An Ordinance amending the Zoning Atlas of the Consolidated Government

of Columbus, Georgia; this amendment changes certain boundaries of a district

located west of the northwest and southwest corners of Wooldridge Road and

Veterans Parkway from A-1 (Agricultural) District to R-1 (Low Density

Residential) and R-1A (Low Density Residential) Districts.



THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY ORDAINS:



That the Zoning Atlas on file with the Planning Division of the

Department of Community and Economic Development be, and the same is hereby

amended by changing the following described property from A-1 (Agricultural)

District to R-1 (Low Density Residential) Districts:

The above-described property is being rezoned with the following conditions:



1. Restrictions and covenants (Subdivision Covenants) governing and

establishing standards for the development, use, landscaping, and appearance

of the Grey Rock Property that is to be developed as a single family

residential development, and the individual lots and single family homes

comprising the same, shall be prepared by Grey Rock Development, LLC (Grey

Rock) and recorded in the real property records of Muscogee County, Georgia

with respect to each section of single family residential lots prior to the

conveyance of any lots by Grey Rock. Said restrictions and covenants shall

include, but are not limited to, the following:

a. Homeowners Association: Grey Rock shall organize a Homeowners

Association and each owner of a single family residential lot in the Grey

Rock Property shall be required to join said association and to pay dues

secured by liens on the lot sufficient to maintain the Buffers (described in

Condition #2), the subdivision entrances to the Grey Rock Property as

developed, and all other common property and amenities of such single family

residential development.

b. Architectural Control Committee: An Architectural Control Committee

shall review and have approval over all improvements on the Grey Rock

Property to be developed as a single family residential development.

c. Buffers: Buffers, as stated in Condition #2, shall be included in

the Subdivision Covenants.

d. Front Yard Landscaping: Standards and requirements for front yard

landscaping and tree planting shall be developed and included in the

Subdivision Covenants.

e. Fences: No fencing shall be located within the Buffers or on the

side of a Buffer toward Wooldridge Road, Veterans Parkway, or the Georgia

Crown Property. No fencing shall be located within the right-of-way of

Wooldridge Road or Veterans Parkway. All fences shall be constructed of

either wood, masonry, black metal, or black chain-link.

f. Mailboxes: All mailboxes shall be of a uniform design to be set

forth in the Subdivision Covenants.

g. Minimum Square Footage of Homes: The Subdivision Covenants shall

provide that the minimum square footage of the single family homes (heated

area) built on the single family residential lots in the Grey Rock Property

shall not be less than the following:

1. R-1A Lots: 1,500 square feet

2. R-1 Lots: 1,800 square feet

3. R-1 Larger Lots: 2,200 square feet

h. Outbuildings / Accessory Structures: The Subdivision Covenants

shall provide for restrictions on outbuildings and other accessory

structures (Accessory Structures) constructed or installed on single family

residential lots in the Grey Rock Property, including, but not limited to, the

following:

1. No more than one Accessory Structure shall be constructed or

installed on a lot.

2. Accessory Structures shall not exceed one story in height.

3. The covered floor area of an Accessory Structure shall not be

greater than fifteen (15) percent of the minimum square footage applicable

to the single family home on a lot.

4. Accessory Structures shall be constructed of one or more of the

same materials as used on the exterior of the home constructed on the lot,

and the trim and other painted areas shall be painted the same color as (or

a color compatible with) the painted areas on the exterior of the home.

5. The roof pitch of Accessory Structures shall be a minimum of 5 on

i. Other Development Restrictions and Covenants:

1. Entrances: The Grey Rock Property shall have no more than two

entrances serving the single family residential development on the north

side of Wooldridge Road and no more than two entrances serving the single

family residential development south side of Wooldridge Road.

2. Density: The number of single family residential lots on the Grey

Rock Property shall not exceed five hundred ten (510) lots as shown on the

Master Plan (Exhibit B). Further, the number of R-1A lots shall not exceed

two hundred fifty-three (253) and the number of R-1 Larger Lots shall not

be less than one hundred nineteen (119).

3. Sanitary Sewer: All lots included in the Grey Rock Property shall

be served by a public sanitary sewer system.

2. The following perpetual "Buffers" (herein so called) shall be created and

established by Grey Rock, landscaped as provided below, and conveyed to the

Homeowners Association, prior to the sale of any lots in the Grey Rock

Property or the construction of any single.family homes thereon:

a. North line of Wooldridge Road: A 40-feet wide strip of land

entirely within the Grey Rock property and along the common boundary of the

Grey Rock Property and the north right-of-way line of Wooldridge Road,

extending to the intersection of the north right-of-way line of Wooldridge

Road and the west property line of the "Proposed Commercial Development"

parcel, planted with evergreens (such as Burford and Carissa Holly) and

other trees and plant-materials as included on Exhibit "C" attached hereto

and made a part hereof, to supplement the natural growth of trees. Clear

cutting of this Buffer at any time shall be prohibited, it being the intent and

agreement of the parties hereto that the only trees or other plant materials

that may be cut down or removed are dead or diseased trees and other plant

materials.

b. South line of Wooldridge Road: A 35 feet wide strip of land

entirely within the Grey Rock Property and along the common boundary of the

Grey Rock Property and the south right-of-way line of Wooldridge Road,

extending to the intersection of the south right-of-way line of Wooldridge

Road and the west property line of the "Proposed Commercial Development"

parcel, planted with evergreens (such as Burford and Carissa Holly) and

other trees and plant materials as included on Exhibit "C" attacbed hereto

and made a part hereof. Clear cutting of this Buffer shall be prohibited at

any time after the initial landscaping is planted and installed, it being the

intent and agreement of the parties hereto that the only trees or other

plant materials that may be cut down or removed after such initial

landscaping are dead or diseased trees and other plant materials.

c. Common property line with Georgia Crown: A 30 feet wide strip of

land entirely within the Grey Rock Property and along the common boundary of

the Grey Rock Property and the Georgia Crown Property, planted with

evergreens (such as Burford and Carissa Holly) and other trees and plant

materials as included on Exhibit ?C? attached hereto and made a part hereof.

Clear cutting of this Buffer shall be prohibited at any time after the

initial landscaping is planted and installed, it being the intent and

agreement of the parties hereto that the only trees or other plant materials

that may be cut down or removed after such initial landscaping are dead or

diseased trees and other plant materials.

d. West line of Veterans Parkway: A 50 feet wide strip of land

entirely within the Grey Rock Property and along the common boundary of the

Grey Rock Property and the west right-of-way line of Veterans Parkway,

planted with evergreens (such as Burford and Carissa Holly) and other trees

and plant materials as included on Exhibit ?C? attached hereto and made a

part hereof. Clear cutting of this Buffer shall be prohibited at any time

after the initial landscaping is planted and installed, it being the intent

and agreement of the parties hereto that the only trees or other plant

materials that may be cut down or removed after such initial landscaping are

dead or diseased trees and other plant materials.
