An Ordinance amending the Zoning Atlas of the Consolidated Government

of Columbus, Georgia; this amendment changes certain boundaries of a district

located at 8271 and 8201 Midland Road; and 8111, 8091, and 8101 Old Pope Road,

from A-1 (Agricultural) District to R-1A (Low Density Residential) District.



THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY ORDAINS:



That the Zoning Atlas on file with the Planning Division of the

Department of Community and Economic Development be, and the same is hereby

amended by changing the following described property from A-1 (Agricultural)

District to R-1A (Low Density Residential) District:



Part of Land Lot 27, 18th District, Columbus, Muscogee County, Georgia, and

being more particularly described as follows:



Beginning at an iron pin at the intersection of the southwesterly right-of-way

line of Midland Road with the south line of Land Lot 27, 18th District and run

thence south 86 degrees 41 minutes west along the south line of Land Lot 27,

18th District a distance of 2339.52 feet to an iron pin; thence run north 03

degrees 19 minutes west a distance of 700.00 feet to an iron pin; thence run

north 86 degrees 41 minutes east a distance of 1728.00 feet to an iron pin on

the southwesterly right-of-way line of Midland Road; thence run along the

southwesterly right-of-way line of Midland Road along a radius to the right of

925.37 feet an arc distance of 97.71 feet to an iron pin; thence continue along

the southwesterly right-of-way line of Midland Road south 44 degrees 02 minutes

east a distance of 761.14 feet to an iron pin; thence continue along the

southwesterly right-of-way line of Midland Road along a radius to the left of

1462.69 feet an arc distance of 70.81 feet to an iron pin at the point of

beginning.



And



All that tract or parcel of land lying and being in Columbus, Muscogee County,

Georgia, and being Part of Land Lots 5 and 6 in the 18th Land District, and

being more particularly described as follows:



Commencing at an iron pin at the northwest corner of Land Lot 6, 18th District,

and run thence north 86 degrees 00 minutes 30 seconds east a distance of

2507.60 feet to an iron pin; thence run south 04 degrees 01 minute 30 seconds

east a distance of 404.03 feet to an iron pin; thence run north 85 degrees 58

minutes 30 seconds east a distance of 509.12 feet to an iron pin on the west

margin of a 60 foot access easement; thence run in a southerly direction along

the west margin of said 60 foot access easement along a radius to the left of

442.12 feet an arc distance of 60.66 feet to an iron pin at the point of

beginning; thence run in a southerly direction along the west margin of said 60

foot access easement along a radius to the left of 442.12 feet an arc distance

of 72.02 feet to an iron pin; thence run south 09 degrees 08 minutes 20 seconds

east along the west margin of said 60 foot access easement a distance of 329.36

feet to an iron pin; thence run south 85 degrees 58 minutes 30 seconds west a

distance of 1060 feet to an iron pin; thence run north 04 degrees 01 minutes 30

seconds west a distance of 400.00 feet to an iron pin; thence run north 85

degrees 58 minutes 30 seconds east a distance of 1030.01 feet to an iron pin at

the point of beginning.

Commencing at an iron pin at the northwest corner of Land Lot 6, 18th District,

and run thence north 86 degrees 00 minutes 30 seconds east a distance of

2507.60 feet to an iron pin at the point of beginning; thence run north 86

degrees 00 minutes 30 seconds east a distance of 422.95 feet to an iron pin on

the southwesterly right of way line of Midland Road; thence run in a

southeasterly direction along the southwesterly right of way line of Midland

Road along a radius to the left of 1467.22 feet an arc distance of 269.02 feet

to an iron pin on the westerly margin of a 60 foot access easement; thence run

south 30 degrees 51 minutes 40 seconds west a distance of 80.30 feet to an iron

pin; thence run in a southwesterly direction along the westerly margin of a 60

foot access easement along a radius to the left of 442.12 feet an arc distance

of 175.98 feet to an iron pin; thence run south 85 degrees 58 minutes 30

seconds west a distance of 509.12 feet to an iron pin; thence run north 04

degrees 01 minute 30 seconds west a distance of 404.03 feet to an iron pin at

the point of beginning.

All those lots, tracts or parcels of land situate, lying and being in Columbus,

Muscogee County, Georgia, and being known and designated as ?Survey of Part of

Land Lots 5 and 6, 18th District and Part of Land Lots 161 and 192, 9th

District, Columbus, Muscogee County, Georgia?, prepared by Hobbs Smith &

Associates, under date of November 29, 1993, and recorded in Plat Book 94,

Folio 59, of the records in the Office of the Clerk of the Superior Court,

Muscogee County, Georgia, to which plat reference is made for a more complete

and accurate description of the property herein conveyed.





The above-described property is rezoned subject to the following conditions:



1. The developer is restricted to a maximum of 129 lots as

depicted on the attached preliminary plat by Hobbs, Smith and Associates

dated November 24, 2004 and to all buffers, easements, street frontages,

building setbacks and fencing which shall run parallel to the interior line of

the 40-foot buffer shown on said plat and to all other easements of record.

The utility easement for lots numbered 122 through 126 on said plat shall be

removed. Said plat is hereby made a part of this ordinance and is specifically

incorporated herein by reference.



2. Those 23 lots numbered 1, 6, 7, 17, 18, 19, 25, 48, 49, 65, 70, 89,

90, 91, 92, 93, 104, 117, 118, 119, 120, 121, and 129 on said plat shall

remain zoned A-1, shall be permitted to use R1-A front and side setbacks, and

shall be subject to a 40-foot rear setback.



3. The construction entrance shall be located on Midland Road as

determined by the City Traffic Engineer. All driveway access to lots shown on

said plat shall be internal from the new streets shown on said plat.
