The Regular Meeting of the Board of Zoning Appeals was held Wednesday, June 5,

2002 at 2:00 P.M., on the 1st Floor of the Government Center Annex, 420-10th

Street. Members present were:

CASES TABLED FROM THE MAY 1st MEETING.



Case No. 02-V59?-Granted.



Kimberly Brown and Joe Jimmerson presented the appeal of Alphabet Train, 1332

Wynnton Road, appealing the decision of the Board of Historic & Architectural

Review that a fence is not allowed in the rear yard. The property is zoned A-O.





In their statements and in response to questions from the Board Members, Ms.

Brown and Mr. Jimmerson gave the following information: They have not changed

the fence.



There was no opposition present to this appeal.



Mr. Fox made a motion, which was seconded by Mr. Edwards, to grant this appeal

with the stipulation that you attach a picket fence to the existing chain link

fence on the Blandford Avenue side. New drawings must be submitted and

approved by BHAR. Motion carried by the affirmative vote of the three Board

BOARD OF ZONING APPEALS ? 06/05/2002





Case No. 02-V67?-Granted.



Trey Dykes presented the appeal of Billy Bickerstaff, 1902 Wildwood Avenue, for

a variance to reduce the rear yard setback requirement from 30 feet to 5 feet,

in order to subdivide property to develop a second lot with a single family

residence. The property is zoned R-3A. Contingent upon Planning approval.





In his statement and in response to questions from the Board Members, Mr. Dykes

gave the following information: He talked with his neighbors that were in

opposition and they agree with what he is planning to do.



Sally Routenna was in opposition last month along with her mother, but she is

not in opposition with Mr. Dykes if he does what he presented to them on the

plans as long as that is what happens.



There was no opposition present to this appeal.



Mr. Edwards made a motion, which was seconded by Mr. Fox, to grant this appeal

because he reached a compromise with his neighbors. Motion carried by the

affirmative vote of the three Board Members present for this meeting.



Case No. 02-HO90---Granted.



Charlotte Sanks, 758 Omega Drive, presented her application for a

Certificate of Occupancy for a Home Occupation for an office only for promoting

gospel programs (promoter), CVJ Productions. The property is zoned R-1A.



In her statement and in response to questions from the Board Members,

the applicant gave the following information: She will be using an office

only. There will be no employees and no additional traffic. This will be part

time.

Joe Bishop presented the appeal of George C. Woodruff, 2801 Double Churches

Road, for a variance to reduce the required number of off-street parking spaces

from 77 to 64, in order to erect, Eckerd Drug Store. The property is zoned C-2.





In his statement and in response to questions from the Board Members, Mr.

Bishop gave the following information: They are proposing to develop a 13,824

square foot Eckerd Drug Store on this site. Eckerd?s is willing to live with

the number of parking spaces that they have. Also, they have the drive thru

lane which will accommodate a number of customers. They will have ample space

for landscaping.



There was no opposition present to this appeal.



Mr. Fox made a motion, which was seconded by Mr. Edwards, to grant this appeal

to erect an Eckerd Drug Store. Motion carried by the affirmative vote of the

77 to 66, in order to erect, Eckerd Drug Store. The property is zoned C-3.



In his statement and in response to questions from the Board Members, Mr.

Bishop gave the following information: They are proposing to develop a 13,824

Bruce and Angela Chapman, 3325 Edgewood Road, presented the appeal from a

Decision of the Building Official that an accessory structure, a storage

building, 8? x 16?, is not permitted in the front yard. The property is zoned

R-1A.



In their statements and in response to questions from the Board Members, Mr. &

Mrs. Chapman gave the following information: The storage building is already in

place. The back of the house is not accessible for a truck that will allow the

storage building to go in the back yard. There is also a sprinkler system in

the back yard. There is a privacy fence around the back yard. Even if they

could get the building in the back, the back yard would not accommodate the

building. There are other storage buildings in the front yard in the

neighborhood.



When the Chairman asked for opposition, Fred Belvin came forward. He stated

the storage building should not be in the front yard and it is an eyesore.

Mr. Fox made a motion, which was seconded by Mr. Edwards, to table this appeal

so that the Board Members can go and look at the location of the storage

building. Motion carried by the affirmative vote of the three Board Members

Case No. 02-V73?-Granted.



Dave Erickson presented the appeal of Sage Development Inc., 6035 Warm Springs

Road Lot #33, for a variance to reduce the lot width requirement from 60 feet

to 25 feet, in order to erect a single family residence. The property is zoned

R-2. Contingent upon Planning approval.



In his statement and in response to questions from the Board Members, Mr.

Erickson gave the following information: This is an out parcel from an

established sub-division. They have a parcel in one corner of the property

that is approximately 4 to 5 acres that is not easily accessed because of a

large stream bed. They have the option of bringing in a driveway cut from Warm

Springs Road. He feels this will be a public safety hazard. The better option

is to come in off the end of a cul-de-sac. This will be better access. There

will be two over sized lots that are accessed from a common driveway at the end

of the court.

There was no opposition present to this appeal.



Mr. Edwards made a motion, which was seconded by Mr. Fox, to grant this appeal

so that they can enter from the cul-de-sac rather than Warm Springs Road.

Dave Erickson presented the appeal of Sage Development, Inc., 6035 Warm Springs

Road Lot #34, for a variance to reduce the lot width requirement from 60 feet

to 25 feet, in order to erect a single family residence. The property is zoned

R-2. Contingent upon Planning approval.

In his statement and in response to questions from the Board Members, Mr.

Erickson gave the following information: This is an out parcel from an

established sub-division. They have a parcel in one corner of the property

that is approximately 4 to 5 acres that is not easily accessed because of a

large stream bed. They have the option of bringing in a driveway cut from Warm

Springs Road. He feels this will be a public safety hazard. The better option

is to come in off the end of a cul-de-sac. This will be better access. There

will be two over sized lots that are accessed from a common driveway at the end

of the court.



There was no opposition present to this appeal.



Mr. Edwards made a motion, which was seconded by Mr. Fox, to grant this appeal

so that they can enter from the cul-de-sac rather than Warm Springs Road.

Billy Strickland, 2723 West Britt David Road and Bobby Battle presented the

appeal for a variance to reduce the side yard setback requirement from 15 feet

to 4 feet, in order to make an addition, a bathroom, closet & extend the great

room, 9?5? x 24?, to a single family residence. The property is zoned C-2.



In their statements and in response to questions from the Board Members, Mr.

Strickland and Mr. Battle gave the following information: Mr. Strickland would

like to add a bathroom and increase the living space. The addition will be

lined up with the existing house.

because the house already encroaches on the 4 feet. This will be a

Robert Teasley presented the appeal of Edgewood UMC, 2371 Elm Drive, for a

variance to increase the size of an I.D. sign from 15 square feet to 32 square

feet. The property is zoned R-1A.



In his statement and in response to questions from the Board Members, Mr.

Teasley gave the following information: This will be an unlighted sign. They

own the parcel and they want people to be aware that the property belongs to

the church.

Mr. Edwards made a motion, which was seconded by Mr. Fox, to grant this appeal

because the size of the sign is appropriate for the lot. They want to identify

Greg Way, 1218 33rd Street and Ben Moon presented the appeal for a variance to

reduce the rear yard setback requirement from 30 feet to 10.63 feet and to

reduce the required number of off-street parking spaces from 8 to 1, in order

to replat a lot. The property is zoned R-4. Contingent upon Planning

approval.



In their statements and in response to questions from the Board Members, Mr.

Way and Mr. Moon gave the following information: He is the purchaser of this

lot. All of the buildings and all of the parking is in place. There are two

lots. They would like to divide the lots and put a building on a separate

lot. There are 33 parking spaces in the whole complex. There will be cross

easements.

side yard setback requirement from 15 feet to 7 feet 6 inches, in order to

erect a storage building, 40? x 60?. The property is zoned C-3.



In his statement and in response to questions from the Board Members, Mr. Tefft

gave the following information: He would like to build a storage building. He

has poured the slab, but has not erected the building.

because the slab was poured too close to the property line. Motion carried by

Doris Gates presented the appeal of Carmelo & Deborah Gaudinot, 1842 Somerset

Avenue, for a variance to reduce the rear yard setback requirement from 30 feet

to 12 feet, in order to make an addition, 17? x 18?, a sunroom, to a single

family residence. The property is zoned R-2.



In her statement and in response to questions from the Board Members, Ms. Gates

gave the following information: The Gaudinot?s would like to enclose a patio

to make a sunroom. The back yard is fenced in.

James & Rhonda Harden, 1939 Wellborn Drive, presented the appeal for a variance

to reduce the side yard setback requirement from 8 feet to 3 feet, in order to

make an addition, 12? x 23?, a carport, to a single family residence. The

property is zoned R-2.



In their statements and in response to questions from the Board Members, Mr. &

Mrs. Harden gave the following information: They enclosed an existing carport

to make a living room. They would like to add a carport to their home. There

is plenty of room in the back, but the front is kind of tight. They will have

access to the back yard. It will have a gable roof. The water will flow to

the back and the side.

because previously he enclosed a carport and is adding a new one. Motion

Holley Talley, 5429 Wayne Drive and Ray Phillips presented the appeal for a

variance to reduce the side yard setback requirement from 8 feet to 2 feet, in

order to make an addition, a carport, 18? x 24?, to a single family residence.

The property is zoned R-2.

In their statements and in response to questions from the Board Members, Mr.

Talley and Mr. Phillips gave the following information: Mr. Talley had a

house, but it burned down. On the original plans they moved the house 3 feet

to the right in order to put up an awning. Mr. Talley thought when the permit

was bought to erect his new house, the permit for the carport was included.

When they found out they did not have a permit they stopped working on the

house and filed for a variance. There are similar carports in the area. The

water will go toward the street.



When the Chairman asked for opposition Douglas Jackson came forward, he was

representing his mother Bonnie Jackson. He stated the water from Mr. Talley?s

property is flowing on his mother?s property.



Mr. Fox made a motion, which was seconded by Mr. Edwards, to table this appeal

until the July meeting so that Mr. Tally and Mrs. Jackson can try to work this

situation out. Motion carried by the affirmative vote of the three Board

Members present for this meeting.



Case No. 02-V84?-Granted.



Ken Knuckles presented the appeal of Tricon Global Restaurants (KFC), 3340

Buena Vista Road, for a variance to reduce the required number of off-street

parking spaces from 38 to 29. The property is zoned C-3.



In his statement and in response to questions from the Board Members, Mr.

Knuckles gave the following information: KFC is hoping to open several new

restaurants in Columbus this year. This site is a small lot (approximately .6

acre lot). They have existing concrete, power poles and over head lines and

easements that they have to deal with. The building will be 2850 square feet.

It will have 60 seats and a drive thru.

because this is a high traffic area. Most of the restaurants will have a lot

of drive thru traffic. Motion carried by the affirmative vote of the three

Case No. 02-V85?-Granted.



Ken Knuckles presented the appeal of Tricon Global Restaurants (KFC), 1934

Columbus-Manchester Expressway, for a variance to reduce the required number of

off-street parking spaces from 38 to 34. The property is zoned C-2.



In his statement and in response to questions from the Board Members, Mr.

Knuckles gave the following information: KFC is hoping to open several new

restaurants in Columbus this year. This site is comprised of two smaller lots

that total about an acre. The two lots are different in elevation about 14

feet. They have an unusual configuration. The building will be 2850 square

feet. It will have 60 seats and a drive thru.



There was no opposition present to this appeal.



Mr. Fox made a motion, which was seconded by Mr. Edwards, to grant this appeal

because this is a high traffic area. Most of the restaurants will have a lot

Warren Kennon and Joe Alexander presented the appeal of Mike Mason, 727 Double

Churches Road, for a variance to reduce the rear yard setback requirement from

40 feet to 12 feet, in order to make an addition, 18? x 28?, a den & a screened

porch, to a single family residence. The property is zoned R-1.

Kennon and Mr. Alexander gave the following information: The Mason?s would

like to add a den and a screened porch to their home. This will increase the

property value and add to the community. The addition can not be in the back

yard because of the sewer easement. The same materials will be used to match

the house.

Bruce Walker presented the appeal of Easter Seals, 2515 Double Churches Road,

for a variance to increase the number of ground signs from 1 (which is allowed)

to 2 (as requested). The property is zoned A-O.



In his statement and in response to questions from the Board Members, Mr.

Walker gave the following information: They are requesting a 2nd sign. They

have no I.D. on their building. They are located 420 feet from the road. They

have very narrow frontage. The sign is not visible from the road because of

the size and the distance from the road. They share a driveway with the church

next door. They want to identify themselves as Easter Seals.

Case No. 02-V88?-Tabled.



Harold Kendrick, 6332 Parker Drive, presented the appeal for a variance to

increase the maximum height requirement from 14 feet to 15 feet, on a

building. The property is zoned R-1A.



In his statement and in response to questions from the Board Members, Mr.

Kendrick gave the following information: This is an existing building that was

put up by Home Depot. The building is over the height requirement 1 foot. The

drawings showed the building was more than 15 feet.



There was a letter of opposition from concerned neighbors that did not give

their names. The concerns were the appearance of the structure, the height and

the structure being fastened down on a permanent foundation.



Mr. Fox made a motion, which was seconded by Mr. Edwards, to table this appeal

because they need the accurate measurements of the building. Motion carried by

the affirmative vote of the three Board Members present for this meeting.



Case No. 02-V89?-Granted.



Lesley Steen, 7449 Fortson Road and James Wald presented the appeal for a

variance to reduce the corner side yard setback requirement from 30 feet to 3

feet, in order to make an addition, 24? x 28?, a carport, to a single family

residence. The property is zoned R-1.



In their statements and in response to questions from the Board Members, Mr.

Steen and Mr. Wald gave the following information: Mr. Steen would like to add

a carport to his home. The carport will be over an existing slab. The water

will go to the city drain.

William Griffin, 7209 Affirm Lane, presented the appeal for a variance to

reduce the side yard setback requirement from 8 feet to 9 inches, in order to

make an addition, a carport, 18? x 30?, to a single family residence. The

property is zoned R-2.



In his statement and in response to questions from the Board Members, Mr.

Griffin gave the following information: He would like to build a two car

carport. It will be over an existing slab. It will have a gable roof. The

same materials will be used to match the house. There is 9 inches from the

edge of the slab to the property line. The roof is hanging over slightly pass

the slab, but will not go to the property line.



There was no opposition present to this appeal.



Mr. Edwards made a motion, which was seconded by Mr. Fox, to grant this appeal

with the stipulation that the overhang can be no closer than 9 inches to the

property line. Motion carried by the affirmative vote of the three Board

Members present for this meeting.



Case No. 02-V91?-Denied.



John C. Chappelle, 756 Rudgate Road presented the appeal for a variance to

increase the maximum height requirement from 14 feet to 19 feet, to an

accessory structure. The property is zoned R-1A.



In his statement and in response to questions from the Board Members, Mr.

Chappelle gave the following information: He would like to build a 2 car

garage with a gambrel roof that will allow him to have a storage area in the

upper portion. The lower portion will be used for a wood working

shop.



When the Chairman asked for opposition, Floyd Mitchell and Chris Spence came

forward. They stated the accessory structure was too tall to fit into the

neighborhood scheme.

because a hardship was not shown. There was opposition to this appeal. There

Case No. 02-V92?-Granted.



Gail Aderhold, Action Buildings, presented the appeal of Homer Harrison, 2721

Marion Street, from a Decision of the Building Official that an accessory

Coordinator for Inspections and Code Enforcement Division came forward. She

stated, In August of 1999 Council Enacted a new mobile home park ordinance.

All parks were to be in compliance with this ordinance by October 2000. I met

with Mr. Dudley in January 2000 to go over deficiencies that he had there at

Orchard Grove Mobile Home Park on South Lumpkin Road. He did not come into

compliance. He was cited to court in April 3, 2002. I will remind you that he

was to be in compliance by October 2000. I have worked with him all of this

time. We gave

park. He told me that he would have the park in compliance by January 2002, he

did not. He was cited to court on April 3, 2002. He was fined for one of his

continuance by the judge until May 6. At that time, he had done a small

portion of the road to bring it into compliance and he indicated to the court

at that time that he would do the rest of the road like that. He was found in

non-compliance by the court and fined for his failure to be in compliance. He

should be required to do what the ordinance requires and that he should not be

given any sort of leniency at all. All other parks have either come into

compliance, been to court or they have closed down. He will argue that his

road surface is adequate. It does not meet the ordinance. He has met with

Richard Smith, the Councilor. Who told him that it did not meet code. He has

met with Richard Bishop, assistant city manager and Bill Duck and myself at the

same time and all of us told him that it did not meet the ordinance. The court

has ruled that it does not meet the ordinance. I?m asking you to deny it.
