A RESOLUTION DECLARING THAT THERE IS A NEED AND NECESSITY TO

IMMEDIATELY ACQUIRE TITLE AND EASEMENTS TO LANDS UNDER THE PROVISION OF THE

OFFICIAL CODE OF GEORGIA ANNOTATED, AUTHORIZING THE MAYOR TO ORDER THE

ACQUISITION OF SAID LANDS FOR COUNTY ROAD AND/OR MUNICIPAL STREET PURPOSES, AND

AUTHORIZING THE FILING OF A DECLARATION OF TAKING BY THE CITY ATTORNEY OR HIS

REPRESENTATIVES FOR THE ACQUISITION OF SAID LANDS UNDER THE AUTHORITY OF THE

OFFICIAL CODE OF GEORGIA ANNOTATED, SECTION 32-3-1, ET. SEQ.





WHEREAS, it is hereby determined that the circumstances in connection

with acquiring right-of-way for the St. Mary?s Road Widening Project, Project

No. STP-8038(7), P.I. No. 350790, are such that it is necessary to immediately

acquire the fee simple title, state, interest, and/or easements in the

following described property, to-wit:

REVISION DATE: October 05, 2004



All that tract or parcel of land lying and being in Land Lot 109 of the

Congressional District 3 Land District and/or Coweta Reserve District of

Muscogee County, Georgia, being more particularly described as follows:



Beginning at a point 28.35 feet left of and opposite Station 115+69.54 on

the construction centerline of ST. MARY'S ROAD on Georgia Highway Project No.

STP-8038(7) ; running thence N 44?45'19" E a distance of 25.98 feet to a point

54.33 feet left of and opposite station 115+69.61 on said construction

centerline laid out for ST MARY'S; thence S 51?55'44" E a distance of 14.88

feet to a point 56.00 feet left of and opposite station 115+84.53 on said

construction centerline laid out for ST MARY'S; thence southeasterly 50.506

feet along the arc of a curve (said curve having a radius of 5944.000 feet and

a chord distance of 50.506 feet on a bearing of S 45?47'12" E) to the point

56.00 feet left of and opposite station 116+35.51 on said construction

centerline laid out for ST MARY'S; thence N 77?39'23" E a distance of 30.65

feet to a point 81.47 feet left of and opposite station 116+52.74 on said

construction centerline laid out for ST MARY'S; thence S 43?29'35" W a distance

of 53.11 feet to a point 28.36 feet left of and opposite station 116+53.03 on

said construction centerline laid out for ST MARY'S; thence northwesterly

83.101 feet along the arc of a curve (said curve having a radius of 5699.650

feet and a chord distance of 83.100 feet on a bearing of N 45?48'35" W) back to

the point of beginning. Containing 0.057 acres more or less.



Also to be acquired is a permanent easement to construct and maintain any

required slopes and utilities within the permanent easement area in regard to

Parcel 19 shown colored orange on a plat filed in the Office of the Highway

Coordinator of Columbus, Georgia.



Also to be acquired is a temporary driveway easement for the construction of a

driveway within the temporary driveway easement area in regard to Parcel 19

shown colored pink on a plat filed in the Office of the Highway Coordinator of

Columbus, Georgia, and which temporary driveway easement will expire upon

completion and final acceptance of said project by the Georgia Department of

Transportation.



NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS

FOLLOWS:



1.



That there is a necessity for the immediate acquisition of said

property under the provisions of the Official Code of Georgia Annotated

?32-3-1, et. seq.

2.



That the Mayor of Columbus, Georgia be, and he hereby is, authorized to

issue such orders and file such papers in the courts and enter into such

agreements as he deems necessary for the immediate acquisition of said property

by condemnation under the provisions of said Act.



3.

That the immediate acquisition of such land and property interests is

for county roads, municipal streets or public highway purposes.



4.



That the Mayor, City Manager and City Attorney, or their

representatives, are hereby authorized to take any and all lawful actions that

they may deem needful, necessary, advisable, or proper for the immediate

acquisition of said property pursuant to and in accordance with the provisions

of the Official Code of Georgia Annotated ?32-3-1, et. seq.



5.



That in accordance with an investigation and report made to the Council

of Columbus, Georgia by competent land appraiser, the estimated value as just

and adequate compensation to be paid for the acquisition is hereby determined

and approved and the sums are authorized to be paid into Court the use of the

persons entitled thereto.
