The Regular Meeting of the Board of Zoning Appeals was held Wednesday, October
2, 2002 at 2:00 P.M., on the 1st Floor of the Government Center Annex, 420-10th
Street. Members present were:

CASES TABLED FROM THE SEPTEMBER 4TH MEETING.
Case No. 02-HO186--Denied.
There was no one present to present the application of Charles Jones, 3715
Willowbend Run, for a Certificate of Occupancy for a Home Occupation for an
office only for painting and miscellaneous repairs, C. Edward Jones Contracting
Company. The property is zoned R-1A.
His case was tabled because he had two employees when he came to the
September Meeting. He was told that his two employees could come back to the
October meeting and they would need to get Home Occupations for their home
businesses. Mr. Jones nor his two employees came to the October meeting;
therefore, his application was denied since employees are not allowed in a Home
Occupation.
There was no opposition to this application.
Mr. Phillips made a motion, which was seconded by Mr. Fox, to deny this
application because Mr. Jones did not attend the 2nd meeting where his two
employees were supposed to apply for their Home Occupations and employees are
not allowed in a Home Occupation. Motion carried unanimously.

Case No. 02-HO193--Granted.
Edith Salyer, 8 Northfield Court, presented her application for a Certificate
of Occupancy for a Home Occupation for an office only for selling jewelry and
accessories (peddler), Selections by Edie. The property is zoned R-1A.
In her statement and in response to questions from the Board Members,
the applicant gave the following information: She will sell watches, costume
jewelry and handbags. She will be using one room of her home as an office
only. She will have no employees and there will be no additional traffic in
the neighborhood. She will meet with her client?s at their homes and no one
will be coming to her home. This will be part time work.
There was no opposition to this application.
Mr. Fox made a motion, which was seconded by Mr. Billingsley, to grant
this application because it does meet the intent of the Home Occupation
definition. Motion carried unanimously.

Case No. 02-V152?-Withdrawn.
This appeal was withdrawn at the request of the appellant Roy Miller, 5344-A
Kolb Avenue, from a Decision of the Building Official that a second sign is not
allowed. The property is zoned M-1.
There was no opposition presented to this appeal.
Case No. 02-V153?-Granted.
Tony Wright presented the appeal of James M. Knight, Inc. (Chevron), 8050
Beaver Run Road, from a Decision of the Building Official that only 2 signs are
allowed, 4 signs existing, 5 signs shown. The property is zoned C-3.

In his statement and in response to questions from the Board Members, Mr.
Wright gave the following information: They would like to add 1 sign on the
Beaver Run Road side. They have quite a bit of road frontage and they would
like to add a sign. They thought about attaching it to the Chevron sign, but
they are not allowed to do that because of their agreement with Chevron. This
sign will be compatible with the other signs on the
property.
There was no opposition presented to this appeal.
Mr. Phillips made a motion, which was seconded by Mr. Fox, to grant this appeal
because there is a lot of area out there and this is not a confined business.
The sign is on a street where major highways come together and vehicles are
traveling at highway speed. He can see the need for signage to show the
information as quickly as possible. The Building Official was correct that
there should only be 2 signs; however, the size of the property, location and
type of highway was compelling evidence that this size property needs some
help. Motion carried unanimously.
Case No. 02-V154?-Granted.
Curtis Weeks, Weeks Construction, presented the appeal of Florine Lakes, #1
Kaleen Court, for a variance to reduce the corner side yard setback requirement
from 25 feet to 9 feet, in order to make an addition, 20? x 22?, a carport, to
a single family residence. The property is zoned R-2.
In his statement and in response to questions from the Board Members, Mr. Weeks
gave the following information: Ms. Lakes would like to add a 20? x 22? double
carport with brick columns to her single family residence. The carport will
have a gable roof and it will be over an existing slab. The water will flow to
the street. The house is in a cul-de-sac and on the side where the carport
will be located is a vacant lot. The materials used in the carport will match
those of the house.

Mr. Fox made a motion, which was seconded by Mr. Billingsley, to grant this
appeal because this is a corner lot and the carport will be over an existing
pad. The water will flow to the street. The materials used in the carport
will match those of the house. Motion carried unanimously.
Case No. 02-V155--Granted.
Carolyn Curenton, 7116 Midnight Sun Lane, presented the appeal for a variance
to reduce the side yard setback requirement from 8 feet to 4 feet, in order to
make an addition, a carport, 25? x 25?, to a single family residence. The
property is zoned R-2.
In her statement and in response to questions from the Board Members, Ms.
Curenton gave the following information: She would like to add a 25? x 25?
wooden carport to her home that will go over an existing pad. The same
materials used will match the existing house. The water will flow down the
hill to the street.
There was no opposition presented to this appeal.
Mr. Phillips made a motion, which was seconded by Mr. Fox, to grant this appeal
because this will be a nice improvement to the home. The addition will be on
the driveway side of the neighbor?s residence. There will be no water problem
and there was no opposition to this case. Motion carried unanimously.
Case No. 02-V156?-Granted.
Ed Burdeshaw of Hecht, Burdeshaw, Johnson, Kidd & Clark, 3100 Macon Road,
presented the appeal of Muscogee County School District for a variance to
reduce the required number of off street parking spaces from 428 to 318, in
order to erect a library. The property is zoned C-2.
In his statement and in response to questions from the Board Members, Mr.
Burdeshaw gave the following information: He is one of the architects for the
new library. They are asking that the required number of parking spaces be
reduced from 428 to 318.

The 318 parking spaces will be enough for the existing library. Inspection and
Codes have ruled that this is a business occupancy with 1 parking space per 250
square feet and the library doesn?t fall into that category and there is not an
appropriate category within the ordinance. They have surveyed other facilities
of similar size and they have found the ratio that they are proposing is
adequate. If they were to add the spaces for cars it would take away green
space, it would cause more run off and it would be an empty car lot.
There was no opposition presented to this appeal.
Mr. Phillips made a motion, which was seconded by Mr. Billingsley, to grant
this appeal because there has been a lot of research done on how to design this
building, how to make it useful, how to park people and how to move the people
into the building. He respects the opinion of the architects. Motion carried
unanimously.
Case No. 02-V157?-Granted.
Alan Massey, 4012 Lakewood Drive, and William Bray, Bray Building Corporation,
presented Mr. Massey?s appeal for a variance to reduce the front yard setback
requirement from 25 feet to 15 feet, in order to make an addition, 12? x 28?,
to a single family residence. The property is zoned R-2.
In their statements and in response to questions from the Board Members, Mr.
Massey and Mr. Bray gave the following information: They would like to remove
the existing small covered stoop from the front of their house and construct a
new front porch, 12? x 28?. They have a petition signed by adjacent property
owners stating that they have no objections to the addition or to the change in
setback dimensions. There are other houses in the neighborhood that have
similar covered porches.
There was no opposition presented to this appeal.
Mr. Edwards made a motion, which was seconded by Mr. Phillips, to grant this
appeal even though the new porch will extend out further than most of the
properties down the line from

them. The house next door is sitting at a catty-cornered angle, it?s next to
the corner lot, and this would be a nice improvement to the neighborhood.

Case No. 02-V158?-Granted.
Joe Jaynes, Identity Manager for Cracker Barrel, 1500 Bradley Park Drive,
presented the appeal for a variance to increase the height of a ground sign
from 35 feet to 70 feet. The property is zoned M-2.
In his statement and in response to questions from the Board Members, Mr.
Jaynes gave the following information: They have looked several times in
Columbus, Georgia, to locate a restaurant and they never felt that they found
all of the aspects in a piece of property that had what they thought could make
a successful business, until they found the corner of Bradley Park Drive and
Highway 80. The one thing they think is missing from this piece of property is
visibility from Highway 80. Typically Cracker Barrel utilizes billboards as
well as logo boards and they utilize those as best as they can to help identify
the property as well as offering signage. This particular location presents a
problem as such, there are no billboards on Highway 80 that are available and
the logo boards are all full. As long as the businesses participate on the
board and remain on the board and no businesses, which open up after that will
have the opportunity to apply. They would like to purchase 8 acres of which
only 2 acres will be usable; there will be a considerable amount of frontage,
but not all will be usable. They are asking for a variance for a free standing
sign that is 70 foot in overall height. This is a minimum request as far as
getting visibility from Highway 80.
There was no opposition presented to this appeal.
Mr. Fox made a motion, which was seconded by Mr. Phillips, to grant this appeal
because the presentation was very good and it won?t be an intrusion on a
rapidly growing commercial area. This is a stand alone sign and it fronts on
an industrial park. Motion carried unanimously.

Case No. 02-V159?-Granted.
Paula Dukes, 3727 E. Britt David Road and Scott McGregor, Aquarius Pools,
presented the appeal from a Decision of the Building Official that an accessory
structure, a swimming pool, 16? x 32?, is not permitted in the side yard. The
property is zoned R-1A.
In their statements and in response to questions from the Board Members, Ms.
Dukes and Mr. McGregor gave the following information: She would like to put a
pool in the side yard, which will be 20 feet from her neighbor and 30 feet from
the road. The pool would be enclosed with a privacy fence. Her house sits
across 2 city lots and the back yard is where her driveway, unattached carport
and trees are located. There is no door that goes out of the back of the
house, the door is on the side of the house.
The Board Members asked if the pool could be moved 60 feet from the property
line instead of 52 feet and Ms. Dukes and Mr. McGregor agreed that they could
do that.
There was no opposition presented to this appeal.
Mr. Phillips made a motion, which was seconded by Mr. Fox, to grant this appeal
because of the irregular shape of the lot and the way the house is placed on
it, this would be the best position for the pool; but with the stipulation that
the pool will be moved 60 feet from the property line instead of 52 feet.
Motion carried unanimously.
Case No. 02-V160?-Granted.
Mike Socci presented the appeal of Woodruff Contracting Company, #30 Peppertree
Court, for a variance to reduce the side yard setback requirement from 8 feet
to 4 feet, in order to erect a single family residence. The property is zoned
R-2.
In his statement and in response to questions from the Board Members, Mr. Socci
gave the following information: The houses are already erected. Ben Moon put
the site plan together and it is still showing that they have 17 to 18 feet
between the houses.

There were 2 property pins 5 feet apart and they measured from the wrong pin.
The front corners are approximately 4 feet and that is where they need the
variance. They put the stake in the wrong place and instead of getting 8 feet
they got 4 feet. They own both houses, but one house is under contract.

Mr. Phillips made a motion, which was seconded by Mr. Fox, to grant this appeal
because of the confusing property lines between the two residences. Motion
carried unanimously.
Case No. 02-V161?-Granted.
Gary Hall presented the appeal of GLH Development Inc., 106 45th Street, for a
variance to reduce the corner side yard setback requirement from 20 feet to 10
feet, in order to erect an office/warehouse, 60? x 160?. The property is zoned
C-3. Contingent upon Planning approval.
In his statement and in response to questions from the Board Members, Mr. Hall
gave the following information: The property around this location is zoned
C-3. The property they would like rezoned is R-3A. The area on the 2400 sq.
ft. side of the warehouse is high and the area on the left side, if you?re
facing the property backing up to the Shell Station, slopes away. There is
going to be a 7 foot retaining wall on the lower side. They will tear down a
small house that was unlivable and build an office/warehouse. The other
property around it is vacant.
Planning does recommend approval of this request.

Mr. Fox made a motion, which was seconded by Mr. Billingsley, to grant this
appeal to reduce the corner side yard setback requirement from 20 feet to 10
feet, contingent upon Planning?s approval to rezone the property from R-3A to
C-3. Motion carried unanimously.

Case No. 02-V162?-Granted.
Archie Parks presented the appeal of Dorothy Parks, 5010 Armour Road, for a
variance to reduce the rear yard setback requirement from 40 feet to 12 feet
and to reduce the required number of off-street parking spaces from 30 to 22,
in order to erect a hotel. The property is zoned A-O.
In his statement and in response to questions from the Board Members, Mr. Parks
gave the following information: They are building a specialty hotel. When the
hotel is full, it still has 6 to 8 spaces that are not occupied that can be
used because the property is owned by the same person. They have 22 spaces for
20 rooms and they feel this would be adequate. The property to the north is a
sleep-in hotel. Buckhead Grill, which is to the west, has parking spaces in
the rear if they need additional parking spaces.
There was no opposition presented to this appeal.
Mr. Edwards made a motion, which was seconded by Mr. Fox, to grant this appeal
because they have two more spaces than they have rooms and this is adequate.
There will be an encroachment on the parking lot in the rear and not on any
residential property. Motion carried unanimously.
Case No. 02-V163?-Granted.
Hal Averett presented the appeal of Julia Ashley, 1331 10th Street, for a
variance to increase the allowable floor area for restoration of a
non-conforming single family residence from 50% to 83% and to reduce the side
yard setback requirement from 3 feet to 2 feet and to reduce the corner side
yard setback requirement from 25 feet to 6 feet, in order to erect a single
family residence, 31? x 43?. The property is zoned A-O. .
In his statement and in response to questions from the Board Members, Mr.
Averett gave the following information: He was helping Ms. Ashley do some
cosmetic work to her house when a tree fell on her house while they were in the
middle of the project.

Since it was a City tree, she thinks the City should be responsible for it.
The house has been sitting for one year with the damage still done to the
house. The house is existing and they will be going back to the same
blueprint. This is only a 39 foot wide lot and an A-O zoning requires a 25
foot setback on a corner. This is an impossible situation. This is also
designated in a historic district, they gave the approval to demolish the
residence and erect something else. The house has no footings, it is totally
out of square and the roof has been off for one year. The only way to meet the
City guidelines and requirements is to leave one portion of the house that was
added on in the 1960?s. That portion has a footing and that is the 17% that is
left so that we don?t have to tear it down and have to rezone it. They would
like to rebuild a house back on the lot.

Mr. Fox made a motion, which was seconded by Mr. Phillips, to grant this
appeal. This is a strange situation where you have an A-O zoning virtually in
the middle of a subdivision. The zoning changes the amount of area of a lot
that can be absorbed, but in this case the house already did absorb that
amount. Today this would be considered a sub-standard lot; it is only 39 feet
wide and they are only replacing and enhancing a house that has already been
virtually destroyed. Motion carried unanimously.
HOME OCCUPATIONS.
Case No. 02-HO207?-Granted.
Jimmie Tice, 1323 35th Street, presented his application for a Certificate of
Occupancy for a Home Occupation for an office only for handyman services,
Columbus Honey Do. The property is zoned R-3A.
In his statement and in response to questions from the Board Members, the
applicant gave the following information: He will be using one room of his home
as an office only. He will have no employees and there will be no additional
traffic in the neighborhood. This will be part time work. He will do
painting, yard work and patch sheetrock, mainly for older people.

In his statement and in response to questions from the Board Members, the
applicant gave the following information: He will be using one room of his home
as an office only. He will have no employees and there will be no additional
traffic in the neighborhood. This will be full time work. The live bait will
be stored in a refrigerator to keep them fresh and he is not sure if he is
going to sell crickets right now. In the future, he would like to open a bait
shop. His wife will sell the craft items on the internet.
