An Ordinance amending the Zoning Atlas of the Consolidated Government

of Columbus, Georgia; this amendment changes certain boundaries of a district

located at the north side of St. Mary?s Road, bordered by Fort Benning, from

SFR2 (Single Family Residential 2) District to SFR2 (Single Family Residential

2), SFR3 (Single Family Residential 3), and RMF1 (Residential Multi-Family 1)

Districts.



THE COUNCIL OF COLUMBUS, GEORGIA, HEREBY ORDAINS:



That the Zoning Atlas on file with the Planning Division of the

Department of Community and Economic Development be, and the same is hereby

amended by changing the following described property from SFR2 (Single Family

Residential 2) District to SFR2 (Single Family Residential 2) District:



Starting at the Northwest corner of Land Lot 17, 9th Land District, Columbus,

Muscogee County, Georgia go along the North line of said Land Lot 17 North 89

degrees 26 minutes 13 seconds East a distance of 375.46 feet; thence continue

along the North line of said Land Lot 17 North 89 degrees 25 minutes 49 seconds

East a distance of 254.91 feet; thence South 14 degrees 21 minutes 04 seconds

West a distance of 2265 feet, more or less, to a point 50 feet North of the

North right of way of St. Mary?s Road (60 foot right of way), as measured at

right angles thereto, also being the POINT of BEGINNING; thence continue South

14 degrees 21 minutes 04 seconds West a distance of 51 feet, more or less, to

the North right of way of St. Mary?s Road; thence Southeasterly along the North

right of way of St. Mary?s Road, as it curves, concave Southwesterly, with a

radius of 3849.83 feet, a distance of 331.31 feet; thence continue long the

North right of way of St. Mary?s Road South 58 degrees 41 minutes 30 seconds

East a distance of 1188.69 feet; thence continue Southeasterly along the North

right of way of St. Mary?s Road, as it curves, concave Northeasterly, with a

radius of 2834.93 feet, a distance of 716.62 feet; thence continue along the

North right of way of St. Mary?s Road South 73 degrees 02 minutes 07 seconds

East a distance of 342.99 feet to the centerline of Tiger Creek; thence

Northerly along the centerline meanders of Tiger Creek to a point which is 50

feet North of the North right of way of St. Mary?s Road, as measured at right

angles thereto; thence Northwesterly along a line that is parallel with the

North right of way of St. Mary?s Road a distance of 2570 feet, more or less, to

the POINT of BEGINNING.

West a distance of 715 feet, more or less, to a point 50 feet North of the

North right of way of St. Mary?s Road (60 foot right of way), as measured at

right angles thereto; thence Southeasterly along a line that is parallel with

the North right of way of St. Mary?s Road a distance of 2570 feet, more or

less, to the centerline of Tiger Creek; thence Northerly along the centerline

meanders of Tiger Creek a distance of 1050 feet, more or less, to its

intersection with the centerline of a stream; thence Northerly, Westerly, and

Southwesterly along the centerline meanders of said stream a distance of 3000

feet, more or less, to the POINT of BEGINNING.

Starting at the Northwest corner of Land Lot 17, 9th Land District, Columbus,

Muscogee County, Georgia go along the North line of said Land Lot 17 North 89

degrees 26 minutes 13 seconds East a distance of 375.46 feet; thence continue

along the North line of said Land Lot 17 North 89 degrees 25 minutes 49 seconds

East a distance of 254.91 feet to the POINT of BEGINNING; thence continue along

the North line of said Land Lot 17 North 89 degrees 25 minutes 49 seconds East

a distance of 455.08 feet; thence continue along the North line of said Land

Lot 17 North 89 degrees 26 minutes 19 seconds East a distance of 825.73 feet to

the centerline of Tiger Creek; thence Southerly along the centerline meanders

of Tiger Creek a distance of 2950 feet, more or less, to its intersection with

the centerline of a stream; thence Northerly, Westerly, and Southwesterly along

the centerline meanders of said stream a distance of 3000 feet, more or less;

thence North 14 degrees 21 minutes 04 seconds East a distance of 1550 feet,

more or less, to the POINT of BEGINNING.





The above-described property is being rezoned with the following conditions:



1. Restrictive covenants shall be required for the development.



2. A smoke disclosure statement shall be required in all home sales. The

requirement for the disclosure shall be included in the restrictive covenants

of said development. A sample smoke disclosure statement is attached to this

ordinance and a completed smoke disclosure statement shall be filed by the

developer or subsequent grantor with the Clerk of Council and the Clerk of

Superior Court.



3. A noise disclosure statement shall be required in all home sales. The

requirement for the disclosure shall be included in the restrictive covenants

of said development. A sample noise disclosure statement is attached to this

ordinance and a completed noise disclosure statement shall be filed by the

developer or subsequent grantor with the Clerk of Council and the Clerk of

Superior Court.



4. With the exception of construction access drives, permanent streets,

amenities and utilities, a fifty-foot undisturbed natural buffer shall be

maintained by the developer and subsequent grantees on the south side of the

property adjacent to St. Mary?s Road. Said buffer may be used in the future for

road-widening purposes subject to compliance with applicable provisions of

Georgia law.

the 11th day of October, 2005; introduced a second time at a regular meeting of
