The Regular Meeting of the Board of Zoning Appeals was held Wednesday, May 7,
2003 at 2:00 P.M., on the 1st Floor of the Government Center Annex, 420-10th
Street. Members present were:

CASES TABLED FROM THE APRIL 2nd MEETING.
Case No. 03-V50--Granted.
Wade Branch, 5425 Cranston Drive, presented his appeal for a variance to reduce
the side yard setback requirement from 8 feet to 5 feet, in order to make an
addition, 8? x 12?, a carport, to a single family residence. The property is
zoned R-2.
In his statement and in response to questions from the Board Members, Mr.
Branch gave the following information: He would like to build a carport over
an existing concrete slab. The materials used will match the house. The water
will flow to the front and rear.
There was no opposition presented to this appeal.
Mr. Fox made a motion, which was seconded by Mr. Edwards, to grant this
appeal because the addition will be over an existing slab and the same
materials will be used to match the house. Motion carried by the affirmative
vote of the four Board Members present for this meeting.

Case No. 03-V53--Denied.
Duk Soon Duncan, 5736 Veterans Parkway and Phil Batastini presented the appeal
for a variance to reduce the required number of off-street parking spaces from
80 to 65, in order to make an addition to an existing restaurant. The property
is zoned C-2.
The following comments were made:
Mrs. Braxton: This is a carry over from last month and I think where we left
it we had two people in opposition that were your adjacent neighbors last
time. We asked you to get with them and get with the neighbor, Southtrust,
across the street from you. Give us some feedback on whether you had written
permission or anything, what they felt about this case and if you could work
something out with your neighbors. We did receive a letter from the Jordan
Company who is in opposition to this request. They say the shortage of parking
for the Sport Page was already causing overflow parking onto the contiguous
space at Landmark Associates before Sport?s Page enclosed additional interior
space for customers. They have received calls from tenants at Landmark
Associates complaining of vehicles in the parking lot at night. Several
tenants have made complaints to the Police Department regarding the parking,
loud noises, beer bottles and Sports Page patrons in the Landmark Associates
parking lot.
Ms. Duncan: The last time I was at the Board Meeting Mr. Jack Key of Kennon,
Parker, Duncan and Key Realtors was in opposition because he didn?t know what
it was. Mr. Duncan and I discussed the matter and he is not in opposition
now. I do not have a problem with Landmark, I would like to talk with them. I
do not have a problem with loud noise at the Sports Page. When I first opened
up the business, someone did call the Police because it was the grand opening
and that was when it was noisy. It was approximately 10:00 p.m. and most of
the places are closed.
Mr. Batastini: Originally when the C.P.A. firm opened up behind the Sports
Page there was not a fence up, Sports Page put up a fence to keep people from
parking over there and walking through the hedges. The only time I was told by
them that they had a little aggravation with the Sports Page is during tax
season when they work late at night, other than that they do not have a
problem. I talked to another tenant that rents from the Jordan Company and he
said after 5:00 p.m. the parking lot is empty and as long as it was kept clean,
he didn?t have a problem with it. He couldn?t give permission because he is a
tenant.

The whole part on getting a written statement from any owner is they sign
themselves up for liability if something should happen and they do not want to
be held liable.
Billy Edwards: The little wing off the building that used to be the drive-in
teller originally, didn?t you have parking there.
Ms. Duncan: No.
Mr. Fox: I thought when you got your original permit in your previous request
to have a variance for the parking that you discovered by re-submitting?when
you were doing the renovations for your permit the site plan submitted had
shown, that is part of what the issue here is.
Ms. Duncan: In the front area that had 3 extra parking spaces, there wasn?t
parking in the drive thru.
Mrs. Braxton: I did speak with Jack Key and he stated that Ms. Duncan did talk
to him and she asked him not to politic against her. He just wants Ms. Duncan
to abide by the law and the law is you must have so many parking spaces. They
asked Danny Cargill, Inspections and Codes, to pull what happened when you got
your license originally and all of the Board Members received copies. In the
letter that came to you, it said that David Cummons brought a revised parking
plan the day before the meeting and Inspections and Codes did not have an
opportunity to adequately review the parking plan before the meeting. It
appeared it would provide at least the minimum parking spaces required. Mr.
Phillips who used to be the Chairperson for the Board of Zoning Appeals wanted
to go on record as saying if the revised site plan did not provide the minimum
parking spaces for that use the Board would not approve a parking variance.
There were many people who opposed this appeal. We also received the minutes
of that meeting that mention Larry Phillips was speaking for himself and on
behalf of the Board expressed that they would not approve a parking variance
even if it was short just one space. Mr. James Billingsley seconded that
motion. That is two previous members of this committee. This is what was told
to you back in September 1, 1999, when I believe originally you were thinking
of filling this in. The opposition got to be so great that you revised the
site plan to settle on that. I see this as being a pretty concrete thing that
was put into place of putting you on notice, there was enough opposition around
here, it was short parking. There was not any inclination to allow this to be
an addition. Over time you did a little at the time and a little at the time
and it ended up being finished in. I don?t know how

you did that, obviously without a permit. I don?t know why the City didn?t
catch it, somehow they caught it now. I think this is fairly good evidence of
the fact that this was discussed prior to you opening the Sports Page and it
was the City and the Board?s point that there would be no variances for parking
given. Mr. Batastini: I don?t think it should have been discussed during the
zoning appeals meeting because it was handled Tuesday at the Council Meeting,
they met all of the requirements.
Danny Cargill: Because a variance was filed with this Board, they had to act
upon that application.
Mr. Batastini: Even though it was qualified.
Mr. Cargill: Yes sir.
Mr. Fox: What are you talking about the Council?
Mr. Batastini: On Tuesday (1999) they met the requirements prior to the
meeting on Wednesday. David Cummons didn?t come down here on one side or the
other, he didn?t have a need to be here. I think if he would have known Mr.
Phillips was going to make comments like that at that particular time someone
would have been there on Sports Page behalf. After thirteen years of dealing
with people, I try to keep my comments to myself, I don?t make it public. If I
don?t like it, I would just vote no.
Ms. Duncan: I had a talk with Jack Key at the time and he didn?t want me to be
there in the very beginning. I think if no one was going to buy the CB&T
building he was going to buy it and when I bought the building it hurt his
feelings.
Ms. Braxton: Do you acknowledge that you get a tremendous amount of overflow
in your peak times that go into his parking lot.
Ms. Duncan: No. Right before the business was opened I talked to Kelsey
Kennon and he said not to worry about it, after 9:00 we all are going to leave
anyway and you can use my parking lot. So I did. Then cars were being towed
away, he told me Jack Key is a junior partner and he doesn?t like it so why
don?t you start parking across the street because that is my building and I am
planning on selling it. I told him O.K. and I have been doing that. I talked
to Mr. Key two weeks ago and he said he is not trying to hurt the business and
he is not going to protest it.
Mr. Cargill: In 1999 Ms. Duncan filed a variance to reduce the parking spaces
from 62 to 48 because they were going to enclose the area. Someone re-drew a
site plan and said because of the size of the building they have 62 parking
spaces and this was done on Tuesday the day before the Board of Zoning Appeals
meeting on Wednesday. That is why it shows parking underneath.

Mr. King made a motion, which was seconded by Mr. Edwards, to deny this
application because the original building was built to support only 62 parking
spaces, the addition was made without proper permitting from the City which was
obviously an oversight on the owners part, however the parking lot is too small
to support the number of square feet in the building and the occupants there,
there was opposition and a hardship was not shown. Ms. Duncan has other
options. Motion carried by the affirmative vote of the four Board Members
present for this meeting.
Case No. 03-HO72--Denied.
There was no one present to present the application of Tara Whitaker, 953
Rosewood Drive, for a Certificate of Occupancy for a Home Occupation for an
office only for selling gift/novelty items and jewelry (will be sold at flea
markets), Tara Whitaker. The property is zoned R-1A.
There was no opposition to this application.
Mr. Fox made a motion, which was seconded by Mr. Edwards, to deny this
application because there was no one present for two consecutive meetings.
Motion carried by the affirmative vote of the four Board Members present for
this meeting.

VARIANCES.
Case No. 03-V56--Granted.
Ted Freeman presented the appeal of Harco Properties, LLC, 6168 Warner Road,
for a variance to reduce the lot width requirement from 75 feet to 25 feet, in
order to replat a lot, to erect a single family residence. The property is
zoned R-1A.
In his statement and in response to questions from the Board Members, Mr.
Freeman gave the following information: This is a flag lot that has 25 feet of
frontage. They would like to divide the lot in order to build a house that
would be approximately 80 feet from the road. The width is wide enough for the
house. There is an existing house on the lot and they would like to put a
fence around it.

There was no opposition presented to this appeal.
Planning recommends approval of this request.
Mr. King made a motion, which was seconded by Mr. Edwards, to grant
this appeal because this is an odd shaped lot and there was no opposition to
this appeal. Planning recommends approval of this request. Motion carried by
the affirmative vote of the four Board Members present for this meeting.
Case No. 03-V57--Granted.
Gifford C. Anthony, 6079 Pierce Chapel Road and Joe Alexander, presented the
appeal from a Decision of the Building Official that an accessory structure (a
barn) is not allowed in the front yard and may not exceed 14 feet in height, 20
feet shown. The property is zoned A-1.
In their statements and in response to questions from the Board Members, Mr.
Anthony and Mr. Alexander gave the following information: Mr. Anthony would
like to build a horse barn in the front yard because this is the logical place
to put the barn and because of the topography. In the back yard there is a
steep drop off and a lake. One of the neighbors has a barn in the back of
their house and does not oppose this request. The barn will be shared with the
next door neighbor, who is a family member.
There was no opposition presented to this appeal.
Mr. Fox made a motion, which was seconded by Mr. Edwards, to grant this
appeal, even though the Building Official was correct, because this is a large
tract of land and this barn will also provide utility to an adjacent property.
The barn will exceed the 14 feet height requirement. This is the most logical
place for the barn because of the topography. Motion carried by the
affirmative vote of the four Board Members present for this meeting.

Case No. 03-V58--Granted.
Curtis Weeks, Weeks Construction Company, presented the appeal of Diane Webb,
2725 Kingsridge Drive, for a variance to reduce the side yard setback
requirement from 8 feet to 6 feet, in order to make an addition, a carport, 14?
x 22?, to a single family residence. The property is zoned R-2.
In his statement and in response to questions from the Board Members,
Mr. Weeks gave the following information: Ms. Webb would like to add a carport
to her home. The carport will have a gable roof and the water will go to the
front and rear. There is an existing slab.
There was no opposition presented to this appeal.
Mr. Edwards made a motion, which was seconded by Mr. Fox, to grant this
appeal because the carport will be over an existing concrete pad and the water
will not go to the neighbor?s home. Motion carried by the affirmative vote of
the four Board Members present for this meeting.
Case No. 03-V59?-Granted.
Rob Elliot, Phillips Construction, presented the appeal of
Dr. Jack Sherrer, 7301 Northlake Drive, for a variance to reduce
the rear yard setback requirement from 40 feet to 28 feet, in
order to erect a doctor?s office, 73? x 93?. The property is
zoned A-O.
In his statement and in response to questions from the Board Members, Mr.
Elliot gave the following information: Phillips Construction has constructed
three buildings in the Woodruff development office complex and have under
contract one more building. The plans and site lay out have been approved by
the Woodruff Development Company. They have descending topography where the
land falls where there is a natural lake. They have continued the water
drainage the same way. The drainage would be provided on the lot behind this
lot by an engineer to carry the water around the building and go to the lake.
They are charged with the responsibility of making sure this complex is
compatible

with the other buildings. The building and the parking couldn?t be moved
forward because at the entrance there is a sign and magnolia tree. If the
building was moved up, the grade would have been increased
tremendously.

Mr. King made a motion, which was seconded by Mr. Edwards, to grant this appeal
because of the topography and the aesthetics of the entire complex. Motion
carried by the affirmative vote of the four Board Members present for this
meeting.
Case No. 03-V60?-Granted.
James McVay, Leary & Brown, Inc., 8540 Midland Road, presented the appeal from
a Decision of the Building Official that an accessory structure (garage/office)
may not exceed 14 feet in height, 17 feet shown. The property is zoned A-1.
In his statement and in response to questions from the Board Members, Mr. McVay
gave the following information: They have a contract with a gentlemen to erect
a single family residence and an accessory structure on a 3 acre lot. The
house will be approximately 40 feet from the nearest property line. They have
maintained a natural buffer on the property line. The requirements for an
accessory structure require the same roof pitch as the house which is 8 on 12
and due to the configuration of the building the height of the roof exceeded
what the ordinance allowed which is 17 feet. The color scheme, materials and
shingles will match the house.
There was no opposition presented to this appeal.
Mr. Fox made a motion, which was seconded by Mr. Edwards, to grant this appeal
to exceed the 14 feet height requirement to 17 feet. The accessory structure
will be compatible with the house. Motion carried by the affirmative vote of

Case No. 03-V61?-Granted.
David Serrato, 1030 Broadway and Marlene Sullis presented the appeal for a
variance to reduce the lot width requirement from 40 feet to 38.60 feet, in
order to combine two existing lots of record into one non-conforming lot. The
property is zoned CRD. Contingent upon Planning approval.
In their statements and in response to questions from the Board Members, Mr.
Serrato and Ms. Sullis gave the following information: This appears to be a
single building that someone put a wall in the center and split it into two
halves. Mr. Serrato and Ms. Sullis are partners and they would like to put a
Mexican restaurant in the building. They need to combine the two sides to get
the footage they need to make this an effective space.
There was no opposition presented to this appeal.
Planning recommends approval of this request.
Mr. Edwards made a motion, which was seconded by Mr. King, to grant this appeal
to combine two existing lots. These are existing non-conforming lots and this
is a logical use of the building, typical of the area. Planning did recommend
approval of this request. Motion carried by the affirmative vote of the four
Board Members present for this meeting.
Case No. 03-V62?-Granted.
Larry Wayneright presented the appeal of Columbus Regional Health Care Systems,
7001 River Road, for a variance to allow 2 exempt signs and to increase the
square footage from 16 to 100. The property is zoned A-O.
In his statement and in response to questions from the Board Members,
Mr. Wayneright gave the following information: They have two parcels of land
that are North on River Road that total approximately 40 acres with 2100 feet
of frontage. They are asking to put two temporary construction signs on those
sites. Each sign will be 10? x 10?. The signs will be up during the
construction period and once the buildings open, the signs will be taken down.
The signs will be up approximately 18 months.

Mr. Fox made a motion, which was seconded by Mr. Edwards, to grant this appeal
to allow two temporary exempt signs that are project notification signs. The
signs will be removed after the construction is completed in 18 months. Motion

meeting.
Case No. 03-V63?-Granted.
Julie Smith presented the appeal of B.R. Johnson, 1803 Park Drive, for a
variance to reduce the side yard setback requirement from 8 feet to 4 feet, in
order to extend a bedroom and a bathroom, 14? 9? x 21?, to a single family
residence. The property is zoned R-1A.
In her statement and in response to questions from the Board Members, Ms. Smith
gave the following information: Mr. Johnson would like to extend a bedroom and
a bathroom. They presented their case to BHAR and received approval. The
neighbors next door do not oppose this request. The materials used will match
the house.

Case No. 03-V64?-Granted.
William Edwards, 1333 Eberhart Avenue, presented his appeal from a Decision of
the Building Official that an accessory structure may not exceed 14 feet in
height, 15 feet shown. The property is zoned R-1A(H).
In his statement and in response to questions from the Board Members, Mr.
Edwards gave the following information: He would like to build a garage. The
garage will match his house and the other houses in the immediate vicinity.
The garages in the vicinity have a higher pitch roof than usual. The garage
will have the same roof pitch as the house. He does have approval from
BHAR.

Mr. Edwards made a motion, which was seconded by Mr. Fox, to grant this appeal

There was no one present to present the application of Joni Biancardi, 3 Leah
Court, for a Certificate of Occupancy for a Home Occupation for an office only
for massage therapy, ?Hands On?. The property is zoned R-1A.
When the Chairman asked for opposition Brent Grimes, Ed McClendon, Ida St. John
and Gregory Floyd came forward. They oppose this Home Occupation because Ms.
Biancardi already has a lot of traffic at her home. They think that she
already has started her business. They do not want an increase in traffic.
They stated that Ms. Biancardi was at the Board of Zoning Appeals meeting, but
left approximately 20 minutes after the meeting started.

application because several neighbors were in opposition and they do not want
