The Regular Meeting of the Board of Zoning Appeals was held Wednesday, July 7,
2004 at 2:00 P.M., on the 1st Floor of the Government Center Annex, 420-10th
Street. Members present were:

Mr. King made a motion, which was seconded by Mr. Lewis, to approve the
Minutes of the Monthly Meeting, which was held on June 2, 2004. Motion carried
unanimously.
CASES TABLED FROM THE JUNE 2nd MEETING.
Case No. 04-V62--Granted.
Aletha Paschal, 1020 Watson Drive, and Buddy Hamier presented the appeal for a
variance to reduce the rear yard setback requirement from 30 feet to 26 feet,
in order to make an addition, 12? x 16?, a den, to a single family residence.
The property is zoned R-1A.
In their statements and in response to questions from the Board Members, Ms.
Paschal and Mr. Hamier gave the following information: She would like to add a
den to her home. The same materials will be used to match the home.
There was no opposition presented to this appeal.
Mr. Fox made a motion, which was seconded by Mr. Edwards,
to grant this appeal because this will be an addition on a corner
lot and similar materials will be used to match the house. Motion

John Zitzelberger, 7444 Mossdale Way, presented his application for a
Certificate of Occupancy for a Home Occupation for an office only for
anesthesia services, Z Anesthesia, P.C. The property is zoned R-2.
In his statement and in response to questions from the Board Members, the
applicant gave the following information: He will be using one room in his
home as an office only. He will have no employees and there will be no
additional traffic in the neighborhood. This will be full time
work.
There was no opposition to this application.
Mr. Fox made a motion, which was seconded by Mr. Edwards, to grant this
application because it does meet the intent of the Home Occupation definition.

There was no one present to present the application of Dwayne Albert McCrary,
8400 Veterans Parkway #511, for a Certificate of Occupancy for a Home
Occupation for an office only for aerial photography and survey exhibition
skydiving, D & M Aerial Services. The property is zoned A-O.
There was no opposition to this application.
Mr. Edwards made a motion, which was seconded by Mr. Lewis, to deny this
application because there was no one present to present the application for two
consecutive meetings. Motion carried unanimously.

Case No. 04-V75--Granted.
Billy Hanson presented the appeal of Fairview Baptist Church, 2913 Reese Road,
for a variance to add a 24 square feet 2nd sign. The property is zoned R-1A.

In his statement and in response to questions from the Board Members,
Mr. Hanson gave the following information: The church has an existing sign on
the property on the far North side of the property down by the sanctuary. They
built a new pre-school center and they are asking for a variance for a 2nd sign
on the south side of the property. (The sign has already been installed)
There was no opposition presented to this appeal.
Mr. Edwards made a motion, which was seconded by Mr. Fox, to grant this
appeal because the hardship being the people wouldn?t know they had the day
care if it wasn?t allowed. The shape of the property that is being developed
is a long continuance set of buildings that will designate which end of the
development is actually where the day care is. Motion carried unanimously.
Case No. 04-V76?-Granted.
Larry Williams, 2716 Vultee Drive and Paul King, presented the appeal from a
Decision of the Building Official that an accessory structure is not allowed in
the side yard. The property is zoned R-2.
In their statements and in response to questions from the Board
Members, Mr. Williams and Mr. King gave the following information: He would
like to put a swimming pool in the side yard because it is the biggest
location. He had an above ground pool that he took down and would like to
replace it with an in-ground pool in the same place.
There was no opposition presented to this appeal.
Mr. Fox made a motion, which was seconded by Mr. Edwards, to grant this
appeal although the Building Official is correct that an accessory structure is
not allowed in the side yard. The swimming pool will be over an existing
slab. It is the only area the pool can be placed. Motion carried unanimously.

Case No. 04-V77?-Granted.
Bitsy Dedwylder, 1808 Park Drive and Steve Cummings, Contractor, presented the
appeal for a variance to reduce the side yard setback requirement from 8 feet
to 5 feet, in order to make an addition, 26? 2? x 29? 2?, a bedroom, bathroom
and laundry room, to a single family residence. The property is zoned R-1A.
In their statements and in response to questions from the Board Members, Ms.
Dedwylder and Mr. Cummings gave the following information: The addition will
be the same material as the house. There will not be a water problem because
gutters will be added.
The Board of Historic And Architectural Review has granted the owner a
Certificate of Appropriateness for this addition. This Certificate is attached
and therefore is considered a part of these minutes.
There was no opposition presented to this appeal.
Mr. Fox made a motion, which was seconded by Mr. Edwards, to grant this appeal
because Ms. Dedwylder has BHAR approval. The materials used will be similar to
the house. The addition will be no closer to the side yard than the existing
garage. Motion carried unanimously.
Case No. 04-V78?-Granted.
Julie Straus, 2201-8 Old River Road and Steve Edmonds, Builder, presented the
appeal from a Decision of the Building Official that an accessory structure is
not allowed in the front yard. The property is zoned A-1.
In their statements and in response to questions from the Board
Members, Mrs. Straus and Mr. Edmonds gave the following information: Their
house is turned 180 degrees North. They would like to build a 22? x 33? garage
and it will be at least 80 feet from the road. Only the back of the garage
will be seen from the road. The same materials will be used to match the
house.

Mr. Edwards made a motion, which was seconded by Mr. Lewis, to grant this
appeal even though the Building Official is correct that an accessory structure
is not allowed in the front yard. The location of the house on the lot causes
the structure to be considered the front. The accessory structure will be
approximately 80 to 100 feet back from the road. Motion carried unanimously.
Case No. 04-V79?-Granted.
Trey Dykes, Dykes Builders, 8772 Heiferhorn Way, presented the appeal from a
Decision of the Building Official that an accessory structure is not allowed in
the side yard. The property is zoned A-1.
In his statement and in response to questions from the Board Members, Mr. Dykes
gave the following information: He would like to put a swimming pool in the
side yard. He can?t put it in the rear yard because it slopes and there is a
sanitary sewer. The swimming pool will have a fence around it.
There was no opposition presented to this appeal.
Mr. Fox made a motion, which was seconded by Mr. Edwards, to grant this
appeal even though the Building Official is correct that an accessory structure
is not allowed in the side yard. The topography of the rear of the lot is
severe enough that the pool needs to be placed on a more flat area which is to
the side of the house. Motion carried unanimously.
Case No. 04-V80?-Granted.
Richard McGuire, Cantrell-McGuire Builders, 1038 Vineville Street, presented
the appeal for a variance to reduce the lot area from 6,000 square feet to
5,600 square feet, in order to erect a duplex. The property is zoned R-3A.
In his statement and in response to questions from the Board Members, Mr.
McGuire gave the following information: He is asking to reduce the minimum lot
area requirement because the lot is not large enough to build a duplex
home.

Mr. Edwards made a motion, which was seconded by Mr. Fox, to grant this appeal
because this size lot it typical of the neighborhood. This is an area where
lots are typically not according to present day zoning sizes, this will allow
usefulness of this lot. Motion carried unanimously.
Case No. 04-V81--Granted.
Robert Wier, 6636 Moon Road, presented his appeal for a variance to increase
the height requirement of an accessory structure from 14 feet to 18 feet. The
property is zoned R-1.
In his statement and in response to questions from the Board Members,
Mr. Wier gave the following information: He would like to build a storage
building for his mother-in-law and himself. Currently they are renting a
storage unit. He would like to build an upper and lower floor (that is why the
height requirement will be higher) instead of putting 2 or 3 buildings in the
back yard. The storage building will be the same color as the house. It will
not be visible because there are a lot of trees.
There was no opposition presented to this appeal.
Mr. Edwards made a motion, which was seconded by Mr. Lewis, to grant
this appeal because the second story of the accessory structure will give more
storage and they would not have to use more than one storage building. It will
be a considerable distance from the road. Motion carried unanimously.
Case No. 04-V82?-Granted.
Steve Fitts, The Fitts Company, presented the appeal of Columbus Bank & Trust,
6401 Whittlesey Boulevard, for a variance to reduce the road frontage from 300
feet to 215 feet, in order to erect a 2nd sign. The property is zoned C-3.
In his statement and in response to questions from the Board Members,
Mr. Fitts gave the following information: The bank wants to add a monument
sign on the back of the property at the main entrance into the bank. The sign
will be 6? 6? x 6? 8?.

Mr. Lewis made a motion, which was seconded by Mr. Edwards, to grant
this appeal to reduce the road frontage from 300 feet to 215 feet to erect a
second sign. Motion carried unanimously.
Case No. 04-V83?-Denied.
Bob Crane, 706 Moore Road Lot 1, presented the appeal for his wife, Elana
Crane, for a variance to reduce the side yard setback requirement from 28 feet
to 15 feet, in order to erect a single family residence. The property is zoned
A-1.
In his statement and in response to questions from the Board Members, Mr. Crane
gave the following information: They are asking to reduce the side yard
setback requirement in order to be able to fit their house 100 to 125 feet back
off the front. They would like to put the house in the center of the lot, but
because of some rocks that may be impossible. They are pushing the house back
because they would like to keep the trees in the front and for privacy. They
own the adjacent lots and eventually they will build them out and have their
home as a model home. Their home will be 5900 square feet heated. He showed
the Board Members a different site plan showing moving a line and showing a
different side yard setback requirement (the house was not on the revised site
plan).
There was no opposition presented to this appeal.
Mr. Fox made a motion, which was seconded by Mr. Edwards, to deny this appeal
because he is replatting his lot and he doesn?t need a variance. The Board
Members don?t know what the true site plan will be, a variance might be granted
for something that doesn?t necessarily have to be done. He didn?t have a site
plan that showed the driveway would fit on the lot and there were no dimensions
at all with a house on the lot. There are other options. Motion carried
unanimously.
Case No. 04-V84--Granted.
Gary Lisle and Gary Gaulett, presented the appeal of Woodruff Company, 6900
Schomburg Road, for a variance to reduce Category B?Option 1, 13 canopy trees
required, 11 shown and 51 understory trees required, 15 shown and 318 shrubs
required, 254 shown. The property is zoned R-4.

In their statements and in response to questions from the Board
Members, Mr. Lisle and Mr. Gaulett gave the following information: They have
an area of this property that adjoins R-2 owned by Georgia Power, 1270 linear
feet, it adjoins the R-4 apartments. The landscape work that they are doing on
the apartments and the club house, they have partial compliance with that
particular area of the buffer ordinance. Since they have drawn this, they have
actually built a third portion of the property under the power line which gives
them further screening in that area. The problem is they own property on both
sides of Georgia Power which requires a buffer on both sides.

Mr. Fox made a motion, which was seconded by Mr. Lewis, to grant this
appeal because they have more than adequately provided for trees as well as
shrubs and they do have the added problem in this particular case they don?t
own the land where the Georgia Power easement is so they don?t really have any
control over how they landscape that particular area. Motion carried
unanimously.
Case No. 04-V85?-Granted.
Robert Teasley, Signs, Inc., presented the appeal of Kendrick High School,
6015 Georgetown Drive, for a variance to increase the size of a sign from 15
square feet to 50 square feet. The property is zoned R-2.
In his statement and in response to questions from the Board Members,
Mr. Teasley gave the following information: Kendrick High School will furnish
the footing and he will furnish the sign. The sign will be a changeable copy
sign. Georgetown Elementary is across the road and they also have a changeable
copy sign, which his company, Signs, Inc., did.
There was no opposition presented to this appeal.
Mr. Edwards made a motion, which was seconded by Mr. Lewis, to grant
this appeal to increase the sign from 15 square feet to 50 square feet.
Several similar requests for schools have been approved in the past. Motion
carried unanimously.

Case No. 04-V86?-Granted.
Russ Batton, 2711 Cora Drive and Ken Chung, Columbus Integrity Building, LLC,
presented the appeal for a variance to reduce the rear yard setback
requirements from 30 feet to 15 feet, from 30 feet to 8 feet and from 30 feet
to 25 feet, in order to make an addition, a carport, bedroom, bathroom, kitchen
and storage room. The property is zoned R-1A.
In their statements and in response to questions from the Board Members, Mr.
Batton and Mr. Chung gave the following information: The house is on a corner
lot. The addition will be on Sections A & B. The carport will be over an
existing slab. The addition will be similar material as the house and it will
be approximately 900 square feet.
There was no opposition presented to this appeal.
Mr. Fox made a motion, which was seconded by Mr. Edwards, to grant this appeal
to approve all three setback requirements. This is a corner lot and not a
uniformed lot. The carport will be over an existing slab. Motion carried
unanimously.

In her statement and in response to questions from the Board Members, Mrs.
Bearden gave the following information: He will be using one room in their
home as an office only. He will have no employees and there will be no
additional traffic in the neighborhood. This will be full time work. The work
will be done in Fort Benning and Baltimore.
There was a letter of opposition from Monika Harrison. She is concerned with
an increase of traffic. In the past, a previous neighbor had visitors who used
her driveway to turn-around, which damaged her driveway.
Mr. Edwards made a motion, which was seconded by Mr. Lewis, to grant this
application because it does meet the intent of the Home Occupation definition.

There was no one present to present the application of Jonathan Cole, 7645

When the Chairperson asked for opposition, Barbara Golden came forward. She
had concerns with traffic and chemicals for the pool maintenance. She thinks
the business is already in operation.

Dozier and Gerald Kent came forward. They have concerns with increase of
