The Regular Meeting of the Board of Zoning Appeals was held Wednesday, November
5, 2003 at 2:00 P.M., on the 1st Floor of the Government Center Annex, 420-10th
Street. Members present were:

CASES TABLED FROM THE OCTOBER 1st MEETING.
Case No. 03-HO268--Denied.
There was no one present to present the application of Wendi Clark, 3813 Howard
Avenue, for a Certificate of Occupancy for a Home Occupation for an office only
for a pet care business, Paw Prints. The property is zoned R-3A.
There was no opposition to this application.
Mr. Edwards made a motion, which was seconded by Mr.
Lewis, to deny this application because there was no one present
to present the application for two consecutive meetings. Motion
carried unanimously.
Case No. 03-HO283--Granted.
Troy Edwards, 1030 Christmas Court, presented his application for a Certificate
of Occupancy for a Home Occupation for an office only for web hosting, domain
registration & web solutions, Weblazer. The property is zoned A-1.

Paskel B. Hilley II, 2378 Old River Road and his daughter-in-law, Tonya Hilley,
presented the appeal for a variance to reduce the side yard setback requirement
from 28 feet to 12 feet, in order to erect a single family residence, 53? x
68?. The property is zoned A-1.
In their statements and in response to questions from the Board
Members, Mr. Hilley and his daughter-in-law gave the following information:
They would like to build a house, but one side of the property has a real bad
drop off and the house can not be shifted any further.
There was no opposition presented to this appeal.
Mr. Fox made a motion, which was seconded by Mr. King, to grant this
appeal because the topography of the land dictates that they force the house
over to the right side line to within 12 feet. Motion carried unanimously.
Case No. 03-V128?-Granted.
Gail Aderhold, Action Buildings, presented the appeal of Nettie Huling, 4020
Evergreen Street, for a variance to reduce the side yard setback requirement
from 8 feet to 3 feet, in order to make an addition, 12? x 18?, a carport, to a
single family residence. The property is zoned R-2.

In her statement and in response to questions from the Board Members,
Ms. Aderhold gave the following information: Ms. Huling would like to add a
carport to her home. The carport will be over an existing slab. On the side
is a block wall, the water will drop right inside the block wall to the
street. There are similar carports in the neighborhood.
There was no opposition presented to this appeal.
Mr. Edwards made a motion, which was seconded by Mr. Lewis, to grant
this appeal because the carport will be over an existing pad and the water will
be controlled by the wall. Motion carried unanimously.
Case No. 03-V129?-Granted.
William Wood, R. W. Wood Construction, 7840 Lynch Road, presented the appeal
for a variance to reduce the side yard setback requirement from 28 feet to 15
feet, in order to erect a single family residence. The property is zoned A-1.
In his statement and in response to questions from the Board Members, Mr. Wood
gave the following information: There are 7 or 8 older property owners with
homes on various acreages. We have 5 acres and had to replat it into three
lots which were an acre and three thirds a piece. We decided to build a little
bit larger home in the $200,000 and above price range which dictates a side
load garage. We started clearing the land and because of the topography that
we ran into slopes on either side it will eliminate us from getting 29 or 30
feet to pour the side garage. It will also force us off the property line and
lose more trees in the front. We are proposing not to reduce each side, we
want only one side of each lot reduced. They will be moved the same distance
over. We may not need the complete 15 feet.
When the Chairperson asked for opposition, Edward Barnwell came forward. He
wanted to clarify what was being done. His main concern was he did not want
any houses too close to his home.
Mr. Wood stated he is going to leave some trees, what is seen now will remain
unless he does not get his zoning and then he will have to change the driveway
and reduce some of the trees. He will clear the area basically for the
driveway pad and the slab.

Mr. King made a motion, which was seconded by Mr. Lewis, to grant this appeal
because the extra footage is needed on the side in order to place the driveway
on the side instead of on the front. This way would be the least land
disturbance. Motion carried unanimously.
Case No. 03-V130?-Granted.

Dave Erickson, Pinnacle Homes, Inc., 5619 Hodges Drive, presented his appeal
for a variance to reduce the lot width requirement from 50 feet to 25 feet, in
order to subdivide a lot. The property is zoned R-3.

In his statement and in response to questions from the Board Members,
Mr. Erickson gave the following information: This is a large piece of property
that they purchased a month ago. There is a house in the rear of the property
that was already there. We would like to provide a logical access to the back
to the driveway. On the left is a house that the former owner has gifted that
property to a family member, so essentially the driveway to the existing house
is on that family member?s property, so we are re-aligning.
Will Johnson, representing the Planning Division, stated that Planning
recommends approval of this request.
When the Chairperson asked for opposition, Richard Jones came forward.
He is not in opposition, but would like to know what is being done.
Mr. Edwards made a motion, which was seconded by Mr. King, to grant this appeal
because this is the best scenario for this property and they won?t have lots
encroaching into the flood plain. Motion carried by the affirmative vote of the
four Board Members with David Fox abstaining from the vote.
Case No. 03-V133?-Granted.
Dave Erickson, Pinnacle Homes, Inc., 1009 Waterstone Court, presented the
appeal for a variance to reduce the side yard setback requirement from 8 feet
to 7 feet, in order to erect a single family residence. The property is zoned
R-2.
In his statement and in response to questions from the Board Members, Mr.
Erickson gave the following information: They are off by 8 inches at the rear
corner with this house. (He is representing Mrs. Dan, she now owns the
property, it was in the process of closing when they verified for sure that
they were off 8 inches at the corner.) The house is already complete. He was
at the Board of Zoning Appeals meeting last month for a similar case, he has an
employee who has made 1 or 2 mistakes and they have gone back and checked every
house they have in process. He thinks there is 1 more house that will have to
come before the Board next month and thinks that will resolve the issue. That
employee has been reassigned to a different responsibility.

Mr. Lewis made a motion, which was seconded by Mr. King, to grant this appeal
because a mistake was made and the house is already built. Motion carried by
the affirmative vote of the four Board Members with David Fox abstaining from
the vote.
Case No. 03-V134--Granted.
William Browning presented the appeal of Kwan Lee, 3933 Buena Vista Road, for a
variance to reduce the side yard setback requirement from 3 feet to 2 feet.
The property is zoned C-2. (sign is already in place)
In his statement and in response to questions from the Board Members,
Mr. Browning gave the following information: They would like to install a sign
on an existing foundation. The sign sits back farther than any other pylon
sign along that part of the highway. The side setback is 3 feet at the rear,
the foundation is approximately 2 feet and the front foundation is 4 feet off
of the side property line because of the angle. The pylon and anchor bolts are
pre-existing. The steel structure and the sign are brand new.
There was no opposition presented to this appeal.
Mr. King made a motion, which was seconded by Mr. Lewis, to grant this
appeal because the sign is already in place where the old footing, pylon and
foundation were located. Motion carried unanimously.
Case No. 03-V135--Granted.
James Johnson presented the appeal of Columbus Housing Initiative, Inc., 2837
Colorado Street, for a variance to reduce the front yard setback requirement
from 20 feet to 12 feet and to reduce the corner side yard setback requirement
from 20 feet to 9 feet and to reduce the required number of off-street parking
spaces from 2 to 1. The property is zoned R-3.

In his statement and in response to questions from the Board Members, Mr.
Johnson gave the following information: The house they would like to build
will be in line with the existing houses. The house will have 1 bedroom and 1
bathroom. With the area of space they would like to reduce the parking from 2
spaces to 1.
There was no opposition presented to this appeal.
Mr. Fox made a motion, which was seconded by Mr. King, to grant this
appeal because they are creating a lot where there is space enough to do a lot
that would keep houses similar to the existing houses. Motion carried
unanimously.

Ben Moon presented the appeal of Jones & Minear Homebuilders, LLC, 4976
Turnberry Lane, for a variance to reduce the lot width requirement from 100
feet to 82 feet, in order to subdivide a lot. The property is zoned R-1.
In his statement and in response to questions from the Board Members, Mr. Moon
gave the following information: This is a deep lot and we would like to split
the lot. The house will be on the back over looking the golf course, so
nothing will be built on the front.
Planning Division recommends approval of this
request.
There was no opposition presented to this appeal.
Mr. King made a motion, which was seconded by Mr. Lewis, to grant this appeal
because the house will sit far from the road and this will make the property
more appealing. Motion carried unanimously.

Laura Burbrink presented the appeal of Brian Grier, Inc., 1026 Whitesville Walk
Drive, for a variance to reduce the front yard setback requirement from 25 feet
to 12 feet and to reduce the rear yard setback requirement from 30 feet to 14
feet, in order to erect a single family residence, 43? 6? x 70? 2?. The
property is zoned R-2.
In her statement and in response to questions from the Board Members, Ms.
Burbrink gave the following information: We have a house that is in a
cul-de-sac lot and the radius is encroaching on the lot. The houses in the
community all have the garages designated for one side of the house. There
would be more green space in the front yard. If the house was placed on the
lot a different way, there would not be a front yard. This house would be the
only one different if the plans were changed to the required setbacks.
There was no opposition presented to this appeal.
Mr. King made a motion, which was seconded by Mr. Lewis, to grant this appeal
because this house will be consistent with the other houses and this will give
the front yard larger green space. Motion carried unanimously.
Case No. 03-V140?-Granted.
Laura Burbrink presented the appeal of Brian Grier, Inc., 5093 Boone Links
Lane, for a variance to reduce the front yard setback requirement from 20 feet
to 14 feet, in order to erect a single family residence, 54? 5? x 65? 7?. The
property is zoned R-3A.
In her statement and in response to questions from the Board Members, Ms.
Burbrink gave the following information: This house is in a cul-de-sac where
the radius is encroaching on the lot. There is an easement in the rear that
keeps the house from going back any further. They are limited on where the
house can sit.

because of the sanitary easement in the rear, this will make it easier for the
house to get on the lot. Motion carried unanimously.
Case No. 03-V141--Tabled.
There was no one present to present the appeal of Horace Senior, 1243 Boxwood
Boulevard, for a variance to reduce the rear yard setback requirement from 30
feet to 19 feet, in order to make an addition, a carport, 22? x 26?. The
property is zoned R-2.
There was no opposition presented to this appeal.
Mr. King made a motion, which was seconded by Mr. Lewis, to table this appeal
until the December meeting because there was no one present to present the
appeal. Motion carried unanimously.
Case No. 03-V142?-Granted.
Becky Carter presented the appeal of Starmount Shopping Center, 3465 Macon
Road, for a variance to reduce the number of off-street parking spaces from 140
to 91, in order to erect a mercantile building. The property is zoned C-2.
In her statement and in response to questions from the Board Members, Ms.
Carter gave the following information: With the change in the tenant layout,
the traffic in the shopping center has lowered and they have an opportunity to
put a building in the parking lot. Since those plans have been drawn they have
re-drawn plans and they are up to having 96 or 97 parking spaces. They think
that with the tenant mix this is more than adequate. Most of the parking
spaces that are being lost are along the retaining wall that are rarely used.
There was no opposition presented to this appeal.
Mr. Fox made a motion, which was seconded by Mr. King, to grant this appeal
because this would be adequate parking. Ms. Carter would like to change the
number of parking spaces from 91 to 96. Motion carried unanimously.

In his statement and in response to questions from the Board Members, the

When the Chairperson asked for opposition Faye Littlefield and Betty Johnson
who was also representing Ester Williams came forward. They had concerns with
a lot of people coming to his house, they do not want an increase in traffic
and hazardous material being used.
Mr. Fox made a motion, which was seconded by Mr. Lewis, to grant this
application because it does meet the intent of the Home Occupation definition,
but with the stipulation that there will be no storage of work material at the
residence. Motion carried unanimously.
