried by a vote of 3 to 2 with Mr. Fox and Mr.

Lewis voting against the motion and Mrs. Braxton voting with the motion to

break the tie.



Case No. 03-V145?-Granted.



Dave Erickson, Pinnacle Homes, Inc., 8021 Garrett Pines Drive, presented the

appeal for a variance to reduce the corner side yard setback requirement from

25 feet to 23 feet, in order to erect a single family residence. The property

is zoned R-2.



In his statement and in response to questions from the Board Members, Mr.

Erickson gave the following information: This house is already built. This is

a culmination of what he hopes is the last of this discussion. They have a

side setback variance on the wide side in the corner. In the process of laying

this house out, his employee watched the close side, but not the far side for

some reason. He has mentioned before that his employee has been reassigned to

other duties and hope this will not be repeated.



There was no opposition presented to this appeal.



Mr. Edwards made a motion, which was seconded by Mr. Lewis, to grant this

appeal because the house was already placed encroaching onto the setback

requirement. It would be a hardship to tear the house down and move it.

Motion carried by the affirmative vote of the four Board Members present with

David Fox abstaining from the

vote.



(Note: Mr. King stated this is the second or third case from the same

developer. He is not going to vote to deny this today, but if we continue to

see this we need to investigate to see if it is being inspected properly. The

contractor should be looking more closely and checking measurements.)

Board of Zoning Appeals ? 12/03/2003





Case No. 03-V146?-Granted.



Gail Aderhold and Louie Carratt of Action Buildings presented the appeal of

Mable McCoy, 2211 Watkins Drive, for a variance to reduce the side yard setback

requirement from 8 feet to 1 foot, in order to make an addition, 12? x 24?, a

carport, to a single family residence. The property is zoned R-2.



In their statements and in response to questions from the Board Members, Ms.

Aderhold and Mr. Carratt gave the following information: Ms. McCoy would like

to add a carport to her home. The carport will be over an existing patio

slab. The slab is slightly higher than the rest of the ground, there is a

slight decline so the water will go to the front and rear.



One of the Board Members asked if the appellant, Ms. McCoy, considered putting

on gutters. Gail Aderhold stated Ms. McCoy is open to putting on

gutters.



There was no opposition presented to this appeal.



Mr. King made a motion, which was seconded by Mr. Lewis, to grant this appeal

because the water will flow from the front to the rear with the stipulation

that a gutter be placed on the side of the adjoining neighbor to avoid any

water flow on their lot. Motion carried unanimously.



Case No. 03-V147?-Withdrawn.



This appeal was withdrawn at the request of the appellant Allen-Simpson, Inc.,

9651 Whitesville Road (Lot 6), for a variance to reduce the lot width

requirement from 125 feet to 25 feet, in order to replat a lot to erect a

single family residence. The property is zoned A-1.

Case No. 03-V148?-Withdrawn.



This appeal was withdrawn at the request of the appellant Allen-Simpson, Inc.,

9651 Whitesville Road (Lot 7), for a variance to reduce the lot width

9651 Whitesville Road (Lot 8), for a variance to reduce the lot width

requirement from 125 feet to 25 feet, in order to replat a lot to erect a

single family residence. The property is zoned A-1.



There was no opposition presented to this appeal.



Case No. 03-V150--Granted.



David Masters, 7450 Old Moon Road, presented his appeal for a variance to

reduce the lot width requirement from 100 feet to 82 feet, in order to replat a

lot and from a Decision of the Building Official that an accessory structure

may only be located in the rear yard. The property is zoned R-1.



In his statement and in response to questions from the Board Members,

Mr. Masters gave the following information: His father-in-law is getting older

and he wants to build an apartment/garage. When his father-in-law?s health

started failing, he decided to make the garage high enough like an apartment

and he could live in it and still could maintain his independence. This is the

best location for it because he would have to lose some trees, a water problem

will be created, there is a septic system and the area will look cramp.



Planning recommends approval of this request. The memorandum from

Aronda Smith, Principal Planner, Planning Division, is attached and therefore

is considered a part of these minutes.



There was no opposition presented to this appeal.



Mr. Fox made a motion, which was seconded by Mr. Edwards, to grant this

appeal, although the Building Official was correct, this would be the best

location for the accessory structure. Trees would have to be removed and there

would be drainage concerns. Motion carried unanimously.

Board of Zoning Appeals ? 12/03/2003





Case No. 03-V151--Granted.



Sandy Bosh and Finley Williamson presented the appeal of D & S Sign Company,

2100 Hilton Avenue, for a variance to increase the size of a sign from 15

square feet allowed to 23 square feet. The property is zoned R-1A.

In their statements and in response to questions from the Board

Members, Mr. Bosh and Mr. Williamson gave the following information: The

existing sign is 25 years old and it is rotting. They would like to take it

down and put up a new sign in the exact place. It will be two sided, red wood

and encapsulated.



When the Chairperson asked for opposition Diana Andrews came forward. She

wanted to know if the size of the sign was going to be increased and if there

would be internal lighting.



The appellants told Ms. Andrews the sign will not be larger and there will not

be internal lightning. They have bulbs or spot lights on the ground that shine

up on the side and they would probably use the same lights.



Mr. King made a motion, which was seconded by Mr. Lewis, to grant this

appeal to increase the size of the sign. It will be placed in good taste in

accordance to the way the old sign fit. The old sign was in bad shape. Motion

carried unanimously.



Case No. 03-V152?-Granted.



Richard Waddell, 5000 Milgen Road, presented his appeal for a variance

to increase the height of an accessory structure from 14 feet to 16 feet 6

inches and from a Decision of the Building Official that an accessory structure

may only be located in the rear yard. The property is zoned R-1A.



In his statement and in response to questions from the Board Members, Mr.

Waddell gave the following information: He would like to build an accessory

structure. It will not be visible from the road. The accessory structure will

be used for storage for his tractor.

Mr. Fox made a motion, which was seconded by Mr. Edwards, to grant this appeal,

although the Building Official is correct. This will be a garage type

structure. It will be built similar to the structure of the main body of the

house. This lot is more than 1,000 feet off of the main street. Motion

carried unanimously.



Case No. 03-V153?-Granted.



Rexon Byrd and Don Campbell presented the appeal of Muscogee County School

District, 2303 Wynnton Road, for a variance from the buffer ordinance option

#1, 2 acres or greater and to reduce the required number of shrubs from 375 to

118 and to increase the number of trees from the required 15 to 17 and delete

the requirement for shrub plantings beneath mature oaks along Forest Avenue to

minimize damage to root zones. Trees are located on City row. The property is

zoned R-4.



In their statements and in response to questions from the Board Members, Mr.

Byrd and Mr. Campbell gave the following information: They would like to

reduce the number of shrubs so they will not damage mature trees. The site is

heavily wooded, there is a fence along the back side that is also heavily

wooded. To plant shrubs in the buffer, the way the buffer ordinance is set up

we are going to damage trees. We would like to put more trees on Wynnton Road

and Wildwood Road. Forrest Avenue is completely mature oaks and we?ve had to

remove parking places out of there, we don?t want to get underneath them. The

other issues are putting a hedge out there that might limit visibility into the

school yard, security issues and maintenance which would be more difficult than

putting in trees. We want to balance the shrubs with the trees. It says that

we are adding two trees, but actually we are taking all of the trees that we

would need on the site and putting them out on Wynnton Road and Wildwood Road.

We are still leaving some of the shrubs at the driveway entrances point of

egress to do as much as we can to meet the buffer ordinance. We are putting in

elm trees. Instead of putting one tree every 100 feet or 150 feet we want to

put a tree every 35 or 40 feet and do a better tree plan.

Mr. Edwards made a motion, which was seconded by Mr. King, to grant this appeal

because adding the required amount of shrubs would damage the existing mature

oak trees. They presently have enough vegetation and trees on the property.
