A RESOLUTION AUTHORIZING A RESOLUTION DECLARING THAT THERE IS A NEED AND

NECESSITY TO IMMEDIATELY ACQUIRE TITLE AND EASEMENTS TO LANDS UNDER THE

PROVISION OF THE OFFICIAL CODE OF GEORGIA ANNOTATED, AUTHORIZING THE MAYOR TO

ORDER THE ACQUISITION OF SAID LANDS FOR COUNTY ROAD AND/OR MUNICIPAL STREET

PURPOSES, AND AUTHORIZING THE FILING OF A DECLARATION OF TAKING BY THE CITY

ATTORNEY OR HIS REPRESENTATIVES FOR THE ACQUISITION OF SAID LANDS UNDER THE

AUTHORITY OF THE OFFICIAL CODE OF GEORGIA ANNOTATED, SECTION 32-3-1, ET. SEQ.





WHEREAS, it is hereby determined that the circumstances in connection with

acquiring right-of-way for the Whitesville/Williams Road Intersection Project

are such that it is necessary to immediately acquire the fee simple title,

state, interest, and/or easements in the following described property, to-wit:



Parcel 2:

Tract 1:

All that tract or parcel of land lying and being in Land Lot 273 of the 19th

District of Muscogee County, Georgia, and being more particularly described as

follows:



BEGINNING at a point marking the existing westerly Right-of-Way of Whitesville

Road (60 foot R/W) with the existing northerly Right-of-Way of Briarlock Road,

thence N 77?06'57" W, 35.63 feet to a point on the northerly required

Right-of-Way of the Briarlock Road, thence N 59?53'40" E, 45.64 feet to a point

on the existing westerly Right-of-Way of Whitesville Road, thence S 8?45'33" W,

31.20 feet to a point marking the intersection of the existing westerly

Right-of-Way of Whitesville Road and the existing northerly Right-of-Way of the

Briarlock Road, and being the POINT OF BEGINNING.



The above described required Parcel 2, Tract 1contains 0.013 acres (554.36 sq.

ft.).



Parcel 2:

Tract 2:

All that tract or parcel of land lying and being in Land Lot 273 of the 19th

District of Muscogee County, Georgia, and being more particularly described as

follows:



COMMENCING at a point marking the existing westerly Right-of-Way of

Whitesville Road (60 foot R/W) with the existing northerly Right-of-Way of

Briarlock Road, thence along said existing westerly Right-of-Way of Whitesville

Road, N 8?45'33" E, 31.20 feet to a point on the existing westerly Right-of-Way

of Whitesville Road, N 8?45'33" E, 74.02 feet to a point on the existing

westerly Right-of-Way of Whitesville Road, and being the POINT OF BEGINNING,

thence N 7?36'30" E, 33.11 feet to a point on the westerly required

Right-of-Way of the Whitesville Road, thence S 70?28'57" E, 0.68 feet to a

point on the existing westerly Right-of-Way of Whitesville Road, thence S 8?

45'33" W, 32.98 feet to a point marking the intersection of the existing

westerly Right-of-Way of Whitesville Road and the northerly required

Right-of-Way of the Whitesville Road, and being the POINT OF BEGINNING.



The above described required Parcel 2, Tract 2 contains 10.96 sq. ft.



The above described Parcels 2, Tract 1 and Tract 2 contain 0.013 acres

(565.32 sq. ft.).

Also to be acquired is the right to a temporary construction and maintenance

easement of slopes, which easement shall terminate upon completion and

acceptance of the Project by Columbus, Georgia, all as shown colored orange on

a plat filed in the Office of the Highway Coordinator of Columbus, Georgia.

Such temporary construction and maintenance easement contains 2956.53 square

feet.



NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY RESOLVES AS FOLLOWS:



1.

That there is a necessity for the immediate acquisition of said property under

the provisions of the Official Code of Georgia Annotated '32-3-1, et. seq.



2.

That the City Manager is hereby authorized to issue such orders and file such

papers in the courts and enter into such agreements as he deems necessary for

the immediate acquisition of said property by condemnation under the provisions

of said Act.



3.

That the immediate acquisition of such land and property interests is for

county roads, municipal streets or public highway purposes.



4.

That the City Manager is hereby authorized to take any and all lawful actions

that they may deem needful, necessary, advisable, or proper for the immediate

acquisition of said property pursuant to and in accordance with the provisions

of the Official Code of Georgia Annotated '32-3-1, et. seq.



5.

That in accordance with an investigation and report made to the Council of

Columbus, Georgia by competent land appraiser, the estimated value as just and

adequate compensation to be paid for the acquisition is hereby determined and

approved and the sums are authorized to be paid into Court the use of the

persons entitled thereto.
