An Ordinance amending the Zoning Atlas of the Consolidated Government

of Columbus, Georgia; this amendment changes certain boundaries of a district

located at 1150, 1156, and 1166 Double Churches Road, from R-1 (Low Density

Residential) District to R-2 (Low Density Residential) District.



THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY ORDAINS:



That the Zoning Atlas on file with the Planning Division of the

Department of Community and Economic Development be, and the same is hereby

amended by changing the following described property from R-1 (Low Density

Residential) District to R-2 (Low Density Residential) District:



All those lots, tracts, or parcels of land situate, lying and being in

Columbus, Muscogee County, Georgia, and being known and distinguished as REPLAT

OF LAND LOTS 62, 79, & 80, 8TH DISTRICT, Columbus, Muscogee County, Georgia,

according to a plat dated May 11, 2001 by Moon, Meeks, Mason, and Vinson, Inc.

and recorded in Plat Book 144, Folio 1 in the Office of the Clerk of Superior

Court, Muscogee County, Georgia.



The above-described property is being rezoned with the following conditions:



1. Based upon a drawing presented to Council without an actual survey, the

existing lake and its major characteristics shall not be reduced to less than

two and one-half (2?) acres. If an actual survey shows that the lake area is

less than two and one- half (2?) acres, then the existing lake and its major

characteristics shall not be reduced to less than two (2) acres.

2. A minimum of one (1) acre shall be preserved as green space.

3. The required green space shall be located west of the existing lake.

4. A 40-foot building setback shall be required for the side yards adjacent to

the right-of-way of Double Churches Road.

5. A ten-foot buffer shall be planted with trees as required under option

two of Category A of the Buffer Ordinance on the eastern border of the

property subject to rezoning, with the exception of the northeast property

line of the property subject to rezoning which property line runs south from

Double Churches Road for approximately 168.89 feet to an iron stake as shown on

the plat by Moon, Meeks, Mason & Vinson dated May 11, 2001 and recorded in

Plat Book 144, Folio 1. Provided, however, if any gravesites are discovered

along said property line on the property subject to rezoning, then the

ten-foot buffer requirement shall apply to said gravesites. The developer

shall be required to install a privacy fence with minimum height of six feet

along the eastern property line of the property subject to rezoning, including

the property line adjacent to existing cemetery lots.

6. The developer shall stabilize and protect the adjacent cemetery lots so as

to prevent erosion of said lots.

7. The developer shall plant at least five large canopy trees as defined in the

Tree Preservation and Replacement Ordinance to the east of the entrance to the

property subject to rezoning from Double Churches Road and such large canopy

trees shall be located within sixty (60) feet of the cemetery property line.

8. The developer shall adopt and record restrictive covenants which establish,

protect and maintain the ten-foot planted buffer required by Condition No. 5,

with the exception of the northeast property line of the property subject to

rezoning which property line runs south from Double Churches Road for

approximately 168.89 feet to an iron stake as shown on the plat by Moon,

Meeks, Mason & Vinson dated May 11, 2001 and recorded in Plat Book 144, Folio

1. Provided, however, if any gravesites are discovered along said property

line on the property subject to rezoning, then the ten-foot buffer

requirement shall apply to said gravesites and this proviso shall be noted in

said restrictive covenants.
