An Ordinance amending the Zoning Atlas of the Consolidated Government

of Columbus, Georgia; this amendment changes certain boundaries of a district

located at 5251 St. Mary?s Road from SFR2 (Single Family Residential 2)

District to SFR3 (Single Family Residential 3) District.



THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY ORDAINS:



That the Zoning Atlas on file with the Planning Division of the

Department of Community and Economic Development be, and the same is hereby

amended by changing the following described property from SFR2 (Single Family

Residential 2) District to SFR3 (Single Family Residential 3) District:



All that tract or parcel of land lying in and being part of Land Lots 16 and

17, 9th District, Columbus, Muscogee County, Georgia, and being more

particularly described as follows:



BEGIN at an iron stake marking the common corner of Land Lots 15, 16, 17, and

18, 9th District; thence North degrees 26 minutes 13 seconds East, along the

northerly line of Land Lot 17, 375.46 feet to an iron stake; thence North 89

degrees 25 minutes 49 seconds East, along the northerly line of Land Lot 17,

254.91 feet to an iron stake; thence leaving said Land Lot line, South 14

degrees 21 minutes 12 seconds West, 2,316.83 feet to an iron stake on the

northerly line of St. Mary?s Road; thence northwesterly, along the northerly

line of St. Mary?s Road, along the arc of a counterclockwise curve (radius

equals 3,849.83 feet), 197.83 feet to an iron stake; thence North 66 degrees 35

minutes 46 seconds West, along the northerly line of St. Mary?s Road, 270.17

feet to an iron stake; (the next five calls are around the perimeter of the

property of Providence Free Will Baptist Church); thence leaving St. Mary?s

Road, North 13 degrees 17 minutes 23 seconds East, 262.70 feet to an iron

stake; thence North 60 degrees 13 minutes 46 seconds West, 116.71 feet to an

iron stake; thence North 63 degrees 32 minutes 48 seconds West, 107.12 feet to

an iron stake; thence North 66 degrees 57 minutes 50 seconds West, 254.13 feet

to an iron stake; thence South 10 degrees 21 minutes 25 seconds West, 282.93

feet to an iron stake on the northerly line of St. Mary?s Road; thence North 66

degrees 35 minutes 46 degrees West, along the northerly line of St. Mary?s

Road, 94.03 feet to an iron stake; thence northwesterly, along the northerly

line of St. Mary?s Road, along the arc of a clockwise curve (radius equals

2,834.93 feet), 516.40 feet to an iron stake; thence North 56 degrees 07

minutes 58 seconds West, along the northerly line of St. Mary?s Road, 376.67

feet to an iron stake; thence leaving St. Mary?s Road, North 14 degrees 21

minutes 04 seconds East, 1,331.36 feet to an iron stake on the northerly line

of Land Lot 16; thence North 86 degrees 28 minutes 28 seconds East, along the

northerly line of Land Lot 16, 1,317.06 feet to an iron stake at the POINT OF

BEGINNING.



The above-described property is being rezoned with the following conditions:



1. Restrictive covenants shall be required for the development.



2. A smoke disclosure statement shall be required in all home sales. The

requirement for the disclosure shall be included in the restrictive covenants

of said development. A sample smoke disclosure statement is attached to this

ordinance and a completed smoke disclosure statement shall be filed by the

developer or subsequent grantor with the Clerk of Council and the Clerk of

Superior Court.





3. A noise disclosure statement shall be required in all home sales. The

requirement for the disclosure shall be included in the restrictive covenants

of said development. A sample noise disclosure statement is attached to this

ordinance and a completed noise disclosure statement shall be filed by the

developer or subsequent grantor with the Clerk of Council and the Clerk of

Superior Court.



4. One side of each lot shall have a minimum 5-foot side setback line.



5. Lots numbered 1, 2, 3, 4, 5, 56, 57, 58, 59, 60, 61, 62, 63, 64, 65, 66 and

67 as shown on the plat dated August 31, 2005 by Moon, Meeks, Mason and Vinson,

Inc. shall have at least the same width at the building line as adjacent

existing residential lots and said plat is incorporated herein by reference.

held on the 20th day of September, 2005; introduced a second time at a regular

meeting of said Council held on the ________ day of , 2005 and adopted
