The Regular Meeting of the Board of Zoning Appeals was held Wednesday, January
8, 2003 at 2:00 P.M., on the 1st Floor of the Government Center Annex, 420-10th
Street. Members present were:

CASES TABLED FROM THE DECEMBER 4TH MEETING.
Case No. 02-V183--Granted.
George Adams III, 1509 22nd Street, presented his appeal for a variance to
reduce the lot area requirement from 21,000 square feet to 20,600 square feet,
in order to add four dwelling units, 3,000 square feet lot area required per
dwelling unit. The property is zoned R-3A.
In his statement and in response to questions from the Board Members,
Mr. Adams gave the following information: He has three apartment units right
now, an existing house and a little cottage on his property. He would like to
erect four townhouse type units on the side of this property.
There was no opposition presented to this appeal.
Mr. Fox made a motion, which was seconded by Mr. Edwards, to grant this
appeal to reduce the lot area from 21,000 to 20,6000, the difference will only
be 400 square feet. This will be a nice improvement. Motion carried by the
affirmative vote of the four Board Members present for this meeting.

This applicatiion was withdrawn at the request of the applicant Richard Allen,

Alfred Hyatt, 1014 43rd Street, presented his appeal for a variance to reduce
the side yard setback requirement from 8 feet to 2 feet, in order to make an
addition, 14? 6? x 37? 5?, a carport, to a single family residence. The
property is zoned R-3A.
In his statement and in response to questions from the Board Members, Mr. Hyatt
gave the following information: For 35 years he had an old carport with a tin
roof that his father built. It was raggedy and he wants to put up a better
looking one. The carport will be over an existing pad and it will have
shingles. He will use materials that will match the house.
There was no opposition presented to this appeal.
Mr. Fox made a motion, which was seconded by Mr. Edwards, to grant this appeal
because the carport will be over an existing pad. The same materials used will
match the house. The structure is almost complete. Motion carried by the
affirmative vote of the four Board Members present for this meeting.

Charles Crutchfield Jr., 4135 Curry Street, presented his
appeal for a variance to reduce the rear yard setback requirement
from 30 feet to 12 feet, in order to make an addition, 19? x 23?,
a two car carport, to a single family residence. The property is
zoned R-1A.

In his statement and in response to questions from the Board Members, Mr.
Crutchfield gave the following information: He would like to add a two car
carport to the rear of his home. The materials used will match the house. The
water will flow to the street. He talked to his neighbor directly behind him
and he does not oppose to what he wants to do.

Mr. Fox made a motion, which was seconded by Mr. Edwards, to grant this appeal
because the addition will be in the rear of the house and it can not be seen
from the street. There was no opposition and there will not be any water
problems. Motion carried by the affirmative vote of the four Board Members
present for this meeting.
Case No. 03-V03?-Granted.
Ken Knuckles and Jason Heidgerken, presented the appeal of Oakland Plaza
Shopping Center, 1807 S. Lumpkin Road, for a variance to reduce the buffer
requirement from 5 feet to 0, in order to erect a restaurant. The property is
zoned C-3.
In their statements and in response to questions from the Board Members, Mr.
Knuckles and Mr. Heidgerken gave the following information: They represent KFC
Restaurant, who are proposing to re-develop a portion of the existing Oakland
Plaza Shopping Center. There intent in working with the developer is to be
able to develop the corner of the property with minimum disturbance to the rest
of their development eliminating as few parking spaces as possible and
certainly trying to minimize disruption to the rest of the tenants and the
shopping center. They will try to hold the existing paving and curbing that
exists along both South Lumpkin and Avondale and work from that point out. The
initial submission that was made had two requests on it. One was for a waiver
for the buffer and the other one was for a waiver for the street tree
requirements. Since the application has been made they have been working with
the City Arborist to come to a compromise in order to be able to provide the
trees that the arborist is asking for. They will provide the required number
of trees that the City Arborist requires. The original plans submitted showed
57 parking spaces and the revised plan now shows 48.

Mr. Fox made a motion, which was seconded by Mr. Billingsley, to grant this
appeal contingent upon Planning?s approval. The City Arborist has agreed to
the plan that has been proposed. Motion carried by the affirmative vote of the
four Board Members present for this meeting.
Case No. 03-V04--Granted.
David Fox stepped down from the Board and presented the appeal of Pinnacle
Homes, Inc., 6012 Hunter Road, for a variance to reduce the lot area from 7,500
square feet to 6,728 square feet, to reduce the lot width from 60 feet to 55
feet and to reduce the side yard setback requirement from 8 feet to 7 feet, in
order to erect a single family residence, 40? x 56? 4?. The property is zoned
R-2.
In his statement and in response to questions from the Board Members, Mr. Fox
gave the following information: The lot has been platted and has been on
public record since 1995. When they came in to get a building permit the
Building Official let them know that the lot size wasn?t big enough, because of
that they are putting a small house on the lot. The plat that was recorded was
already previously approved by Planning. There is one undeveloped lot to the
left in the corner that is the normal size.
There was no opposition presented to this appeal.
Mr. Edwards made a motion, which was seconded by Mr. Billingsley, to grant this
appeal because the lot was replatted and approved by Planning several years
ago. This will be a nice improvement to the area. Motion carried by the
affirmative vote of the three Board Members with David Fox abstaining from the
vote.

Case No. 03-V05?-Granted.
Gail Aderhold, Action Buildings, presented the appeal of Bob Hymes, 1127
Staunton Drive, for a variance to reduce the side yard setback requirement from
8 feet to 3 feet, in order to make an addition, 11? x 24?, a carport, to a
single family residence. The property is zoned R-2.
In her statement and in response to questions from the Board Members, Ms.
Aderhold gave the following information: Mr. Hymes would like to add a carport
to his home. There are several similar carports in the area. The yard slopes
up, so the water will go to the drainage on the street.
There was no opposition presented to this appeal.
Mr. Edwards made a motion, which was seconded by Mr. Fox, to grant this appeal
because there will be no water problems and this carport seems to be consistent
with others in the neighborhood. Motion carried by the affirmative vote of the
four Board Members present for this meeting.
Case No. 03-V06?-Granted.
James Johnson presented the appeal of Columbus Housing Initiative, Inc., 2919
Baldwin Street, for a variance to reduce the lot width from 50 feet to 49.38
feet, in order to erect a single family residence. The property is zoned R-3.
Contingent upon Planning approval.
In his statement and in response to questions from the Board Members, Mr.
Johnson gave the following information: They have taken two non-conforming 25
feet lots and replatted them. Once they were replatted the frontage came up to
49.38 feet.
Planning does recommend approval of this request.

appeal contingent upon Planning?s approval. This replat is part of the

Case No. 03-V07?-Granted.
Mike Russell presented the appeal of Terry Wilson, 2018 6th Avenue, for a
variance to reduce the front yard setback requirement from 25 feet to 12 feet
and to reduce the side yard setback requirement from 12 feet to 3 feet and to
reduce the other side yard setback requirement from 12 feet to 1 foot 5 inches
and to reduce the required number of off-street parking spaces from 11 to 4, in
order to move a house (for business use). The property is zoned A-O.
In his statement and in response to questions from the Board Members, Mr.
Russell gave the following information: Terry Wilson has two houses that he is
trying to save. He wants to turn those houses around and put them back like
the neighborhood was at one time. He owns the property to the left, which is
an existing house.
John Wilson who is employed by one of the neighboring businesses is in support
of this request.
There was no opposition presented to this appeal.
Mr. Fox made a motion, which was seconded by Mr. Billingsley, to grant this
appeal because Mr. Terry Wilson is moving a house for office use. Mr. John
Wilson was in support of this request. Motion carried by the affirmative vote

Case No. 03-V08?-Granted.
Mike Russell presented the appeal of Terry Wilson, 2016 6th Avenue, for a
variance to reduce the front yard setback requirement from 25 feet to 12 feet
and to reduce the side yard setback requirement from 12 feet to 8 feet and to
reduce the other side yard setback requirement from 12 feet to 4 feet and to
reduce the required number of off-street parking spaces from 7 to 4, in order
to move a house (for business use). The property is zoned A-O. Parking and
driving easement pending approval.

David Fox stepped down from the Board and presented the appeal of Pinnacle
Homes, Inc., 4025 Shade Valley Drive, for a variance to reduce the front yard
setback requirement from 20 feet to 14 feet, in order to erect a single family
residence 44? x 55? 10?. The property is zoned R-3.
In his statement and in response to questions from the Board Members, Mr. Fox
gave the following information: This lot is the beginning of a cul-de-sac.
The only house that they were able to put on this lot is small in width &
depth. There is a steep bank in the rear yard. There will be an effective
distance between the back of the house and the retaining wall about 15 feet.
There was no opposition presented to this appeal.
Mr. Edwards made a motion, which was seconded by Mr. Billingsley, to grant this
appeal because this is an odd shaped lot in a cul-de-sac. The plans show the
best way to put the house on the lot with enough space for the rear yard.

this meeting with David Fox abstaining from the vote.

Cynthia Bowden, 3009 Chambliss Street, presented her appeal for a variance to
reduce the side yard setback requirement from 8 feet to 2 feet, in order to
make an addition, 19? x 19?, a carport, to a single family residence. The
property is zoned R-3A.
In her statement and in response to questions from the Board Members, Ms.
Bowden gave the following information: The carport is already in place. The
carport is over an existing pad. The materials used match the house. It has
gutters and the water flows to the city drainage.

Mr. Fox made a motion, which was seconded by Mr. Edwards, to grant this appeal
because the carport is already erected. It is over an existing slab and it has
been guttered. Motion carried by the affirmative vote of the four Board

Case No. 03-V11?-Granted.
John Rivers and Pastor Swinney presented the appeal of St. James AME Church,
1002 6th Avenue, for a variance to reduce the required number of off-street
parking spaces from 176 to 93, in order to make an addition, to a church. The
property is zoned M-1. (Special Exception Use Required)
In their statements and in response to questions from the Board Members, Mr.
Rivers and Pastor Swinney gave the following information: They are providing a
new addition to the existing church. The addition is being placed in the
parking lot. They are losing some spaces because of the addition, but the
church has compensated for the loss by acquiring the corner property right
behind the Royal Caf?, which will provide 15 parking spaces. Also, the church
has acquired space behind houses on 7th Avenue, which will provide an
additional 12 parking spaces. There will be a total of 27 parking spaces that
will be added back to the project site. There will also be a landscaping plan
that will meet the buffer requirements.

Case No. 03-V12?-Granted.
Todd Ammerman and Bill Dykes presented the appeal of River City Construction
Company, 101 Southern Way, for a variance to reduce the required number of
off-street parking spaces from 71 to 39, in order to make an addition, to a
retail store. The property is zoned C-3.
In their statements and in response to questions from the Board Members, Mr.
Ammerman and Mr. Dykes gave the following information: They are seeking a
variance to reduce the number of parking spaces for a proposed addition. On
the site plan they maximized what they anticipated the needs would be. They
met with engineering and there was no negative impact that they could see as
far as drainage. They maximized the size out because of the way it would
project off the face of the building. They could have saved more parking
spaces, but they would have been non-functional. There is cross parking with
the adjacent lot. The balance of the land that would lie in front of the
proposed addition would be returned to Green Space. Mr. Dykes has a furniture
store and it requires a lot of display space. This would allow him to move
some of his display area to a setting that would be more conducive to
displaying his products.

appeal because the owner thinks the number of parking spaces are sufficient for
his business. The owner has obtained additional parking at an adjacent parking

Case No. 03-V13?-Granted.
Betty Davidson, 5038 Buena Vista Road and her son Steve Davidson presented the
appeal from a Decision of the Building Official that an accessory structure is
not allowed in the front yard. The property is zoned R-1A.
In their statements and in response to questions from the Board Members, Ms.
Davidson and her son gave the following information: For 50 years they have
had a house and 5 acres. They would like to take 4 acres and possibly sell them
in the future. The property was re-surveyed and replatted. When the plat was
submitted they were told they needed a setback for the house on the right from
25 feet to 12 feet, because of the replat the accessory structure is in the
front yard.
There was no opposition presented to this appeal.
Mr. Edwards made a motion, which was seconded by Mr. Billingsley, to grant this
appeal because the accessory structure has been in the same location for about
50 years. The building existed prior to replatting the lots and met the
minimum lot requirements. Motion carried by the affirmative vote of the four
Board Members present for this meeting.
Case No. 03-V14?-Granted.
Phil Johnson presented the appeal of Hecht, Burdeshaw, Johnson, Kidd & Clark
Architects, 806 5th Avenue, for a variance to reduce the required number of
off-street parking spaces from 22 to 10, in order to erect a day car facility.
The property is zoned C-3.
In his statement and in response to questions from the Board Members, Mr.
Johnson gave the following information: They would like to change the number
of spaces from 10 to 13. They will satisfy all of the requirements for the
tree ordinance and the buffer ordinance except for an area along 8th because it
straddles the property line. They have two letters. The first letter is from
Fourth Street Daycare Center, Inc., stating, the condition to receiving the
variance to construct a drive and porte-cochere on 8th Street, if ever widened
those amenities beyond the property line will be removed at Fourth Street Day
Care Center?s expense. The second letter is from Community Reinvestment
stating, the parking will be shared by Fourth Street Towers and the occupants
of 905 5th Avenue.
