SUBJECT: Temporary and Limited Access, Chevron Products Co.,
5131 Miller Road
INITIATED BY: Department of Engineering
Recommendation: Approve the attached resolution authorizing a temporary and
limited access easement for Chevron Products Co. located at Miller Road.
Background: Chevron Products Company?s trucks do not presently meet their
standards for entrance into a terminal for loading gasoline. Chevron has
requested a temporary 20-foot easement on City Property for a new driveway
extension. This property is part of the City?s proposed ?Trail Improvements?
project located on the Miller Road railroad tracks. The easement will be
terminated when the City determines the easement interferes with development of
the project. The property will be returned to its original condition as no
cost to the City.
Analysis: The Traffic Engineering Division has investigated the request and
recommends approval.
Alternatives: A denial would prevent the improvement planned for the
property.
Financial Considerations: There are no costs to the City beyond administrative
cost.
Legal Considerations: Council must approve a ?Temporary and Limited Access
Easement Agreement? between the City and Chevron Products Company.
Recommendations/Actions: Approve the request for the temporary and limited
access.
RESOLUTION

A RESOLUTION AUTHORIZING A TEMPORARY AND LIMITED ACCESS EASEMENT FOR A NEW
DRIVEWAY EXTENSION ON CITY PROPERTY AT THE MILLER ROAD RAILROAD TRACKS FOR
CHEVRON PRODUCTS CO.

WHEREAS, Chevron Products Co., 5131 Miller Road, requests a 20 foot easement to
allow gasoline transports to meet Chevron standards for entrance into a
terminal to load product; and,
WHEREAS, the Chevron Products Co. and the City propose to enter into a
Temporary and Limited Access Easement Agreement to use the City?s property
located at the Miller Road railroad tracks as a 20 foot access easement; and,
WHEREAS, the City intends to construct a trolley line and walking and bicycle
trails (known as ?Trail Improvements) for said property, thus allowing the City
to only grant a temporary limited access easement until the City determines
that the easement interferes with the development of the Trail Improvements and
terminates said easement; and,
WHEREAS, upon termination of said easement, Chevron shall return the City?s
property to its original condition at no cost or expense to the City; and,
WHEREAS, the Traffic Engineer has investigated the request and recommends
approval.
NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA HEREBY RESOLVES:
That the City Manager s hereby authorized to execute a Temporary and Limited
Access Easement Agreement with Chevron Product's to extend the driveway onto
city property at the railroad tracks on Miller Road.
