An ordinance amending certain sections of the Columbus Code and changing

miscellaneous fees which are included in the Proposed Fee Increase Chart for

the following departments: Fire & EMS, Public Services and Parks and

Recreation, and which were recommended by the Council Budget Review Committee

for the FY04 budget.

THE COUNCIL OF COLUMBUS, GEORGIA HEREBY ORDAINS:





Section 1.

The services provided in maintaining and monitoring radio boxes on private

property connected to the municipal fire alarm monitoring system are

discontinued effective July 1, 2003. Effective July 1, 2003, this service will

no longer be provided for a monthly administrative fee. Effective July 1,

2003, Ordinance No. 92-48 is hereby repealed in its entirety.



Section 2.

Effective January 1, 2004, Section 11-20.1 of the Columbus Code is hereby

deleted in its entirety and there substituted a new Section 11-20.1 to read as

follows:

?Sec. 11-20.1 Hazardous materials permits.

(a) Definitions. For the purposes of this section:

(1) Extremely Hazardous Material means any hazardous waste or mixture of

hazardous wastes which, if human exposure should occur, may likely result in

death, disabling personal injury or serious illness caused by hazardous waste

because of its quantity, concentration, or chemical characteristics.

(2) Hazardous materials means any substance which is defined as a hazardous

material by Title III, section 302-312 of the Superfund Amendments and

Reauthorization Act of 1986, known as the Emergency Planning and Community

Right-To-Know Act.

(3) Facilities list means the list of Muscogee County sites at which hazardous

materials are used or stored, which list is published from time to time by the

Georgia Environmental Protection Division.

(4) Governmental site means any site under the direct control of the

Consolidated Government of Columbus or another state or local governmental

agency

(5) MSDS means Materials Safety Data Sheet.

(b) Permit required: fire department to notify.

(1) Department of Fire and Emergency Medical Services is to notify any person,

firm or corporation which is located at or operates any site appearing on the

facilities list and /or stores materials 10,000 pounds or greater that require

an MSDS to be maintained at the workplace and/or stores materials classified as

an extremely hazardous material 500 pounds or greater shall obtain a hazardous

materials permit from the Department of Fire and Emergency Medical Services.

The hazardous materials permit shall be valid for 12 months from the date of

issuance, and shall be posted prominently at the site appearing of the

facilities list.

(2) The Department of Fire and Emergency Medical Services shall be responsible

for notifying each person, firm or corporation subject to the requirements of

this section of its obligation, and no person, firm, or corporation shall be

required to comply with the provisions of this section unless so notified.

(c) Permit fee.

(1) No permit required by this section shall be issued unless the person, firm,

or corporation which is located at or operates the site has first paid the

Revenue Division of the Consolidated Government of Columbus, Georgia, a permit

fee of $50.00 for each material requiring a MSDS stored at the facility not to

exceed $500.00 provided, however, that no permit fee shall be charged for any

governmental site. Any person, firm, or corporation notified by the Department

of Fire and Emergency Medical Services of its obligation pursuant to this

section shall pay the permit fee to the Revenue Division of the Columbus

Consolidated Government within thirty (30) days of the date of such

notifications, and shall be issued a hazardous materials permit by the

Department of Fire and Emergency Medical Services within thirty (30) days

thereafter.

(2) The Fire and EMS Department shall provide all permit fees to the city

treasury within two business days of receipt.

(d) Inspections.

(1) Each site appearing on the facilities list shall be inspected at least once

each calendar year by the Department of Fire and Emergency Medical Services for

the conformance with the fire prevention code.?



Section 3.

Section 9-13 of the Columbus Code is hereby amended by deleting the Table of

Grave Opening and Closing Fees in its entirety and substituting a new Table of

Grave Opening and Closing Fees to read as follows:

Monday Through Friday Saturdays, Sundays and Holidays

(a) With Vault. When interments are made with a vault approved by the

superintendent of cemeteries:

(1) Infants (up to 1 year of age) $150.00 $230.00

(2) Children (1--5 years of age) 200.00 300.00

(3) Adults (includes children over 5 years of age) 450.00 550.00

(b) With Wooden Box. When interments are made without vault approved by the

superintendent of cemeteries:

(1) Infants (up to 1 year of age) 170.00 250.00

(2) Children (1--5 years of age) 220.00 320.00

(3) Adults (includes children over 5 years of age) 700.00 800.00

(c) With Ash Container. When interments are made of cremation ashes: 150.00 230.00



Section 4.

Section 13-170(a) of the Columbus Code is hereby deleted in its entirety and

there is substituted a new Section 13-170(a) to read as follows:

(a) A person (including private or non-governmental nonprofit organizations,

which are exempt from ad valorem taxes, including the Muscogee County School

District) who shall direct a vehicle into a sanitary landfill for the purpose

of dumping solid waste therein shall pay according to the following schedule:

Tipping fee schedule

Regular rate

Putrescible waste:

Less than 2,100 tons per month . . .27.50

2,100 ? 3,247 tons per month . . . 26.00

Over 3,247 tons per month . . . 25.50

Construction/demolition waste:

Per ton . . . 25.50

Inert waste:

Per ton . . . 14.00

Tires:

Per ton . . .110.00

Off-road tires:

Per ton . . . 270.00

Special handling . . . 45.00

Solid waste requiring special handling shall be charged per vehicle at the rate

designated. The following solid waste, plus any like items, as determined by

the city manager shall be classified in special handling category:

(1) Metal nuggets

(2) All liquids to include soft drinks, wine, beer and juice, the handling of

which must be scheduled 24 hours in advance by the landfill division.

(3) All animal entrails.

(4) Carpet strips and bundles.

(5) Cotton bales.

(6) Wastewater solids.

(7) Any food products or written documents that must be covered immediately,

the handling of which must be scheduled 24 hours in advance by the landfill

division.

(8) Tobacco products.

(9) Paint filters.

(10) Wire, cable, or metal bonds if consisting of more than 30 percent of the

land.

(11) All products containing asbestos.?



Section 5:

The fees attached to this Ordinance for the Public Services, Fire and EMS, and

Parks and Recreation departments are hereby adopted and shall become effective

on July 1, 2003 unless otherwise indicated.





Section 6.



All ordinances or parts of ordinances in conflict with this ordinance are

hereby repealed.





THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY ORDAINS:



WHEREAS, the fees aforementioned shall be adjusted as indicated.







THIS ORDINANCE, introduced at a regular meeting of the Council of Columbus,

Georgia, held on the day of June, 2003; introduced a second time at a

regular meeting held on the day of June, 2003 and adopted at said

meeting by the affirmative vote of members of said Council.
