A RESOLUTION AMENDING RESOLUTION NO. 125-05, SO AS TO INCLUDE THE
CORRECTED LEGAL DESCRIPTION, DECLARING THAT THERE IS A NEED AND NECESSITY TO
IMMEDIATELY ACQUIRE TITLE AND EASEMENTS TO LANDS UNDER THE PROVISION OF THE
OFFICIAL CODE OF GEORGIA ANNOTATED, AUTHORIZING THE MAYOR TO ORDER THE
ACQUISITION OF SAID LANDS FOR COUNTY ROAD AND/OR MUNICIPAL STREET PURPOSES, AND
AUTHORIZING THE FILING OF A DECLARATION OF TAKING BY THE CITY ATTORNEY OR HIS
REPRESENTATIVES FOR THE ACQUISITION OF SAID LANDS UNDER THE AUTHORITY OF THE
OFFICIAL CODE OF GEORGIA ANNOTATED, SECTION 32-3-1, ET. SEQ.
WHEREAS, it is hereby determined that the circumstances in connection
with acquiring right-of-way for the Whitesville/Williams Road Intersection
Project are such that it is necessary to immediately acquire the fee simple
title, state, interest, and/or easements in the following described property,
to-wit:
All that tract or parcel of land lying and being in Land Lot 273 of the 19th
District of Muscogee County, Georgia, and being more particularly described as
follows:
BEGINNING at a point marking the existing southerly Right-of-Way of Williams
Road (60 foot R/W) with the existing westerly Right-of-Way of Williams Way (60
foot R/W), thence S 46?04'14" W, 42.24 feet to a point on the existing
westerly Right-of-Way of the Williams Way, thence along an arc for a distance
of 54.06 feet to the Left, having a radius of 241.51 feet, the chord of which
is S 39?39'32" W, 53.95 feet to a point marking the intersection of the
existing westerly Right-of-Way of Williams Way and the westerly required
Right-of-Way of the Williams Way, thence N 27?55'52" E, 89.90 feet to a point
on the southerly required Right-of-Way of the Williams Road, thence N 41?35'04"
W, 196.66 feet to a point on the southerly required Right-of-Way of the
Williams Road, thence N 84?23'47" W, 32.78 feet to a point on the southerly
required Right-of-Way of the Williams Road, thence N 45?51'28" E, 22.90 feet to
a point on the existing southerly Right-of-Way of the Williams Road, thence S
44?52'38" E, 16.24 feet to a point on the existing southerly Right-of-Way of
the Williams Road, thence S 44?03'06" E, 227.24 feet to a point marking the
intersection of the existing southerly Right-of-Way of Williams Road and the
existing westerly Right-of-Way of the Williams Way, and being the POINT OF
BEGINNING.
The above described required parcel contains 0.058 acres( 2534.16 square feet).
Also to be acquired is the right to a temporary construction and maintenance
easement of slopes, which easement shall terminate upon completion and
acceptance of the Project by Columbus, Georgia, all as shown colored green on a
plat filed in the Office of the Highway Coordinator of Columbus, Georgia. Such
temporary construction and maintenance easement contains 1787.40 square feet.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS
FOLLOWS:
1.
That there is a necessity for the immediate acquisition of said
property under the provisions of the Official Code of Georgia Annotated
?32-3-1, et. seq. Resolution No. 125-05 is hereby amended to reflect the entire
legal description contained in this Resolution.
2.
That the Mayor, City Manager and CityAttorney or their designee are
hereby authorized to issue such orders and file such papers in the courts and
enter into such agreements as he deems necessary for the immediate acquisition
of said property by condemnation under the provisions of said Act.
3.
That the immediate acquisition of such land and property interests is
for county roads, municipal streets or public highway purposes.
4.
That the Mayor, City Manager and City Attorney or their designee are
hereby authorized to take any and all lawful actions that they may deem
needful, necessary, advisable, or proper for the immediate acquisition of said
property pursuant to and in accordance with the provisions of the Official Code
of Georgia Annotated ?32-3-1, et. seq.
5.
That in accordance with an investigation and report made to the Council
of Columbus, Georgia by competent land appraiser, the estimated value as just
and adequate compensation to be paid for the acquisition is hereby determined
and approved and the sums are authorized to be paid into Court the use of the
persons entitled thereto.
