A RESOLUTION

No.

A Resolution opposing the statutory waiver of county governmental immunity by

the Georgia General Assembly with respect to motor vehicle accidents.

--------------

WHEREAS, proposed legislation at the 2002 Session of the Georgia General

Assembly would waive by statute county governmental immunity with respect to

motor vehicle accidents;

WHEREAS, proposed HB 669 would waive county governmental immunity up to

"$500,000 for one person in any one occurrence, $1 million involving a loss

with two or more persons in any one occurrence, and to the extent of $250,000

for loss involving injury to or destruction of property per occurrence."

WHEREAS, this Council opposes such legislation because the Consolidated

Government manages an in-house risk management program and because of the

expense involved in purchasing motor vehicle liability insurance to cover a

large fleet of vehicles such as that owned by the Consolidated Government.

NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA HEREBY RESOLVES:

We hereby request that the local delegation to the Georgia General Assembly

oppose any proposed legislation which would waive by statute county

governmental immunity with respect to motor vehicle accidents. Let a copy of

this resolution be forwarded to each member of the local legislative delegation

to the Georgia General Assembly.
