SUBJECT: Encroachment onto City right-of-way
First Baptist Church

Recommendation: Approve the attached resolution authorizing the permanent
encroachment onto City right-of-way for First Baptist Church along the east
curb of 3rd Avenue.
Background: The Traffic Engineering Division received a request from First
Baptist Church soliciting an encroachment onto City right-of way. In this
request First Baptist Church is petitioning the City to allow the canopy
overhang to encroach onto the City?s right-of-way at 3rd Avenue and a passenger
loading area is to be constructed between the east curb of 3rd Avenue and the
sidewalk.
Analysis: The Traffic Engineering Division reviewed the site plans, and
recommends the approval of the proposed encroachment.
Alternatives: A denial would prevent improvements on public right-of-way.
Financial Considerations: There is no cost to the City beyond administrative
cost for permitting and inspections.
Legal Considerations: A variance to the City Code of this nature requires
Council approval.
Actions: Approve the recommended encroachment onto City right-of-way along 3rd
Avenue.

A RESOLUTION AUTHORIZING A PERMANENT ENCROACHMENT FOR A PASSENGER LOADING LANE
AND A CANOPY STRUCTURE OVER THE EXISTING SIDEWALK WITHIN CITY RIGHT-OF-WAY TO
THE FIRST BAPTIST CENTER TO BE LOCATED ALONG THE EAST CURB OF THIRD AVENUE
SOUTH OF THIRTEENTH STREET; AUTHORIZING A VARIANCE TO THE DRIVEWAY CODE,
SECTION 22-32(6) FOR MINIMUM DRIVEWAY RADII.

WHEREAS, First Baptist Church plans to construct a new Child Development Center
along the east curb of Third Avenue beginning at the south right-of-way line of
Thirteenth Street and running south to north property line of 1220 Third
Avenue; and,
WHEREAS, First Baptist Church plans to construct a canopy for the Child
Development Center that will overhang the sidewalk within the east right-of-way
of Third Avenue; and,
WHEREAS, First Baptist Church requested the City to allow the canopy to
encroach onto the City?s right-of-way at Third Avenue; and,
WHEREAS, a passenger loading lane will be constructed between the east curb of
Third Avenue and the sidewalk; and,
WHEREAS, the northern most driveway shall not be located any closer than 100
feet from south curb of 13th Street as measured to the tangent point of the
driveway radius; and,
WHEREAS, the ingress and egress driveways will require a variance to the
driveway code that allows the interior driveway radii to be less that fifteen
(15) feet; and,
WHEREAS, the City reserves the right to reclaim the full use of said
right-of-way for any future roadway and/or right-of-way improvements upon
giving the First Baptist Church, its successors or heirs a ninety (90) day
written notice to clear all encroachments/obstructions from the right-of-way at
no cost to the City.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA HEREBY RESOLVES:
That a PERMANENT ENCROACHMENT IS HEREBY AUTHORIZED FOR A PASSENGER LOADING LANE
AND A CANOPY STRUCTURE OVER THE EXISTING SIDEWALK WITHIN CITY RIGHT-OF-WAY TO
THE FIRST BAPTIST CHURCH CHILD DEVELOPMENT CENTER TO BE LOCATED ALONG THE EAST
CURB OF THIRD AVENUE SOUTH OF THIRTEENTH STREET; WE HEREBY AUTHORIZE A VARIANCE
TO THE DRIVEWAY CODE, SECTION 22-32(6) FOR MINIMUM DRIVEWAY RADII, WHICH WILL
ALLOW THE INTERIOR DRIVEWAY RADII TO LESS THAN 15 FT; THE CITY RESERVE THE
RIGHT TO RECLAIM THE FULL USE OF SAID RIGHT-OF-WAY FOR ANY FUTURE ROADWAY
AND/OR RIGHT-OF-WAY IMPROVEMENTS UPON GIVING THE FIRST BAPTIST CHURCH, ITS
SUCCESSORS OR HEIRS A NINETY (90) DAY WRITTEN NOTICE TO CLEAR ALL
ENCROACHMENTS/OBSTRUCTIONS FROM THE RIGHT-OF-WAY AT NO COST TO THE CITY.
