An Ordinance amending the Zoning Atlas of the Consolidated Government
of Columbus, Georgia; this amendment changes certain boundaries of a district
located at the north side of St. Mary?s Road, bordered by Fort Benning, from
SFR2 (Single Family Residential 2) District to RMF1 (Residential Multi-Family
1) District.
THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY ORDAINS:
That the Zoning Atlas on file with the Planning Division of the
Department of Community and Economic Development be, and the same is hereby
amended by changing the following described property from SFR2 (Single Family
Residential 2) District to RMF1 (Residential Multi-Family 1) District:
All that tract or parcel of land lying and being in the City of Columbus,
Muscogee County, Georgia, and being Part of Land Lot 3 in the 7th District and
Part of Land Lots 16 and 17 in 9th District, being more particularly described
as follows:
To reach the Point of Beginning, commence at the point of intersection of Land
Lots 15, 16, 17 and 18 in the 9th District; thence north 89 degrees 26 minutes
13 seconds east a distance of 375.46 feet to an iron stake; thence north 89
degrees 25 minutes 49 seconds east a distance of 254.91 feet to an iron stake
which marks the Point of Beginning; from said Point of Beginning thence north
89 degrees 25 minutes 49 seconds east a distance of 455.08 feet to a concrete
monument; thence north 89 degrees 26 minutes 19 seconds east a distance of
750.04 feet to a concrete monument; thence north 89 degrees 26 minutes 19
seconds east a distance of 75.69 feet to the center line of Tiger Creek; thence
meandering southerly along the center line of Tiger Creek 4,064.0 feet, more or
less, to the intersection of the center line of Tiger Creek and the northerly
margin of St. Mary?s Road; thence north 73 degrees 02 minutes 07 seconds west a
distance of 10.45 feet to an iron stake thence north 73 degrees 02 minutes 07
seconds west a distance of 332.54 feet to an iron stake; thence westerly along
a curve on the north margin of St. Mary?s Road, which curve has a radius of
2,834.93 feet, a distance of 716.62 feet to an iron stake; thence north 58
degrees 41 minutes 30 seconds west a distance of 1,188.69 feet to an iron
stake; thence westerly along a curve on the northern margin of St. Mary?s Road,
which curve has a radius of 3,849.83 feet, a distance of 331.31 feet to an iron
stake; thence north 14 degrees 21 minutes 04 seconds east a distance of
2,316.48 feet to the Point of Beginning.
The above-described property is being rezoned with the following conditions:
1. Restrictive covenants shall be required for the development.
2. A smoke disclosure statement shall be required in all home sales. The
requirement for the disclosure shall be included in the restrictive covenants
of said development. A sample smoke disclosure statement is attached to this
ordinance and a completed smoke disclosure statement shall be filed by the
developer or subsequent grantor with the Clerk of Council and the Clerk of
Superior Court.
3. A noise disclosure statement shall be required in all home sales. The
requirement for the disclosure shall be included in the restrictive covenants
of said development. A sample noise disclosure statement is attached to this
ordinance and a completed noise disclosure statement shall be filed by the
developer or subsequent grantor with the Clerk of Council and the Clerk of
Superior Court.

Introduced at a regular meeting of the Council of Columbus, Georgia held on
the 19th day of August, 2005; introduced a second time at a regular
meeting of said Council held on the day of , 2005 and adopted
at said meeting by the affirmative vote of ________ members of said
Council.
