side yard. The property is zoned R-1A.
In her statement and in response to questions from the Board Members, Ms.
Aderhold gave the following information: Mr. Putman would like to put a
carport in the corner side yard. He bought a garage and a carport at the same
time. The carport is too close to the property line. There was confusion
about where the property line was.
There was no opposition present to this appeal.
Mr. Edwards made a motion, which was seconded by Mr. Fox, to grant this appeal
because this would be the place to put the carport. Motion carried by the
affirmative vote of the three Board Members present for this meeting.
Case No. 02-V95?-Granted.
W. Bailey Gross, 1311 18th Avenue, presented the appeal for a variance to

lot. The property is zoned R-4 (H). Contingent upon Planning approval.

BOARD OF ZONING APPEALS ? 06/05/2002
In his statement and in response to questions from the Board Members, Mr. Gross
gave the following information: The lot already has a duplex on it. He would
like to develop it as a multi-family lot. In order to do that he would have to
either add on to the duplex or cut the duplex off and do a multi-family
structure. There is a vacant lot beside it. He would like to divide the lot.
He would like to make it an independent lot and develop it.
When the Chairman asked for opposition, Mr. Kromer came forward. He stated,
Mr. Gross has a duplex across from Lake Bottom Park and this would change the
character quite a bit. He would have to cut down about 10 or 12 trees. This
will de-value his home.
Mr. Fox made a motion, which was seconded by Mr. Edwards, to grant this appeal
because it is zoned for apartments. His intention is to try to save as many
trees as possible by redirecting parking and placement of the apartments.
Motion carried by the affirmative vote of the three Board Members present for
this meeting. Contingent upon Planning approval.
Case No. 02-V96?-Granted.
Eddie Miles presented the appeal of Kelvin Hill, 3886 Woodland Drive, for a
variance to reduce the side yard setback requirement from 8 feet to 2 feet 7
inches, in order to make an addition, 20? x 25? 1?, a garage, to a single
family residence. The property is zoned R-1A.
In his statement and in response to questions from the Board Members, Mr. Miles
gave the following information: Mr. Hill would like to add a 2 car garage to
his home. There is an existing slab. The same materials will be used to match
the house. The water will flow to the front and the back.
There was no opposition present to this appeal.
Mr. Fox made a motion, which was seconded by Mr. Edwards, to grant this appeal
because the garage will go over an existing slab. The same materials will be
used to match the house. Motion carried by the affirmative vote of the three
Board Members present for this meeting.
19
BOARD OF ZONING APPEALS ? 06/05/2002
Case No. 02-V97--Granted.
Joseph Morales presented the appeal of Aecha Gossett, 151 Bob-O-Link
Drive, for a variance to reduce the side yard setback requirement from 8 feet
to 7 feet, in order to make an addition, 16? x 20?, a sunroom, to a single
family residence. The property is zoned R-1A.
In his statement and in response to questions from the Board Members, Mr.
Morales gave the following information: He asked to change the side yard from
8 feet to 6 feet (request was granted). Mr. Gossett would like to have more
living space. They would like to add a sunroom to their home. They don?t have
any other place to put this type structure. The back yard is concrete and it
has a swimming pool.
There was no opposition present to this appeal.
Mr. Edwards made a motion, which was seconded by Mr. Fox, to grant this appeal
because the side yard is the only place to put the addition. Motion carried by
the affirmative vote of the three Board Members present for this meeting.
Case No. 02-V98--Denied.
There was no one present to present the appeal of A.H. Dudley III, 304 S.
Lumpkin Road, for a variance to reduce the requirement for a 6 inch aggregate
base to existing base. The property is zoned M-1.
When the Chairman asked for opposition Rebecca Wiggins, Housing Code
Coordinator for Inspections and Code Enforcement Division came forward. She
stated, In August of 1999 Council Enacted a new mobile home park ordinance.
All parks were to be in compliance with this ordinance by October 2000. I met
with Mr. Dudley in January 2000 to go over deficiencies that he had there at
Orchard Grove Mobile Home Park on South Lumpkin Road. He did not come into
compliance. He was cited to court in April 3, 2002. I will remind you that he
was to be in compliance by October 2000. I have worked with him all of this
time. We gave
20
BOARD OF ZONING APPEALS ? 06/05/2002
him a moratorium because he was in brief negotiations with the city to buy that
park. He told me that he would have the park in compliance by January 2002, he
did not. He was cited to court on April 3, 2002. He was fined for one of his
violations and on the other one, which was the road problem he was given a
continuance by the judge until May 6. At that time, he had done a small
portion of the road to bring it into compliance and he indicated to the court
at that time that he would do the rest of the road like that. He was found in
non-compliance by the court and fined for his failure to be in compliance. He
should be required to do what the ordinance requires and that he should not be
given any sort of leniency at all. All other parks have either come into
compliance, been to court or they have closed down. He will argue that his
road surface is adequate. It does not meet the ordinance. He has met with
Richard Smith, the Councilor. Who told him that it did not meet code. He has
met with Richard Bishop, assistant city manager and Bill Duck and myself at the
same time and all of us told him that it did not meet the ordinance. The court
has ruled that it does not meet the ordinance. I?m asking you to deny it.
Mr. Fox made a motion, which was seconded by Mr. Edwards, to deny this appeal
because there was opposition to the appeal from the Inspections & Code
Enforcement Division that the appellant has been under notice since August
1999, to bring the Mobile Home Park into compliance; he has been cited into
court; and, he still has not brought the property into compliance. Also, it
was noted that the appellant did not appear for the hearing.
Case No. 02-V99?-Denied.
Robert Teasley, Signs, Inc., presented the appeal of Tire King, 5403
Veterans Parkway, for a variance to increase the maximum height requirement
from 35 feet to 58 feet, in order to erect a ground sign. The property is
zoned C-3.
In his statement and in response to questions from the Board Members,
Mr. Teasley gave the following information which he illustrated by
photographs: A sign of the required height of 35 feet could not be seen
because of trees, wires, and the awning over the gas pumps. They tried to use
the 45-foot pole which was formerly used by the Shell Oil Company at this
location, but 45 feet was not enough height for the sign to be seen. Tire King
is
21
BOARD OF ZONING APPEALS ? 06/05/2002
the dealer for Michelin, B.F. Goodrich, and Uniroyal tires. All three should
have signs, but because of the highway frontage at this location, they can only
have two signs. They used a bucket truck to raise the sign to the 58-foot
height before it could be easily seen.
There was no opposition presented to this appeal.
Mr. Fox made a motion, which was seconded by Mr. Edwards, to deny this
appeal because the appellant did not show that enough hardship was created so
that there was a need to have the height of 58 feet. Also, they do have the
right to have a second sign on this property. Motion carried by the
affirmative vote of the three Board Members present for this meeting.
Case No. 02-V100--Granted.

of the Building Official that a sign is not allowed in an R-4 zone. The
property is zoned R-4.

gave the following information: He has two buildings. He was erecting a brick
sign that he thought was within the regulations. The building is zoned
residential, he can not have a sign in an R-4 zone.
There was no opposition present to this appeal.
Mr. Fox made a motion, which was seconded by Mr. Edwards, to grant this appeal
because this is a special exception use. Motion carried by the affirmative
vote of the three Board Members present for this meeting.
Case No. 02-V101--Withdrawn.
This appeal was withdrawn at the request of the applicant AFLAC, 1932
Wynnton Road, from a Decision of the Building Official that only 2 signs are
allowed, 6 signs are shown. The property is zoned A-O.

BHAR approval.
In her statement and in response to questions from the Board Members, Ms.
Douthit gave the following information: This is a pre-existing building that
she obtained. She is moving a house to this lot. She is almost certain that
the house will pass BHAR?s approval, but wanted to know if the variance would
be approved.
There was no opposition present to this appeal.
Mr. Fox made a motion, which was seconded by Mr. Edwards, to grant this appeal
because this is an odd shaped lot. Motion carried by the affirmative vote of
the three Board Members present for this meeting. Contingent upon BHAR
approval.
