An Ordinance amending the Zoning Atlas of the Consolidated Government

of Columbus, Georgia; this amendment changes certain boundaries of a district

located at 3898 Mulberry Drive from R-1A (Low Density Residential) District to

R-3 (Medium Density Residential) District.



THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY ORDAINS:





All that lot, tract or parcel of land situate, lying and being in LAND LOT 134

of the COWETA RESERVE of Muscogee County, Georgia, and being a PART OF LOTS

SIXTEEN (16) and SEVENTEEN (17), in BLOCK LETTERED ?C?, in that Subdivision

known as ?ALTA VISTA,? as shown on a survey of record in the Office of the

Clerk of the Superior Court of Muscogee County, Georgia in Deed Book 60, Page

559. The property hereby conveyed is designated as 4.307 acres on a plat of

Mulberry Hill, of record in said Clerk?s Office in Plat Book 103, Page 13 and

Book 103, Page 76 and as shown on said surveys, is located east of and adjacent

to Lots 3, 4, and 8 of said Mulberry Hill Subdivision, and at the intersection

of Mulberry Drive and Morris Road, Columbus, Georgia.



The above-described property is being rezoned with the following conditions:



1. All lighting shall be deflected internally using deflector shields.

2. Any external trash dumpsters / compactors shall be visually obstructed by a

structure that is aesthetically similar to the proposed development.

3. Screening for air conditioners, refrigeration units, and heat pumps shall be

required for all development on the property.

4. No external trash dumpsters / compactors shall be located along the west and

south property lines.

5. If any owner of the property subject to rezoning ceases to use said property

as a church day care center, then the property shall be rezoned to an R-1A

district by the Planning Division.

the 3rd day of May, 2005; introduced a second time at a regular meeting of
