The Regular Meeting of the Board of Zoning Appeals was held Wednesday, November

3, 2004 at 2:00 P.M., on the 1st Floor of the Government Center Annex, 420-10th

Street. Members present were:





Mrs. Leah Braxton, Chairperson

Mr. Willie Lewis Jr.

Mr. Billy Edwards

Mr. Ralph King



Also present were Mr. Danny Cargill, Secretary of the Board, and Ms. Veronica

Pitts, Recording Secretary.



Mr. Edwards made a motion, which was seconded by Mr. King, to approve

the Minutes of the Monthly Meeting, which was held on October 6, 2004. Motion

carried unanimously.



Board Member David Fox was unable to attend the meeting, Mr. King made

a motion, which was seconded by Mr. Lewis, to excuse Mr. Fox?s absence on

today, November 3, 2004, for personal reasons. Motion carried unanimously.





CASES TABLED FROM THE OCTOBER 6TH MEETING.



Case No. 04-V95--Denied.



There was no one present to present the appeal of Greater Beulah Baptist

Church, (Signs, Inc.), 613 Sixth Avenue, from a Decision of the Board of

Historic and Architectural Review to deny approval of a sign that is not in

keeping with the Historic District?s guidelines. The property is zoned C-3.



There was no opposition presented to this appeal.



Mr. King made a motion, which was seconded by Mr. Lewis, to

deny this appeal because a compromise could not be made with BHAR

and failure to be present for the B.Z.A. meeting. Motion carried

by the affirmative vote of the four Board Members present for

this meeting.

Case No. 04-HO275--Granted.



Gary Holcomb, 7209 Helen Drive, presented his application for a Certificate of

Occupancy for a Home Occupation for an office only for a home inspection

business and selling lamps & ballasts, Best Home Inspection. The property is

zoned R-1A.



In his statement and in response to questions from the Board Members, the

applicant gave the following information: He will be using one room in his

home as an office only. He will have no employees and there will be no

additional traffic in the neighborhood. This will be full time work. He will

pick up the bulbs and take them to the client?s home.



There was no opposition to this application.



Mr. King made a motion, which was seconded by Mr. Edwards, to grant this

application because it does meet the intent of the Home Occupation definition.

Case No. 04-V156--Granted.



Elizabeth Parsons, 1321 10th Street #4 and Jimmy Cross presented the appeal for

a variance to reduce the rear yard setback requirement from 40 feet to 13 feet,

in order to make an addition, enclose an existing porch, to a townhouse. The

property is zoned A-O.



In their statements and in response to questions from the Board

Members, Mrs. Parsons and Mr. Cross gave the following information: They would

like to enclose the existing porch, they are extending the roof line. The

material used will be brick. They have received approval from BHAR.

this appeal because it will match the existing design of the house and it has

Case No. 04-V157?-Granted.



Bob and Susan Weigl, 215 7th Street, presented their appeal for a variance to

reduce the side yard setback requirement from 10 feet to 5 feet, in order to

make an addition, a porch, to a single family residence. The property is zoned

H.



In their statements and in response to questions from the Board

Members, Mr. and Mrs. Weigl gave the following information: They realized they

have a large easement between their house and the house next door when the back

door was moved to the side of the house. The existing porch on the back of the

house has many roof lines and they want to fix that by extending the bathroom

and adding a closet. Where the existing porch was they need some type of exit

from the kitchen area. The Board of Historic and Architectural Review has

given their approval.



There was no opposition presented to this appeal.



Mr. Edwards made a motion, which was seconded by Mr. King, to grant

this appeal because this will clean up the roof system and they have approval

from BHAR. Motion carried by the affirmative vote of the four Board Members

present for this meeting.



Case No. 04-V158?-Denied.



Barry Wells, Wells Construction, 1253 Gurr Avenue, presented his appeal for a

variance to reduce the side yard setback requirement from 8 feet to 5 feet, in

order to erect a single family residence. The property is zoned R-3A.



In his statement and in response to questions from the Board Members, Mr. Wells

gave the following information: At the last Board meeting he was asked if an

additional variance would be needed and he said no, but because this is his

first time doing this it was overlooked that an additional 3 feet was needed.

3 feet is taken from the width of the house the living area, the rooms will be

too small. The site plan has a driveway on it, but it will be done

differently. The house next door has a circular driveway and he would like to

put in the same kind of driveway. The plans showed lot 5 with an existing

house, the previous variance was for lot 6 had an existing house and he will

remodel it. He was showing the wrong lot to the B.Z.A. members. Because the

lots look the same, he had the lots mixed up.



Leah Braxton, Chairperson, asked Mr. Wells if had gone before the Board

of Historic and Architectural Review.



Mr. Wells stated Sean Boles told him if he was approved by B.Z.A. then he would

be approved by BHAR by Friday.



Will Johnson, Principal Planner, asked Mr. Wells if the case has gone before

BHAR.



Mr. Wells, stated no, he guess it hasn?t gone before BHAR.



Danny Cargill, Acting Secretary of the Board, stated if the driveway is going

to be moved then he would have to go back to BHAR.



When the Chairperson asked for opposition, Larry Carr and Stacey Doggett came

forward. Janice Bell stood up in opposition, but did not speak. Their

concerns are making sure enough space is between the houses, they do not want

the new house to be squeezed in and the zoning is designed to protect the

quality of the neighborhood as it is and this will lessen the

quality.

Mr. Edwards made a motion to table this appeal, motion failed because there was

no second. Mr. King made a motion, which was seconded by Mr. Lewis, to deny

this appeal because this case has not gone before BHAR, there were

discrepancies in the site plan and there was opposition. Motion carried by the

affirmative vote of the four Board Members present for this meeting.



Case No. 04-V159?-Granted.



Ed Parker, 1718 Marilon Drive, presented his appeal for a variance to reduce

the side yard setback requirement from 8 feet to 6 feet 3 inches, in order to

make an addition, a family room, laundry room and bathroom, to a single family

residence. The property is zoned R-1A.

In his statement and in response to questions from the Board Members,

Mr. Parker gave the following information: He would like to add approximately

300 square feet to the back left of his house. The addition will be a den and

bathroom. The existing room will be made into a larger laundry room. The

house is 6 feet 3 inches from the property line and the addition will be no

closer to the property line. Similar materials will be used to match the

house.

There was no opposition presented to this appeal.



Mr. Edwards made a motion, which was seconded by Mr. Lewis, to grant this

appeal because the existing house is 6 feet 3 inches and it will not be any

closer than the existing house to the property line. Motion carried by the

affirmative vote of the four Board Members present for this meeting.



Case No. 04-V160?-Granted.



Sandy Bosch and Doug Hawn presented the appeal of St. Thomas Episcopal Church,

2100 Hilton Avenue, for a variance to reduce the required distance of a sign

from the property line from 3 feet to 2 feet. The property is zoned R-1A.



In their statements and in response to questions from the Board Members, Mr.

Bosch and Mr. Hawn gave the following information: They would like the sign to

be o.k. where it is presently located. The sign should be 3 feet inside the

right of way, but it is actually 2 feet. When they originally applied for the

sign it was in the same location, but it was a smaller sign. The new sign is a

bigger sign. Previously when they applied for the variance for the sign they

did not acknowledge where the sign would be.



There was no opposition presented to this appeal.



Mr. King made a motion, which was seconded by Mr. Edwards, to grant

this appeal because the hardship would be they would have to take down the sign

and re-build it. Motion carried by the affirmative vote of the four Board

Members present for this meeting.

BOARD OF ZONING APPEALS ? 11/3/2004





Case No. 04-V161--Granted.



Tommy Chapman of Signs Inc. and Dhan Parekh presented the appeal of Hilton

Garden Inn, 1500 Bradley Lake Boulevard, for a variance to reduce the required

distance of a sign from the property line from 3 feet to 0 inches. The

property is zoned A-O.



In their statements and in response to questions from the Board Members, Mr.

Chapman and Mr. Parekh gave the following information: They are asking to

reduce the required distance because the sign is on the DOT line. DOT has

approved this distance and they need approval from the City. The hardship is

they are working against the transmission easement (Georgia Power line).



There was no opposition presented to this appeal.



Mr. Edwards made a motion, which was seconded by Mr. King, to grant

this appeal because the hardship is the amount of space they have to put this

on between the power easement and the property line. Motion carried by the

affirmative vote of the four Board Members present for this meeting.



Case No. 04-V162--Granted.



Bob Crane presented the appeal for his wife Elana S. Crane, 8946 Moore Road,

for a variance to reduce the lot width requirement from 125 feet to 50 feet, in

order to replat a lot. The property is zoned A-1.



In his statement and in response to questions from the Board Members,

Mr. Crane gave the following information: He has previously gone before the

Board to be approved for 5 lots, a technicality was found that had to be

cleaned up and that is why it is going back before the Board. He is trying to

maximize the size of the lots instead of making them smaller. He would like to

make the lots 1 acre in size and have more green space.



Planning recommends approval of this request. The memorandum from Planning is

attached and therefore is considered a part of these minutes.

When the Chairperson asked for opposition, Larry Biggers, Brian Pole and Matt

Gouge came forward. They had concerns with the quality of the neighborhood

going down, zone changes and the size of the lots.



Mr. King made a motion, which was seconded by Mr. Lewis, to grant this

appeal because this will increase the lot size and create more green space for

the area. Motion carried by the affirmative vote of the four Board Members

present for this meeting.



Case No. 04-V163?-Granted.



Gary Lisle, The Lisle Company, 6900 Schomburg Road, presented his appeal for a

variance to increase the allowable area of a ground sign from 15 square feet to

60 square feet and to allow a 2nd sign painted on a building, 1 sign allowed.

The property is zoned R-4.



In his statement and in response to questions from the Board Members,

Mr. Lisle gave the following information: They have a monument sign that

identifies the name of the development and the other sign is the painted logo

Sugar Mill on the side of the building. It is affected by the zoning of this

property, but it is the same as Mr. George did at Hamilton Station.



There was no opposition presented to this appeal.



Mr. King made a motion, which was seconded by Mr. Lewis, to grant this

appeal to increase the allowable area of a ground sign from 15 square feet to

60 square feet and to allow a 2nd sign painted on a building. Motion carried

by the affirmative vote of the four Board Members present for this meeting.

applicant gave the following information: She has been in business since 1999,

she moved to a different residence. She will be using one room in her home as

an office only. There will be no items stored at her home. She will have no

employees and there will be no additional traffic in the neighborhood. This

Certificate of Occupancy for a Home Occupation for an office only for selling

clothes, shoes, handbags and jewelry (sold away from the home), J & S

Clothing. The property is zoned R-2.



In their statements and in response to questions from the Board Members, the

applicants gave the following information: They will be using one room in

their home as an office only. They will have no employees and there will be no

additional traffic in the neighborhood. This will be part time work. The

items will be sold at flea markets.

Mr. Edwards made a motion, which was seconded by Mr. Lewis, to grant this

application because it does meet the intent of the Home Occupation definition.
