ACQUIRE TITLE TO LANDS UNDER THE PROVISION OF THE OFFICIAL CODE OF GEORGIA
ANNOTATED, AUTHORIZING THE MAYOR TO ORDER THE ACQUISITION OF SAID LANDS FOR
COUNTY ROAD AND/OR MUNICIPAL STREET PURPOSES, AND AUTHORIZING THE FILING OF A
DECLARATION OF TAKING BY THE CITY ATTORNEY OR HIS REPRESENTATIVES FOR THE
ACQUISITION OF SAID LANDS UNDER THE AUTHORITY OF THE OFFICIAL CODE OF GEORGIA

WHEREAS, it is hereby determined that the circumstances in connection with
acquiring rights-of-way for the Georgetown/Amber Drive Road Widening Project
are such that it is necessary to acquire the fee simple title, state or
interest in the following described property, to-wit:
All that tract or parcel of land lying and being in Land Lot 21 of the 9th
District of Muscogee County, Georgia, and being more particularly described as
follows:
COMMENCING at a point marking the easterly Right-of-Way of Amber Drive (60 foot
R/W) with the northerly Right-of-Way of Buena Vista Road, thence along said
existing easterly Right-of-Way of Amber Drive, N 20? 29' 40" W, 44.00 feet to a
point on the easterly existing Right-of-Way of Amber Drive, thence N 1?53'20"
E, 129.48 feet to a point on the easterly existing Right-of-Way of Amber Drive,
thence N 86?04'40" W, 3.70 feet to a point on the easterly existing
Right-of-Way of Amber Drive, thence N 5?43'50" E, 238.24 feet to a point on
the easterly existing Right-of-Way of Amber Drive, thence along an arc for a
distance of 64.43 feet to the left, having a radius of 4614.50 feet, the chord
of which is N 5? 19' 50" E, 64.43 feet to a point on the easterly existing
Right-of-Way of Amber Drive, and being the POINT OF BEGINNING, thence N 4?
18'35" E, 99.99 feet to a point on the easterly existing Right-of-Way of Amber
Drive, thence S 86?27'51" E, 0.92 feet to a point on the easterly proposed
Right-of-Way of Amber Drive, thence along an arc for a distance of 100.00 feet
to the right, having a radius of 5729.58 feet, the chord of which is S 2? 17'
22" W, 100.00 feet to a point on the easterly proposed Right-of-Way of Amber
Drive, thence N 86? 27'03" W, 4.45 feet to a point on the easterly existing
Right-of-Way of Amber Drive, and being the POINT OF BEGINNING.
The above described parcel contains 0.006 acres (283 sq.ft.), and is shown
colored in yellow on a map or plat attached hereto and made a part hereof as
Exhibit ?A?.
Also to be acquired is the right to a temporary construction easement as shown
colored in green on Exhibit ?A? attached hereto and made a part hereof. This
easement expires upon completion of the project.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:
1.
That there is a necessity of acquisition of said property under the provisions
of the Official Code of Georgia Annotated ?32-3-1, et. seq.
2.
That the Mayor of Columbus, Georgia be, and he hereby is, authorized to issue
such orders and file such papers in the courts and enter into such agreements
as he deems necessary for the acquisition of said property and/or property
rights by condemnation under the provisions of said Act.
3.
That the acquisition of such property and/or property rights is for county
roads, municipal streets or public highway purposes.
4.
That the Mayor, City Manager and City Attorney, or their representatives, are
hereby authorized to take any and all lawful actions that they may deem
needful, necessary, advisable, or proper for acquisition of said property
and/or property rights pursuant to and in accordance with the provisions of the
Official Code of Georgia Annotated ?32-3-1, et. seq.
5.
That in accordance with an investigation and report made to the Council of
Columbus, Georgia by competent land appraiser, the estimated value as just and
adequate compensation to be paid for such acquisition is hereby determined and
approved, and such sum is authorized to be paid into Court for the use of the
persons entitled thereto.

Also to be acquired is the right to an easement for construction of driveways
as shown colored pink on Exhibit ?A? attached hereto and made a part hereof.
This easement expires upon completion of project.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:

to a point on the proposed westerly Right-of-Way of Amber Drive, thence N
0E43'12" E, 111.00 feet to a point on the proposed westerly Right-of-Way of

A RESOLUTION DECLARING THAT THERE IS A NEED AND NECESSITY TO IMMEDIATELY
ACQUIRE TITLE TO LANDS UNDER THE PROVISION OF THE OFFICIAL CODE OF GEORGIA
ANNOTATED, AUTHORIZING THE MAYOR TO ORDER THE ACQUISITION OF SAID LANDS FOR
COUNTY ROAD AND/OR MUNICIPAL STREET PURPOSES, AND AUTHORIZING THE FILING OF A
DECLARATION OF TAKING BY THE CITY ATTORNEY OR HIS REPRESENTATIVES FOR THE
ACQUISITION OF SAID LANDS UNDER THE AUTHORITY OF THE OFFICIAL CODE OF GEORGIA
ANNOTATED, SECTION 32-3-1, ET. SEQ.

WHEREAS, it is hereby determined that the circumstances in connection with
acquiring rights-of-way for the Georgetown/Amber Drive Road Widening Project
are such that it is necessary to acquire the fee simple title, state or
interest in the following described property, to-wit:
All that tract or parcel of land lying and being in Land Lot 21 of the 9th
District of Muscogee County, Georgia, and being more particularly described as
follows:
BEGINNING at a point marking the easterly Right-of-Way of Amber Drive (60 foot
R/W) with the southerly Right-of-Way of Georgetown Drive, thence N 80?04'21" E,
23.35 feet to a point marking the intersection of the proposed easterly
Right-of-Way of the Amber Drive and the existing southerly Right-of-Way of
Georgetown Drive, thence S 47?16'28" W, 24.98 feet to a point on the proposed
easterly Right-of-Way of Amber Drive, thence S 0?43'12" W, 108.91 feet to a
point on the proposed easterly Right-of-Way of Amber Drive, thence S 71?23'04"
W, 5.22 feet to a point on the existing easterly Right-of-Way of Amber Drive,
thence N 0?46'13" E, 123.50 feet to a point marking the intersection of the
existing easterly Right-of-Way of the Amber Drive and the existing southerly
Right-of-Way of the Georgetown Drive, and being the POINT OF BEGINNING.
The above described parcel contains 0.017 acres (724 sq.ft.), and is shown
colored in yellow on a map or plat attached hereto and made a part hereof as
Exhibit ?A?.
Also to be acquired is the right to an easement for construction and
maintenance of slopes shown colored in orange on Exhibit ?A? attached hereto
and made a part hereof.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:
1.
That there is a necessity of acquisition of said property under the provisions
of the Official Code of Georgia Annotated ?32-3-1, et. seq.
2.
That the Mayor of Columbus, Georgia be, and he hereby is, authorized to issue
such orders and file such papers in the courts and enter into such agreements
as he deems necessary for the acquisition of said property and/or property
rights by condemnation under the provisions of said Act.
3.
That the acquisition of such property and/or property rights is for county
roads, municipal streets or public highway purposes.
4.
That the Mayor, City Manager and City Attorney, or their representatives, are
hereby authorized to take any and all lawful actions that they may deem
needful, necessary, advisable, or proper for acquisition of said property
and/or property rights pursuant to and in accordance with the provisions of the
Official Code of Georgia Annotated ?32-3-1, et. seq.
5.
That in accordance with an investigation and report made to the Council of
Columbus, Georgia by competent land appraiser, the estimated value as just and
adequate compensation to be paid for such acquisition is hereby determined and
approved, and such sum is authorized to be paid into Court for the use of the
persons entitled thereto.
