An Ordinance amending the Zoning Atlas of the Consolidated Government

of Columbus, Georgia; this amendment changes certain boundaries of a district

located north of the northeast corner of Williams Road and Whitesville Road,

from A-1 (Agricultural) District to A-O (Apartment-Office) District.



THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY ORDAINS:



That the Zoning Atlas on file with the Planning Division of the

Department of Community and Economic Development be, and the same is hereby

amended by changing the following described property from A-1 (Agricultural)

District to A-O (Apartment-Office) District:



Commencing at an iron stake at the northeast corner of the intersection of

Williams Road and Whitesville Road, and running North 05 degrees 13 minutes 06

seconds East a distance of 5.92 feet to an iron stake; thence running North 01

degree 30 minutes 54 seconds East a distance of 214.55 feet to a concrete

monument that marks the point of beginning; thence running along a radius north

a distance of 338.03 feet to a concrete monument; thence running North 69

degrees 45 minutes 04 seconds East a distance of 29.92 feet to a concrete

monument; thence running North 19 degrees 47 minutes 59 seconds West a distance

of 905.60 feet to an iron stake; thence running North 86 degrees 23 minutes 27

seconds East a distance of 1,267.26 feet to an iron stake; thence running South

06 degrees 14 minutes 00 seconds West a distance of 1,016.23 feet to an iron

stake; thence running South 70 degrees 07 minutes 48 seconds West a distance of

610 feet to an iron stake; thence running North 01 degree 30 minutes 54 seconds

East a distance of 32.22 feet to a concrete monument; and thence running South

69 degrees 38 minutes 14 seconds West a distance of 249.18 feet to an iron

stake that marks the point of beginning.



The above-described property is being rezoned with the following conditions:



1. All lighting shall be deflected internally using deflector shields.

2. No external trash dumpsters / compactors shall be permitted along the

property lines bordered by the A-1 zoning district.

3. Any external trash dumpsters / compactors shall be visually obstructed by a

structure that is aesthetically similar to the proposed development.

4. Screening for air conditioners, refrigeration units, and heat pumps shall be

required for all development on the property.

5. A 100-foot wide natural undisturbed buffer shall front Whitesville Road, but

fencing and landscaping shall be permitted on the perimeter of the property

subject to rezoning and utilities shall be permitted as determined and approved

by the City Engineer. This condition shall be permanent.

6. Only one curb-cut shall be permitted on Whitesville Road.

7. If this property is not used as a nursing home which includes all present

activities and other related health services associated with the nursing home

operated by Muscogee Manor on Schatulga Road, an independent living facility,

an assisted living facility, medical offices for on-staff physicians, physical

therapy services, and a home health agency that provides services outside the

nursing home, then the property shall be rezoned back to the A-1 zoning

district by the Planning Division.
