The Regular Meeting of the Board of Zoning Appeals was held Wednesday, June 4,
2003 at 2:00 P.M., on the 1st Floor of the Government Center Annex, 420-10th
Street. Members present were:

Mr. Willie Lewis Jr.
Also present were Mr. Danny Cargill, Secretary of the Board, and Ms. Veronica
Pitts, Recording Secretary.
Board Member Ralph King was unable to attend the meeting. Mr. Fox made
a motion, which was seconded by Mr. Edwards, to excuse the absence because of
personal business. Motion carried unanimously by the four Board Members
present for this meeting. Mr. Willie Lewis was welcomed as a new Board
Member.

Case No. 03-HO111--Denied.
There was no one present to present the application of Zachary L. Thomas, 3629
Gray Fox Drive, for a Certificate of Occupancy for a Home Occupation for an
office only for website development/design shop, HotRodVille. The property is
zoned R-1A.
There was no opposition to this application.
Mr. Edwards made a motion, which was seconded by Mr. Lewis, to deny this

Case No. 03-V65--Granted.
William McWhirter, 507-2 Biggers Road, presented his appeal for a variance to
increase the height requirement of an accessory structure from 14 feet to 26
feet. The property is zoned A-1.
In his statement and in response to questions from the Board Members, Mr.
McWhirter gave the following information: He is building a garage and
workshop. The structure will be in a hole on the side of a hill at least 500
feet from Biggers Road. It has been approved by architectural control.
There was no opposition presented to this appeal.
Mr. Edwards made a motion, which was seconded by Mr. Fox, to grant this
appeal because the accessory structure is approximately 500 feet from the road
and there was no opposition to this request. Mr. McWhirter did receive
approval from the architectural control committee. Motion carried by the

Gary Parrish, 8141 Orchard Glen Drive, presented the appeal for a variance to
reduce the rear yard setback requirement from 30 feet to 24 feet, in order to
make an addition, 10? x 15?, a porch, to a single family residence. The
property is zoned R-1A.
In his statement and in response to questions from the Board Members, Mr.
Parrish gave the following information: He would like to add a screen porch to
the rear of a single family residence. This is a corner lot that is a little
smaller than the other lots. The materials used will match the house.
There was no opposition presented to this appeal.
Mr. Fox made a motion, which was seconded by Mr. Lewis, to grant this
appeal because this lot is smaller than the other lots in the area and this
would be an asset to the neighborhood. Motion carried by the affirmative vote
of the four Board Members present for this meeting.
Case No. 03-V67?Granted.
Gary Parrish, 7175 Blackmon Road, presented the appeal for a variance to reduce
the rear yard setback requirement from 30 feet to 27 feet, in order to erect a
single family residence. The property is zoned R-2.
In his statement and in response to questions from the Board Members,
Mr. Parrish gave the following information: They will erect a single family
residence in the right rear corner of the property where a sewer easement comes
in. This is a small lot and only approximately 10 feet is on the line. This
is the best way to position the house. There is nothing directly behind the
house, but a daycare is in the rear of the house on the left side.

Mr. Fox made a motion, which was seconded by Mr. Edwards, to grant this
appeal because this is an odd shape lot and the encroachment is the rear corner
of the house. Motion carried by the affirmative vote of the four Board Members

Case No. 03-V68?-Granted.
Bob Laws, Air Cool Awning, presented the appeal of Cheryl
Haley, 183 Sweetwater Drive, for a variance to reduce both side
yard setback requirements from 8 feet to 2 feet, in order to make
an addition, a carport, 9? x 23? and door/canopy 5? x 11?, to a
single family residence. The property is zoned R-2.
In his statement and in response to questions from the Board Members, Mr. Laws
gave the following information: Ms. Haley would like to add an aluminum
carport to her home. The carport will have gutters. There are other carports
in the area.
There was no opposition presented to this appeal.
Mr. Edwards made a motion, which was seconded by Mr. Fox, to grant this appeal
because there are other similar carports in the area and the carport will have
gutters to control the water run off. Motion carried by the affirmative vote
of the four Board Members present for this meeting.
Case No. 03-V69?-Granted.
Jaime Fernandez, 1016 Manley Drive, presented his appeal from a Decision of the
Building Official that an accessory structure must be at least 5 feet from the
side property line, 1 foot is shown. The property is zoned R-2.
In his statement and in response to questions from the Board Members, Mr.
Fernandez gave the following information: The accessory structure (a wood
storage shed) is already in place. He misunderstood the numbers on the blue
print. He thought the number was 3, but it was 5.
There was no opposition presented to this appeal.
Mr. Fox made a motion, which was seconded by Mr. Edwards, to grant this appeal,
even though the Building Official was correct, because the accessory structure
is already in place and Mr. Fernandez misread the number on the blueprint.

J. Woody Gilliam, 3765 Forest Road (Lot B), presented the appeal for a variance
to reduce the lot width requirement from 75 feet to 25 feet, in order to erect
a single family residence. The property is zoned R-1A. Contingent upon
Planning approval.
In his statement and in response to questions from the Board Members, Mr.
Gilliam gave the following information: He plans to build 3 houses. This is
one lot that they are dividing. The house next door was on two acres and it
was in dis-repair. The house was repaired and now it is a nice home which will
increase the property value.
There was no opposition presented to this appeal.
Planning does recommend approval of this request.
Mr. Edwards made a motion, which was seconded by Mr. Fox, to grant this appeal
because planning recommends approval of this request. This is a large lot and
this would be an improvement to the neighborhood. There was no opposition to
this request. Motion carried by the affirmative vote of the four Board Members
present for this meeting.
Case No. 03-V71?-Granted.

Case No. 03-V72?-Granted.
Ben Moon of Moon, Meeks, Mason & Vinson, Inc., 1569 Woodland Drive, presented
the appeal for a variance to reduce the lot width requirement from 60 feet to
25 feet, in order to erect a single family residence. The property is zoned
R-2. Contingent upon Planning approval.
In his statement and in response to questions from the Board Members,
Mr. Moon gave the following information: The owner had the property rezoned to
R-2. They wanted 4 lots, but Planning recommended 3 lots. One lot is
extremely big, it was a nice piece of property before Georgia Power condemned
part of it. There will be two houses on the front and one in the back.
When the Chairperson asked for opposition, Ms. Sandy Kawosky came forward. She
stated the street was not big enough to park two cars. She also wanted to look
at the plans to find out the size of the lots.
Mr. Fox made a motion, which was seconded by Mr. Edwards, to grant this appeal
because planning did approve this request. Because of the Georgia Power
easement the lot is an odd shape and in order to make this lot a logical use
this reduction is required. Motion carried by the affirmative vote of the four
Board Members present for this meeting.
Case No. 03-V73?-Granted.
Wayne Griffin, 1501 Buk Court, presented his appeal from a Decision of the
Building Official that an accessory structure may not exceed 14 feet in height,
16 feet shown. The property is zoned R-1A.

Griffin gave the following information: The accessory structure is already
constructed. He wasn?t aware of the 14 feet height requirement. His home is a
two story and he built the accessory structure to match it. The upstairs has
an attic for storage.

Robert Yarbrough, 1801 Carter Avenue, presented his appeal for a variance to
reduce the side yard setback requirement from 8 feet to 3 feet, in order to
make an addition, a bedroom, to a single family residence. The property is
zoned R-1A.
In his statement and in response to questions from the Board Members, Mr.
Yarbrough gave the following information: He would like to add a bedroom to
his home. The same materials will match the house.

Rhonda Walkerson presented the appeal of Columbus Area Habitat For Humanity,
1033 47th Street, for a variance to reduce the lot area from 6,000 square feet
to 5,923 square feet and to reduce the lot width from 50 feet to 45 feet, in
order to erect a single family residence. The property is zoned C-3.

Walkerson gave the following information: They are proposing to build 5 houses
in this area. This particular lot is small, but it is common to have lots this
size (narrow).

because most of the lots in this area are this size and it wouldn?t be out of

Case No. 03-V76?-Granted.
Bill Green presented the appeal of Developers-Investors, Inc., 8432-U Veterans
Parkway, for a variance to increase a sign from 15 square feet to 28 square
feet. The property is zoned R-1.
In his statement and in response to questions from the Board Members, Mr. Green
gave the following information: They are putting in another entrance at Maple
Ridge Subdivision. They have a landscape plan that is natural. They would
like to put up a rock sign. The 15 square feet allowed would be too small for
the entrance. They would like to increase the size of the letters so they will
show up from the street and on the rock. They will have one single sign that
will be recognizable.
