BOARD OF ZONING APPEALS
REGULAR MEETING - 2:00 P M - AUGUST 4, 2004
The Regular Meeting of the Board of Zoning Appeals was held on
Wednesday, August 4, 2004, on the first floor of the Government Center Annex,
located at 420 10th Street. Members present were:
Mrs. Leah Braxton, Chairperson Mr. David Fox
Mr. Willie Lewis, Jr. Mr. Billy Edwards
Mr. Ralph King
Also present were Mr. Danny Cargill, Secretary of the Board, and Mrs.
Anne Thomas, Acting Recording Secretary of the Board. Ms. Aronda Smith was
present as the representative of the Planning Department.
Mr. King made a motion, which was seconded by Mr. Lewis, to approve the Minutes
of the Monthly Meeting, which was held on July 7, 2004. Motion carried
unanimously.
CASES TABLED FROM THE JULY 7th MEETING.
CASE NO. 04-HO 170: Denied
There was no one attending the meeting to present the application of
Jonathan Cole, 7645 Crescent Drive, for a Certificate of Occupancy for a Home
Occupation for an office only for landscaping and pool maintenance, AQUASCAPES.
The property is zoned R-1A.
There was no opposition presented to this application.
Mr. Fox made a motion, which was seconded by Mr. Edwards to deny this
application because of lack of interest since the applicant did not attend two
consecutive meetings to present his case. Motion carried unanimously.
CASE NO. 04-HO172: Approved - N.V.S.
Mr. Ben Baxter, 6012 Old Dominion Road, presented his application for a
Certificate of Occupancy for a Home Occupation for an office only for selling
safety supplies, Safety Vend. The property is zoned R-2.
In his statement and in response to questions by the Board Members, Mr.
Baxter gave the following information: His business will consist of making
sales via the internet for equipment to keep people safe on their jobs. This
will be full time work for him; there will be no additional traffic in the
neighborhood; and, he will have no employees.
There was no one present who objected to this application.
Mr. King made a motion, which was seconded by Mr. Edwards to grant this
application because it meets the criteria as set forth in the Home Occupation
Ordinance. Motion carried unanimously.
CASE NO. 04-HO173: Denied
There was no one attending the meeting to present the application of
Anthandus Beauford, 915 Washington Avenue, for a Certificate of Occupancy for a
Home Occupation for an office only for selling fraternity & sorority gift items
and clothing, (these will not be sold from the home), The College Greek House.
The property is zoned R-3.
There was no one present who opposed this application; however, the
manager of the property, Mr. Jack Land, wrote a letter objecting to the use of
the house for a Home Occupation, even though the applicant's grandmother, who
rents the property, had written a letter giving him permission to work out of
one room of the house. Also, there was a letter from an adjacent property
owner, Mr. Frank Turman, who objected because this will bring more traffic into
the neighborhood.
Mr. Lewis made a motion, which was seconded by Mr. Fox, to deny this
application because of lack of interest since the appellant did not attend two
consecutive meetings to present his case and because of the opposition that was
presented. Motion carried unanimously.
CASE NO. 04-HO177: Denied.
There was no one attending the meeting to present the Application of
Kelly P. White, 429 Cheyenne Road, for a Certificate of Occupancy for a Home
Occupation for an office only for an accounting and tax service, Kelly P.
White, LLC. The property is zoned A-1.
There was no opposition presented to this application.
Mr. Lewis made a motion, which was seconded by Mr. Fox, to deny this
application because of lack of interest since the appellant did not attend two
consecutive meetings to present his case. Motion carried unanimously.
CASE NO. 04-HO184: Denied.
There was no one attending the meeting to present the Application of
Alberto Mejia Lopez, 800 Morris Road, Lot #67, for a Certificate of Occupancy
for a Home Occupation for an office only for a brick layer business. MUSA.
The property is zoned M-1.
There was no one present who opposed this application; however, the
manager of the trailer park, Mr. W. Mercer Morris, Jr., had sent a list of the
rules and regulations of the trailer park which prevented any commercial
activity. Mr. Morris did not know Tammy S. Adams, who had written a letter
giving Mr. Lopez permission to use her property to carry out his business.
Mr. Lewis made a motion, which was seconded by Mr. Fox, to deny this
application because of lack of interest since the appellant did not attend two
consecutive meetings to present his case and because of the opposition of the
manager. Motion carried unanimously.

VARIANCES
CASE NO. 04-V87: Approved
John Morrison of John Morrison Construction presented the appeal of Dr.
Vincent Nicolais, 5110 Midland Trace, for a variance to reduce the rear yard
setback requirement from 40 feet to 32 feet, in order to make an addition of a
living room and a garage to an existing single family residence. The property
is zoned A-1.
In his statement and in response to questions by the Board Members, Mr.
Morrison gave the following information: They will use materials that match
the existing house. There is a 10-foot grade drop off in the rear of the lot.
There was no one present who objected to this application.
Mr. King made a motion, which was seconded by Mr. Edwards to approve
this appeal because the materials will match; this is an odd shaped lot; and
there was no opposition from the neighbors. Motion carried unanimously.
CASE NO. 04-V88: Denied
Charles Thomas, 7805 Veterans Parkway, presented his appeal for a variance to
reduce the required setback inside the property line from 3 feet to 2 inches,
in order to erect a portable sign, 4 feet X 8 feet, to advertise Charles & Di
Antique Shop. The property is zoned C-3.
In his statement and in response to questions by the Board Members, Mr.
Thomas gave the following information: He is asking for a variance on his shop
sign from 3? to 2? to advertise his business ?Charles & Di Antiques?. He has
rented this sign for over 12 years from a sign rental company. He decided to
buy his own sign and put it in the same spot. The Sign Inspector told him the
sign must be 3 feet from the property line and it has been reduced to 3 feet 4
inches. This is a heavily sloped lot. To put it at 3 feet would have one end
standing on its side. The sign is 6 feet 10 inches outside the property line.
The posts have already been erected.
There was no one present who objected to this application.
Mr. Edwards made a motion, which was seconded by Mr. King to deny this
appeal since the appellant has other options as to where he can place his
signs. Motion carried unanimously.
CASE NO. 04-V89: Approved
David Fox presented the appeal of Pinnacle Homes, Inc., 6016 Hunter
Road, for a variance to reduce the side corner yard setback requirement of a
corner lot from 25 feet to 19.5 feet, in order to erect a single family
residence, 49' X 40' X 24'. The property is zoned R-2.
Mr. Fox stepped down as a Board Member and stated that he would abstain
from voting since he is employed by Pinnacle Homes. In his statement and in
response to questions by the Board Members, Mr. Fox gave the following
information: All lots along this road on the corners have a setback of 25 feet
on the rear and on the sides. They have a contract to build on this lot. The
lot is relatively flat. They bought this lot because it was a flat lot on the
street side. The encroachment is 5 feet.
When the Chairperson asked for any objections, Mrs. Sara Daniel, 6000
Hunter Drive, came forward. She stated that when Pinnacle Homes first started
working in this neighborhood she gave them permission to cross her lot and
driveway with their equipment. The driveway and shrubbery were damaged. She
would like for her property to be repaired before they do anything else. Her
husband died only a few months ago and she has no one to fight for her.
Mr. Edwards asked Mrs. Daniel what her objection is; He told her that
the Board can deal only with the variance that has been requested. Mrs. Daniel
replied that she will get a chair and sit there with a sign that reads, "You
are a fool if you buy this lot." Mr. Fox assured her that before the house is
completed her property will be repaired. Mr. Lewis assured her that she will
be taken care of. As Mrs. Daniel left the front, the audience gave her a loud
round of applause.
Mr. Edwards made a motion, which was seconded by Mr. King to approve
this appeal because these are small lots and would probably need a variance in
order to develop them. Motion carried unanimously by the four members who
voted. Mr. Fox abstained from voting and left the room prior to the discussion
of the other board members concerning this case.
CASE NO. 04-V90: Approved
Howard F. Pound, 2835 Roswell Lane, presented his appeal for a variance
to reduce the rear yard setback requirement from 30 feet to 25 feet, in order
to make an addition of a garage and other additions to a single family
residence. The property is zoned R-1A.
In his statement and in response to questions by the Board Members, Mr.
Pound gave the following information: This is his home; the 25-foot setback
has been existing for 40 years; the back corner is the only part of the lot
that requires a variance.
There was no one present who objected to this application.
Mr. King made a motion, which was seconded by Mr. Fox to approve this
appeal because the back of the existing house already has a 25-foot setback and
it has caused no problems. Motion carried unanimously.
CASE NO. 04-V91: Approved
Mr. Wright Wade, 5604 Dearborn Avenue, Lot #1, presented his appeal for
a variance to reduce the side yard setback requirement of a corner lot from 25
feet to 20 feet, and to reduce the lot area requirement from 7500 square feet
to 6400 square feet, in order to erect a single family residence. This appeal
is pending the repeat and rezoning of this property from R-1 to R-2.
In his statement and in response to questions by the Board Members, Mr.
Wade gave the following information: Planning Division has recommended the
approval of this variance. Also, they have had the survey changed to reduce
the lot area from 7500 square feet to 6,215 square feet, instead of the 6,400
square feet, which was originally requested. This is a corner lot and no one
owns the property next door since this is a City right-of-way.
There was no one present who objected to this application.
Mr. Fox made a motion, which was seconded by Mr. Edwards to approve
this appeal because the City right-of-way encroachment makes this a
sub-standard lot and they do have the approval of the Planning Division.
Motion carried unanimously.
CASE NO. 04-V92: Denied
Ben Moon presented the appeal of Ronald Edwards, 9520 Whitesville Road,
for a variance to reduce the width lot from the required 125 feet to 25 feet,
in order to erect 2 single family residences. This appeal is pending the
replat of this property. The property is zoned A-1.
Mr. Edwards stepped down as a Board Member and stated that he would
abstain from voting since he is employed by Ronald Edwards Construction
Company, Inc.
In his statement and in response to questions by the Board Members, Mr.
Moon gave the following information: These lots are 3.1 acre lots which they
wish to divide to make two lots from each one. Planning Division has
recommended denial of this appeal. A letter from Planning was presented, added
to the file, and making it a part of these minutes.
When the Chairperson asked for any objections, ten people came forward. They
were as follows: Ms. Eileen Oravic, 9515 Whitesville Road, Mr. Jasper Woodham,
9448 Whitesville Road, Mrs. Gail Woodham, 9448 Whitesville Road, Mr. Barry
Johnson, 9437 Whitesville Road, Mr. Bob Williams, 9409 Whitesville Road, Mr.
Gary Cummings, 9635 Whitesville Road, Mr. George Bullard, 9406 Whitesville
Road, Mrs. Dorothy Bishop, 9700 Whitesville Road, Mr. Ray Minalski, 9520
Whitesville Road, and Mrs. Bonner, 9520 Whitesville Road, came forward. Some
of the reasons these 10 people objected to this appeal included the following:
They all have large lots, which they bought because of the country atmosphere
and open space. The current residents all have at least 3.1 acre lots and some
of them have more acreage so they can have horses and donkeys. They want this
to remain agricultural. If this is approved, they will no longer have the
country atmosphere. If it is approved, it will set a precedent for others to
make this same appeal for another lot.
Mr. King made a motion, which was seconded by Mr. Lewis to deny this
appeal because this would create a flag lot, and because of the strong
objections of the neighbors. Motion carried unanimously.
CASE NO. 04-V93: Approved
David Jacobs, Pastor, presented the appeal of Calvary Assembly of God
Church, 8100 Cooper Creek Road, for a variance to increase the allowable size
of a sign from the maximum requirement of 15 square feet to 32 square feet.
The sign will measure 8 feet by 4 feet. The property is zoned R-1.
In his statement and in response to questions by the Board Members, Mr.
Jacobs gave the following information: Because of the location they need a
larger sign that can be more easily seen from the road.
There was no one present who objected to this appeal.
Mr. Fox made a motion, which was seconded by Mr. King to grant this
appeal to increase the size of the sign because there is a lot of traffic in
this area and a lot of school signs. There was no opposition. Motion carried
unanimously.
CASE NO. 04-V94: Approved
Robert Teasley, Signs Inc., presented the appeal of North Columbus Eye
Center, 7351 Old Moon Road, from a Decision of the Building Official that a
second sign is not allowed for one business. The property is zoned A-0.
In his statement and in response to questions by the Board Members, Mr.
Teasley gave the following information: They are requesting permission to have
two signs instead of the one sign allowed by the Sign Ordinance. The Sign
Ordinance allows one sign of no more than 150 square feet, with a maximum
height of 20 feet, which is the requirement of a sign in an A-O zoning
district. With the second sign they would have a total of 215 square feet.
Their hardship is the distance of the sign from Moon Road. The
southbound traffic is unable to see the current sign and A-O zoning only allows
one sign. They are requesting permission for two signs, which will give them a
total of 215 square feet in signage.
There was no one present who objected to this appeal.
Mr. King made a motion, which was seconded by Mr. Edwards to grant this
appeal even though the Building Official is correct in his decision. This is a
unique case and the second sign would not be more than the 20 feet maximum
height and the total square footage would be only 215 square feet. Motion
carried unanimously.
CASE NO. 04-V95: Tabled
Robert Teasley, Signs, Inc., presented the appeal of Greater Beulah
Baptist Church, 613 Sixth Avenue, from a Decision of the Board of Historic and
Architectural Review to deny approval of a sign that is not in keeping with the
Historic District guidelines. The property is zoned C-3.
Mr. Walter Jones and Mr. Freddie Blackmon Jr., were also in attendance
as representatives of the church.
In their statements and in response to questions by the Board Members,
the three men gave the following information: They are willing to work with
BHAR in regards to the size of a sign, which they would approve. He brought
out the fact that the Liberty Garden Apartments do not meet the requirements of
BHAR. The church needs to have a sign, which will communicate to their members
and to the community.
Mr. Sean Boles, Secretary of BHAR and a City Planner, stated that a
sign in The Historic District should be no more than 12 square feet. The
modern sign of the size that they want to erect would not be suitable for this
area. Mr. Boles continued by stating that they could change the materials of
the sign to meet the requirements of BHAR.
After further discussion, Chairperson Leah Braxton stated that the
Board could at this time vote ?no? to deny this appeal or they could table this
case for 30 days. That would give the church and the sign company time to
adjust the size and the materials to something on which everyone could agree.
There was no one present who objected to this application.
Mr. Edwards made a motion, which was seconded by Mr. Lewis to table
this appeal until the September meeting, in order for Mr. Teasley and the
church to alter their plans so they would be acceptable and in compliance.
Motion carried unanimously.

HOME OCCUPATIONS.
CASE NO. 04-HO199: Approved N.V.S.
Mr. Larry D. Jackson, 5032 Delray Drive, presented his Application for
a Certificate of Occupancy for a Home Occupation for an office only for a brick
layer business, J's Construction. The property is zoned R-1A.
In his statement and in response to questions by the Board Members, Mr.
Jackson gave the following information: His business will consist of his
laying brick for general contractors. All of his equipment and materials will
be stored on the job. When asked if this would be full or part time work, he
replied that it would be double time if he could get the work. There will be
no additional traffic in the neighborhood, and he will have no employees.
There was no one present who objected to this application.
Mr. Edwards made a motion, which was seconded by Mr. King, to grant
this application because it meets the criteria as set forth in the Home
Occupation Ordinance. Motion was made with the stipulation that there be no
visible storage of materials or equipment at the home. Motion carried
unanimously.
CASE NO. 04-HO200: Approved N.V.S.
Cindy Foxworth, 5536 Hodges Drive, presented her application for a
Certificate of Occupancy for a Home Occupation for an office only for a house
painting business, Foxworth Paint Contractors, Inc. The property is zoned R-1.
In her statement and in response to questions by the Board Members, Ms.
Foxworth gave the following information: She owns the business and her husband
runs it. This will be full time work for them; there will be no additional
traffic in the neighborhood; and, they will have no employees. The
sub-contractors will be given 1099 forms at the end of the year, and they will
carry workmen's compensation insurance on the sub-contractors.
There was no one present who objected to this application.
Mr. Fox made a motion, which was seconded by Mr. King to grant this
application because it meets the criteria as set forth in the Home Occupation
Ordinance. Motion was made with the stipulation that there be no visible
storage of materials or equipment at the home. Motion carried unanimously.
CASE NO. 04-HO201: Approved N.V.S.
Mr. Jesse Lee Ogletree, 948 Celia Drive, presented his Application for
a Certificate of Occupancy for a Home Occupation for an office only for a
cleaning service, Mr. Clean. The property is zoned R-1A.
In his statement and in response to questions by the Board Members, Mr.
Ogletree gave the following information: This will be part time work for him;
there will be no additional traffic in the neighborhood; and, he will have no
employees. He added that he has a storage room in which he keeps his equipment
and his regular household type cleaning products.
There was no one present who objected to this application.
Mr. King made a motion, which was seconded by Mr. Edwards to grant this
application because it meets the criteria as set forth in the Home Occupation
Ordinance. Motion carried unanimously.
CASE NO. 04-HO202: Tabled
Mr. Chris Coates attended the meeting to present the Application of
Doug Duncan, 5080 Grandtree Court, for a Certificate of Occupancy for a Home
Occupation for an office only for a lawn care service, All Seasons Lawn and
Landscape. The property is zoned A-1.
In his statement and in response to questions by the Board Members, Mr.
Coates gave the following information: This will be part time work for Mr.
Duncan; there will be no additional traffic in the neighborhood; and, he will
have no employees. He added that Mr. Duncan is presently storing his equipment
at Mr. Coates' home. When asked if Mr. Duncan will be doing landscaping, Mr.
Coates replied that it will mostly be cutting and maintenance of lawns.
There was no one at the meeting who voiced any objections to this
application.
Mr. Fox made a motion, which was seconded by Mr. Edwards to table this
application until September 1st because the applicant did not come to the
meeting, and his representative seemed unsure about some of the questions.
Motion carried unanimously.
CASE NO. 04-HO203: Approved N.V.S.
Mrs. Willie M. Hunter, 5920 Mill Branch Road, presented her Application
for a Certificate of Occupancy for a Home Occupation for an office only for a
cleaning service, Hunter's Cleaning, Etc. The property is zoned R-2.
In her statement and in response to questions by the Board Members,
Mrs. Hunter gave the following information: This will be part time work for
her; there will be no additional traffic in the neighborhood; and, she will
have no employees. She added that there will be no storage of strong chemicals,
but only her regular household type cleaning products.
There was no one present who objected to this application.
Mr. King made a motion, which was seconded by Mr. Edwards to grant this
application because it meets the criteria as set forth in the Home Occupation
Ordinance. Motion carried unanimously.
CASE NO. 04-HO204: Approved
William P. Massey, 8851 Moore Road, Lot #1, presented his application
for a Certificate of Occupancy for a Home Occupation for an office only for a
private practice of social work, Bill Massey, LCSW. The property is zoned A-l.
In his statement and in response to questions by the Board Members, Mr.
Massey gave the following information: This will be full time work for him;
there will be no additional traffic in the neighborhood; and, he will have no
employees. He does social work for St. Francis Hospital, and goes to about six
different locations that they set up.

Mr. King made a motion, which was seconded by Mr. Edwards to grant this
application because it meets the criteria as set forth in the Home Occupation
Ordinance. Motion was made with the stipulation that there be no visible
storage of materials or equipment at the home. Motion carried unanimously.
CASE NO. 04-HO205: Approved N.V.S.
William T. Stewart, 8478 Liberty Hall Drive, presented his application
for a Certificate of Occupancy for a Home Occupation for an office only for a
landscape and sprinkler contractor, Bill Stewart Landscape & Sprinkler Company.
The property is zoned A-1.
In his statement and in response to questions by the Board Members, Mr.
Stewart gave the following information: His business will consist of
installing residential sprinklers; He will rent any equipment he might need,
and will also rent a storage area for his equipment and materials. This will
be full time work for him; there will be no additional traffic in the
neighborhood; and, his only employee will be his son who lives with him.
There was no one present who objected to this application.
Mr. King made a motion, which was seconded by Mr. Edwards to grant this
application because it meets the criteria as set forth in the Home Occupation
Ordinance. Motion was made with the stipulation that there be no visible
storage of materials or equipment at the home. Motion carried unanimously.
CASE NO. 04-HO206: Approved N.V.S.
William A. Renfro, III, 3638 Stratford Drive, presented his application
for a Certificate of Occupancy for a Home Occupation for an office only for a
moving and delivery business, East Wynnton Movers. The property is zoned R-2.
In his statement and in response to questions by the Board Members, Mr.
Renfro gave the following information: His business will consist of moving
household furniture and will be conducted from his pickup truck. He will not
have a big truck. This will be part time work for him; there will be no
additional traffic in the neighborhood; and, he will have no employees.
There was no one present who objected to this application.
Mr. King made a motion, which was seconded by Mr. Edwards to grant this
application because it meets the criteria as set forth in the Home Occupation
Ordinance. Motion was made with the stipulation that there be no visible
storage of materials or equipment at the home. Motion carried unanimously.
CASE NO. 04-HO207: Approved
Tania C. Edwards, D.O., 8388 Ridge Creek Court, presented her
application for a Certificate of Occupancy for a Home Occupation for an office
only to contract with hospitals and medical offices as a physician,
Chattahoochee Valley Family Medicine, Inc. The property is zoned R-1A.
In her statement and in response to questions by the Board Members, Ms.
Edwards gave the following information: Her business will consist of making
house calls on behalf of other doctors and hospitals. She deals mostly with
holistic treatments and with manipulations. This will be full time work for
her; there will be no additional traffic in the neighborhood; and, she will
have no employees.
There was no one present who objected to this application.
Mr. King made a motion, which was seconded by Mr. Edwards to grant this
application because it meets the criteria as set forth in the Home Occupation
Ordinance. Motion carried unanimously.
CASE NO. 04-HO208: Approved
Ms. Cathy Miller, 2860 Jeannie Drive, presented her application for a
Certificate of Occupancy for a Home Occupation for an office only for the sale
of accessories, Precious Purses. The property is zoned R-1.
In her statement and in response to questions by the Board Members, Ms.
Miller gave the following information: Her business will consist of
advertising, making purses for teenagers, and making sales via consignment to
gift shops; there will be no additional traffic in the neighborhood; and, she
will have no employees.
There was no one present who objected to this application.
Mr. King made a motion, which was seconded by Mr. Edwards to grant this
application because it meets the criteria as set forth in the Home Occupation
Ordinance. Motion carried unanimously.
CASE NO. 04-HO209: Approved
Jeffers L. Smith, 35 Middleton Place, presented his application for a
Certificate of Occupancy for a Home Occupation for an office only for the sale
of gifts, whatnots, pictures, and small gift items, Smitty Smith 4 Gift. The
property is zoned R-1A.
In his statement and in response to questions by the Board Members, Mr.
Smith gave the following information: His business will consist of making
small gift items to sell at flea markets, art fairs, and via the internet.
This will be full time work for him and his wife; there will be no additional
traffic in the neighborhood; and, they will have no other employees. He will
buy his products through a web site; they will not conduct home shows; and they
have two storage buildings in which to store their products.
There was no one present who objected to this application.
Mr. King made a motion, which was seconded by Mr. Edwards to grant this
application because it meets the criteria as set forth in the Home Occupation
Ordinance. Motion carried unanimously.
CASE NO. 04-HO210: Tabled and then Withdrawn.
There was no one in attendance to present the Application of Ernest
Williams, 1466 Rochester Avenue, for a Certificate of Occupancy for a Home
Occupation for an office only for making videos and DVD's on tips for hunting
safety and training pointing dogs, Pointing Gun Dogs and Safety on DVD. The
property is zoned R-2.
There was no one present who objected to this application.
Mr. King made a motion, which was seconded by Mr. Edwards to table this
application until next month since Mr. Williams was not present to present his
appeal. Motion carried unanimously.
On August 17, 2004, Mr. Williams called the office of Inspections and
Code and told Dispatcher Sandy Wilson that he wishes to withdraw his case, and
will not attend the September 1st meeting.
CASE NO. 04-HO211: Denied
There was no one in attendance to present the Application of Sean C.
DeLoatch, 2001 Torch Hill Road, Apt. #11-D, for a Certificate of Occupancy for
a Home Occupation for an office only for the Internet sales of shoes and
clothing, and for retail sales at flea markets and bazaars, Java Clothing Shoe
Wear. The property is zoned R-4.
There was no one who attended and who objected to this Home
Occupation. However, upon checking on the Owner's Letter of Permission for the
business to be operated from this apartment, it was discovered that Mr.
DeLoatch's father had written the letter because the apartment is rented in his

In his statement and in response to questions by the Board Members, Mr.
Young gave the following information: His business will consist of processing
loans, going to the customers, getting bids, and brokering the loans through
other companies. This will be full time work for him; there will be no
additional traffic in the neighborhood; and, he will have no employees.
When the Chairperson asked for any objections, three people came
forward. They were William I. Hepburn, 5485 East Brook Lane, Robert Day, 5496
East Brook Lane, and Mrs. Rosa Day, 5496 East Brook Lane. Their complaints
included the fact that there is lots of traffic all during the night to Mr.
Young's house; a lot of people go and come to and from his house; there are a
lot of cars parked in front and in back of his house; he has an ice cream truck
parked there; and the property is an eyesore to the neighborhood. There is
some type of business going on there now, and they would like to keep their
neighborhood as a decent place to live. Mr. Hepburn has lived there 35 years
and Mr. and Mrs. Day have lived there 20 years. There are about thirty other
homeowners who would object, but they did not get a petition signed.
Mr. Edwards made a motion, which was seconded by Mr. Fox to deny this
application because of the increased traffic and the opposition presented by
three of the neighbors. Motion carried unanimously.

Mary Lynne Bohannon, 7112 W. Wynfield Loop, presented her application
for a Certificate of Occupancy for a Home Occupation for an office only for a
