SUBJECT: Alley Quit Claim Deed (Swift Spinning, Inc.)



INITIATED BY: City Manager's Office







Recommendation: Approval is requested to execute a Quit Claim Deed to

Swift Spinning, Inc., for an alley that runs south from 32nd Street between 3rd

and 4th Avenue (Veterans Parkway) and a 5 foot by 100 foot portion that abuts

the tract of land which contains Lots 15 and 16 of block 22 be abandoned (see

attached letter and map).



Background: Swift Spinning, Inc., is requesting that the City execute a

Quit Claim Deed for all rights, title and interest the City may have in the

above described alley bordering 32nd Street between 3rd and 4th Avenue

(Veterans Parkway) in Columbus, Georgia.



Analysis: The alley is located at 32nd Street between 3rd and 4th Avenue

(Veterans Parkway) in Columbus, Georgia. Written confirmation has been

received from all public utilities stating there are no active utilities

located in this alley. The Engineering Department has examined the alley and

has no objections to abandoning the alley.

Deed to Swift Spinning, Inc., for the alley located at 32nd Street between 3rd

and 4th Avenue (Veterans Parkway).







A RESOLUTION

A RESOLUTION AUTHORIZING THE EXECUTION OF A QUIT CLAIM DEED TO SWIFT SPINNING,

INC., FOR A PORTION OF THE 10 X 150 +/- FEET ALLEY THAT RUNS SOUTH FROM 32ND

STREET BETWEEN 3RD AND 4TH AVENUE (VETERANS PARKWAY) AND A 5 X 100 +/- FOOT

PORTION THAT ABUTS THE TRACT WHICH CONTAINS LOTS 15 AND 16 OF BLOCK 22 BE

ABANDONED.

WHEREAS, the City owns a 10 x 150 +/- foot unopened alley that runs

south from 32nd Street between 3rd and 4th Avenue (Veterans Parkway) and a 5 x

100 +/- foot portion that abuts the tract of land which contains Lots 15 and 16

of block 22 be abandoned.

WHEREAS, the City has no present or future use of said portions of the

alley, and;



WHEREAS, Swift Spinning, Inc., wishes to include said alley portions

with their adjoining properties, and;



WHEREAS, all public utilities have sent written confirmation stating

they have no use for this alley, and;



WHEREAS, the Engineering Department has checked the alley and approves

abandonment of said portions of the alley.

NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY

RESOLVES AS FOLLOWS:

That the City Manager is hereby authorized to execute said Quit Claim

Deed in said alley portions, which are hereby abandoned. A copy of said Quit

Claim Deed is also hereto attached and by reference made a part of this

Resolution.



Introduced at a regular meeting of the Council of Columbus, Georgia, held

the ______ day of _______________ 2002, and adopted at said meeting by the

affirmative vote of ______ members of said Council.
