AN ORDINANCE

An Ordinance amending the Zoning Atlas of the Consolidated Government

of Columbus, Georgia; this amendment changes certain boundaries of a district

located at 4348 and 4350 17th Avenue; and 1706 and 1708 44th Street, from R-4

(High Density Residential) District to C-2 (Neighborhood Shopping) District.



THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY ORDAINS:



That the Zoning Atlas on file with the Planning Division of the

Department of Community and Economic Development be, and the same is hereby

amended by changing the following described property from R-4 (High Density

Residential) District to C-2 (Neighborhood Shopping) District:



Beginning at an iron pipe located at the corner formed by the intersection of

the eastern line of Seventeenth Street with the southern line of Forty-Fourth

Street, and from said point of beginning running thence in a southerly

direction, along the said eastern line of Seventeenth Avenue, a distance of 75

feet to a point; thence running in an easterly direction, through said Lot #1,

parallel with the southern line of Forty-Forth Street, a distance of 60 feet to

a point located on the eastern line of said Lot #1; thence running in a

northerly direction along the said eastern line of said Lot #1, parallel with

the said eastern line of Seventeenth Avenue, a distance of 75 feet to a point

located on the southern line of Forty-Fourth Street, said point being also the

northeastern corner of said Lot #1; thence running in a westerly direction,

along the said southern line of Forty-Fourth Street a distance of 60 feet to

the point of beginning.



And



Beginning at an iron stake located on the easterly line of 17th Avenue, which

iron stake is located 75 feet south of the southeast corner of the intersection

of 17th Avenue with 44th Street; thence running southerly along the east line

of 17th Avenue a distance of 75 feet to an iron stake; thence easterly and

parallel with the south line of 44th Street a distance of 60 feet to an iron

stake; thence north and parallel with the east line of 17th Avenue a distance

of 75 feet to an iron stake; thence west and parallel with the south line of

44th Street a distance of 60 feet to the point of beginning.



And



All that tract or parcel of land situate, lying and being in Columbus, Muscogee

County, Georgia, and being the west one-half of Lot No. 2 of Survey of Parts of

Lands J. Calvin Cook and being of record in the Office of the Clerk of the

Superior Court of Muscogee County, Georgia in Deed Book 673, Page 431, and also

being commonly known by the street address of 1706 44th Street.



And



All that tract or parcel of land situate, lying and being in Columbus, Muscogee

County, Georgia, and being the east one-half of Lot No. 2 of Survey of Parts of

Lands J. Calvin Cook and being of record in the Office of the Clerk of the

Superior Court of Muscogee County, Georgia in Deed Book 668, Page 529, and also

being commonly known by the street address of 1708 44th Street.





The above-described property is being rezoned with the following conditions:



1. All lighting shall be directed internally using deflector shields.

2. Curb and gutter shall be installed along the south edge of 44th Street from

17th Avenue to the east property line of this site.
