AN ORDINANCE

An Ordinance amending the Zoning Atlas of the Consolidated Government
of Columbus, Georgia; this amendment changes certain boundaries of a district
located at 6801 Warm Springs Road (north of Flat Rock Creek), from A-1
(Agricultural) District to R-1 (Low Density Residential) District.
THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY ORDAINS:
That the Zoning Atlas on file with the Planning Division of the
Department of Community and Economic Development be, and the same is hereby
amended by changing the following described property from A-1 (Agricultural)
District to R-1 (Low Density Residential) District:
Commencing at a point formed by the intersection of the west
right-of-way line of Pierce Chapel Road with the northwesterly right-of-way
line of Warm Springs Road and running thence in a southwesterly direction along
the northwesterly right-of-way line of Warm Springs Road a distance of 2216.78
feet to an iron pin; thence running north 329.27 feet to the centerline of Flat
Rock Creek which marks the point of beginning; thence running north 1224.29
feet to an iron pin; thence running east 450.37 feet; thence running south
269.66 feet; thence running east 686.68 feet; thence running west 1763.56 feet
along the centerline of Flat Rock Creek to the point of beginning.
The above-described property is being rezoned with the following condition:
1. No access shall be permitted onto Springbrook Court.
2. All lots bordering the southernmost property of David Ragland shall be 125
feet wide at the building line.
3. The developer states that restrictive covenants will apply to the property
being rezoned. Such restrictive covenants shall require property owners and
their successors adjacent to Flat Rock Creek to preserve the creek and creek
banks in their natural state and, at a minimum, shall require compliance with
all provisions of Chapter 17C of the Columbus Code (Soil Erosion and
Sedimentation Control Ordinance) and applicable state law as now or hereafter
amended.
4. Two natural, undisturbed 25-foot buffers shall be provided as shown drawn on
the attached plat of Hobbs, Smith & Assoc., Inc. dated March 8, 2002. One
25-foot buffer shall be required along the western boundary of the Ragland
property and an additional 25-foot buffer shall be required along the eastern
boundary of Springbrook Crossing Subdivision for a distance of 512 feet as
measured from the northwest corner of the property subject to rezoning.
