SUBJECT: Quit Claim Deed

Recommendation: Authorize the City Manager to execute a Quit Claim Deed to

Gordon A. Cumbaa for an unnamed unopened road located adjacent to his

properties, identified on Tax Map #096 009 001 which is 50 ft x 511 +/- ft. and

Tax Map #096 014 001, 005 and 006 and one half of the road which is 50 ft

x1300? +/- ft. The road is identified in yellow on the enclosed tax map.



Background: Mr. Cumbaa purchased this property in 1985. Staff research

indicated the road has always shown unopened. Mr. Cumbaa desires to develop

the property with a traffic flow different from the unopened road.



Analysis: The unnamed unopened road adjacent to his properties identified on

Tax Map #096 009 001 which is 50 ft x 511 +/- ft. and on Tax Map #096 014 001,

005 and 006 which is 50 ft x 1300? +/- ft. This unnamed unopened road has been

identified on plats since1926.



Financial Considerations: N/A



Legal Considerations: Council must authorize the execution of the Quit Claim

Deedby the City Manager.





Recommendations/Actions: Authorize the City Manager to execute a Quit Claim

Deed to Gordon A. Cumbaa for a portion of an unnamed unopened road (50 ft x

511? +/- and 25 ft x 1300? +/-) that is adjacent to his properties.

A RESOLUTION AUTHORIZING THE EXECUTION OF A QUIT CLAIM DEED TO GORDON A. CUMBAA

FOR AN UNNAMED UNOPENED ROAD LOCATED ADJACENT TO HIS PROPERTY IDENTIFIED ON TAX

MAP PARCEL 096 009 001 IDENTIFIED AS 50 FT x 511 FT+/- AND 25 FT x 1300 FT A

PART OF THE 1300? x 50? +/- FT ADJACENT TO HIS PROPERTIES IDENTIFIED AS TAX

MAP PARCEL 096 014 001, 005 AND 006. THE PORTION OF THE ROAD ADDRESSED IN THIS

RESOLUTION IS IDENTIFIED IN YELLOW ON THE ENCLOSED TAX MAP.





WHEREAS, Mr. Cumbaa owns property on both sides of the unnamed road for a

distance of 511 +/- ft.; and owns property on one side of the road adjacent to

the unnamed road for distance of 1300 +/- ft. of an unnamed unopened road which

is adjacent to the properties identified as Tax Map #096 009 001 and Tax Map

#096 014 001, 005 and 006 be abandoned; and,



WHEREAS, the City has no present or future use of unnamed unopened road, and;



WHEREAS, Gordon A. Cumbaa wishes to include said unnamed unopened road with his

adjacent properties; and,



WHEREAS, all public utilities have sent written confirmation stating they have

no use for this unnamed unopened road: and,



WHEREAS, the Engineering Department has checked the unnamed unopened road and

approves abandonment of said portions of the unnamed unopened road.





NOW, THEREFORE, THE COUNCIL OF COLUMBUS, GEORGIA HEREBY RESOLVES AS FOLLOWS:



That the City Manager is hereby authorized by the Council of Columbus, to

execute said Quit Claim Deed to said unnamed unopened road portions, which are

hereby abandoned. A map and a copy of said Quit Claim Deed is also hereto

attached and by reference made a part of this Resolution.



Introduced at a regular meeting of the Council of Columbus, Georgia, held the

day of _____________ 2002 and adopted at said meeting by the

affirmative vote of _______ members of said Council.
